DECLARATION
of 28 February 2017
amending Decree No. 392 / 2003 Coll., on the safety of the operation of technical equipment and on requirements for dedicated technical equipment pressure, lifting and gas in the event of mining and mining activities, as amended by Decree No. 282 / 2007 Coll.
The Czech Mining Authority provides pursuant to § 5 (3), § 6 (6) (a) and § 8a (8) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration, as amended by Act No. 542 / 1991 Coll. and Act No. 124 / 2000 Coll.:
Decree No. 392 / 2003 Coll., on the safety of the operation of technical equipment and on requirements for dedicated technical equipment by pressure, lifting and gas during mining and mining activities, as amended by Decree No. 282 / 2007 Coll., is amended as follows:
1. in Article 3 (3), the words "including its accessories" shall be added at the end of the text of point (a).
2. The following Section 3a is inserted after Section 3, including footnote 44:
(1) The installation and operation of the machinery referred to in Article 3 (1) (a) shall be carried out according to the design or drawing documentation of the equipment. The device can be put into service if the design documentation of the device is in the Czech language, corresponds to the actual state and contains in particular:
(a) a technical description and drawing of the machinery assembly, indicating:
1. specification of individual parts - products with the parameters required by the technological unit, including their connections and continuity;
2. calculations of supporting structures and structures for proper walking;
3. specification and location of safety guards, stop stops and other passive safety devices;
4. specifications, location and settings of safety sensors, end switches, operational meter,
5. technological continuity of individual components, indicating mutual blocking, prohibited states and limit values, location of filters, use of dilation connections,
6. the way in which the connections of individual parts are carried out, in particular the appropriate welding technology and the way in which they are checked after welding,
7. after assembly and time limits of any subsequent tests and revisions,
(b) the signature of the designer by the installation of the machinery referred to in paragraph 2 confirming his consent to the project documentation, the registration number of his certificate and the date of signature;
(c) the signature of the designer by the installation of the machinery in the event of changes in the project documentation corresponding to the actual state of agreement with the amendments in question, the registration number of his certificate and the date of signature. For changes which do not affect safety, it shall be sufficient to draw the change into the project documentation by the responsible staff member and to approve the technician responsible for managing the installation, operation and maintenance of the machinery referred to in paragraph 3.
(2) The installation of machinery can be designed by a competent person who meets the requirements of the professional qualification of the designer by the installation of machinery (44).
(3) In order to manage the installation, operation and maintenance of the machinery referred to in Section 3 (1), the organisation shall determine the technology responsible for managing the installation, operation and maintenance of the machinery. This technique must have at least a secondary education with a technical focus and at least two years of experience.

3. In Section 6 (3) of the Introductory Part of the Provisions, the words "which operate with a gas whose critical temperature is less than 50 ° C or with a substance for which the absolute vapour pressure is greater than 3 bar at 50 ° C and which is used 'are inserted as" technical equipment'.
4. In Article 7 (5), the words "and (f) 'shall be added at the end of the text in point (a).
5. in Article 7 (5) (b), "to (f)" is replaced by "to (e)";
6. In Paragraph 12 (9), the words "or traffic facilities in vertical underground workshops 17 'shall be inserted after the words" underground'.
7. Paragraph 17 (1) is deleted and paragraph 2 is deleted.
8. In Section 17, the words "I and 'shall be inserted after the words" reserved gas class technical equipment'.
9. In Annex 7, Part III, point 2, point (d) is deleted.
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This Decision shall enter into force on 1 June 2017.
