on school establishments
The Czech National Council decided on this law:

ČÁST PRVNÍ

BASIC PROVISIONS
§ 1
(1) The education system shall include preschool and school establishments, provided they are included in the school network, preschool and school establishments; they shall act on their behalf in legal relations and shall be responsible for such relations, unless otherwise specified. The method of inclusion in the network of schools, preschool establishments and school establishments shall be laid down in a separate law. 1) Preschool and school establishments may be combined or established as one legal person as regards preschool and school establishments of a single constituent.
(2) Preschool education is provided by preschool establishments. Education outside teaching, the system of further education of teachers and other school staff and vocational services to schools, preschool institutions and educational establishments are provided by educational establishments.

§ 2
Pre-school education ensures the satisfaction of the child's natural needs and the development of his personality; takes place in cooperation with the family and the pre-school establishment.
§ 3
(1) The preschool facilities are a kindergarten and a special kindergarten. One-class nursery school has at least 15 children, two or more classes have an average of 18 children in the class. If there is only one parent school with one class in the village, there are at least 13 children, a parent school with two or more classes has at least an average of 16 children in the class. Exemptions shall be decided by the Regional Authority, unless otherwise provided for in this Law.
(2) A parent school and a special maternity school follow-up to the education of children in the family and provide universal care for children aged between three and six.
(3) A parent school develops specific forms of education for children. It also works for children with health, education and social risks and for children with talent.
(4) A special nursery school provides care for children mentally or sensually or physically disabled or children with speech defects, children with multiple defects and children sick or disabled in a health care facility.
(5) Mental or sensory or physical disabled children and children with speech defects may be assigned to a parent school as referred to in paragraph 3 or to special maternity schools.
(6) A parent school and a special parent school are established primarily as a parent school and a special parent school with day and half-day care; they may also be established as boarding schools.
(7) Preschool or boarding school may accept children under 10 years of age for an exceptional or short stay.
(8) A parent school may establish interest groups. Activities in interest groups can also be attended by children who do not attend kindergarten. Interest ring activities may be carried out in return for payment. The remuneration shall be used for the partial reimbursement of the non-investment costs of the parent school.

§ 8
School institutions are education institutions and school purpose institutions.

SCHOOL EDUCATION
§ 9
The educational institutions are interest learning facilities, school recovery facilities, school education facilities for non-teaching and educational facilities for the performance of constitutional and protective education and preventive education.
EQUIPMENT FOR THE INTEREST STUDY
§ 10
An interest study of art is served by the school institutions of artistic production, by the interest study of languages of the state language school, by the interest study of stenotyping and writing by the state shorthand institution.
§ 12
School Institute of Art Production
(1) The School of Art is responsible for maintaining traditional and developing new artistic expressions, techniques and practical knowledge in the fields of folk art production and crafts.
(2) The Institute shall, in particular, conduct the interest education and teaching of pupils and adults, focusing on the field of folk art production, vocational education and teaching of pupils and adults for the needs of legal persons and natural persons engaged in folk art production and artisanal crafts, unless provided by the relevant secondary schools, and the design of designs and technical documentation needed for both interest and vocational education and teaching of pupils and adults in folk art production and artistic crafts.
(3) The Institute may be established as part of a secondary art school; carry out its tasks through courses, including in return.
§ 14
Language school
(1) The State Language School provides language education in the main world languages as well as in other languages; It also organises language learning with a professional focus and prepares language-based activities in international contacts, translation, interpretation and other activities.
(2) Study at the State Language School may be completed by a state language examination; This examination may also be carried out by a citizen who has not studied at a state language school. The State Language School may perform its tasks for consideration.
(3) State language schools may also be established as part of a secondary or primary school.
§ 15
State shorthand Institute
(1) The state shorthand institute teaches and teaches in the field of Czech and foreign language shorthand, typing, business correspondence, stenotyping in the Czech language and foreign languages, technology, mechanisation and rationalisation of administration and secretarial work. A state shorthand institution may perform its tasks for consideration.
(2) The study of the fields to which the public shorthand institute teaches may be completed by a state examination.
SCHOOL DEVICES
§ 16
School in nature
(1) School in nature is a school recovery facility which allows children to stay from pre-school institutions and pupils of schools or individual classes, or to stay of selected groups of pupils in a healthy environment without interrupting school education. Its mission is to compensate for the negative effects of the environment on the health of children and pupils living in areas with disabilities.
(2) Children from pre-school institutions, primary school pupils, special primary school pupils, special schools, support schools and pupils of those multi-annual colleges corresponding to a maximum of the ninth grade of primary school shall be sent to the school in nature.
(3) The counties may also establish and manage a school in nature outside their territorial districts in agreement with the municipality in whose territory the school is to be established in nature.
(4) For the purposes of this Act, the Government of the Czech Republic provides for a territory with an environment affected. In these territories, schools are not set up or held in nature.
School educational establishments for non-teaching education
§ 17
(1) Non-teaching education is part of education and education care; It is organised by schools and educational institutions for upbringing outside of school.
(2) School education facilities for non-teaching are leisure centres for children and youth, a school satellite, a school club, a school library and a youth home.
§ 19
Children and youth leisure centres
(1) The centres for the leisure of children and youth serve as educational and recreational centres.
(2) Freelance centres for children and youth are houses of children and young people with a wide range of interests and stations specialising in specific areas of interest.
(3) The Centre for the Leisure of Children and Youth may provide its services for remuneration.
§ 20
School Sanitary and School Club
(1) Education, education, interest and recreation of primary school pupils, primary school for sensory disabled pupils, primary school for pupils with multiple defects, primary school for pupils with speech defects, special school or auxiliary school, or primary school for disabled pupils, primary school for medical institutions serves at a time outside the teaching and during school holidays, the school's satellite and the school club. The School Satellite is intended for pupils in the first degree, the School Club for pupils in the other years of these schools and for pupils in those multi-annual colleges corresponding to a maximum of the ninth grade of primary school.
(2) A school satellite or a school club may establish interest rings. Under local conditions, pupils who are not enrolled in a school club or a school club may participate. Activities in interest circles may be carried out against payment. The remuneration shall be used for the partial reimbursement of non-investment costs.
(3) The School Satellite and the School Club may also be established as part of the School.
§ 21
School library
(1) The school library as part of a single system of libraries consists of the school library and the school teaching library.
(2) The school library is established as part of the school; it may also provide its services to the public, in return for payment.
§ 22
Youth Home
(1) The youth home provides pupils with secondary education, accommodation and meals. The content of the educational activity in the youth home follows the content of the educational work of the secondary school.
(2) Youth home can also be established as part of a school.
§ 31b
(1) Social care facilities in which persons with a disability (m2) are provided with education and training for appropriate work in accordance with the social security rules are also performed by educational institutions; These establishments can also perform the function of a centre of practical instruction.4)
(2) The Ministry of Labour and Social Affairs of the Czech Republic and the Ministry of Education, Youth and Sports of the Czech Republic (hereinafter referred to as "Ministry of Education") lay down generally binding legislation on the details of education and training in these establishments.

SCHOOL ACCOUNTING EQUIPMENT
§ 32
School purpose institutions help pre-school institutions, primary schools, special schools, secondary schools and educational establishments to perform educational tasks; they also provide further education of teaching staff or physical care of pupils during their stay at school.
EASTERN ADVICE EQUIPMENT
§ 34
Educational Adviser
Primary schools, special schools and secondary schools provide educational guidance tasks by educational advisers. The Ministry of Education shall determine the qualifications of the educational adviser by decree.
§ 35
Pedagogical-psychological counseling
(1) Pedagogical-psychological guidance helps to solve the educational and educational problems of pre-school children, primary school pupils, secondary schools and special schools and educational institutions, helps in the professional orientation of pupils and provides vocational teaching and psychological services for preschool institutions, schools and educational establishments.
(2) The pedagogical-psychological advisory body conducts educational and psychological examinations of children and pupils, providing methodological assistance to teachers and educational advisers in schools and psychologists in educational establishments.
SCHOOL STABILITY EQUIPMENT
§ 39
School cafeteria
(1) The school cafeteria provides meals for children and pupils and pre-school, school and school staff.
(2) The school canteen may provide additional catering services to children and pupils and pre-school, school and school staff, and may also provide public catering services in accordance with local conditions, subject to hygiene and safety standards.
(3) A school cafeteria may be established as part of a pre-school, school or educational establishment.
OTHER ACCOUNTING EQUIPMENT
§ 42
School economy
(1) A school farm is mainly a school farm, a school grooming, a school fishing and a school horticulture.
(2) The school economy carries out an objective task of creating conditions for practical teaching of pupils and their professional interest and developing vocational teaching work for school teachers.

FINAL AND REPEAL PROVISIONS
§ 45
(2) The Ministry of Education issues generally binding legislation on the activities of pre-school institutions and school establishments referred to in this Act, unless that competence falls under a special law to another central administration.
(3) By decree, the Ministry of Education sets out the length of studies and teaching plans and details of national language examinations in state language schools.
(4) The Ministry of Education sets out by decree the types and types of special maternity schools.
(5) The Ministry of Education sets out the details of the performance of constitutional education and protection education in an agreement with the central authorities involved, in a generally binding law.
(6) The Ministry of Education approves experimental verification of the organisation and forms of educational work in preschool and school establishments.
(7) The Ministry of Education may set up other school special-purpose establishments not covered by this Act.
§ 45a
Special Act 5) lays down the conditions under which the parents of children or their legal representatives are required to contribute to the partial reimbursement of the costs of the maternity school.
§ 45b
(1) Preschool and school establishments are required to keep the following documentation:
(a) a register of pupils (children), containing in particular their personal data, reception data, study or residence in an establishment, termination of studies or residence in an establishment;
(b) economic documentation and accounting records, property records, 5a)
(c) personnel documentation;
(d) other documentation provided for by law, unless the documentation is kept by the body or school of which the pre-school or school establishment is part.
(2) Pre-school establishments and educational establishments are required to transmit to the Ministry the data referred to in paragraph 1 (a) and the documentation and registration data kept in accordance with points (b), (c) and (d) in the form, dates and on the prescribed data medium established by the Ministry.
§ 45c
Preschool facilities established under the Decree of the Government of the Czech Socialist Republic No. 92 / 1978 Coll., on the establishment and operation of preschool facilities by socialist organisations, shall be considered as private preschool facilities provided that their promoters, within six months of the entry into force of this Act, submit to the Ministry of Education the formalities for the inclusion of preschool facilities in the school network, preschool facilities and educational facilities under a special law. 1)
§ 46
The scope established by the Regional Authority under this Act is the exercise of the delegation of the Region.
§ 47
They shall be deleted:
1. Sections 3, 4 and 22 to 24 of Act No. 186 / 1960 Coll., on the System of Education and Education (Education Act),
2. Article 21 of Decree-Law No 59 / 1964 Coll., on the tasks of national committees in the care of children,
3rd Government Decree No. 72 / 1961 Coll., on the establishment of nursery and nursery schools in common buildings.
§ 48
This Act shall take effect on 1 September 1978.
