THE LAW
of 7 February 2012
amending Act No. 229 / 1991 Coll., on the treatment of property relations with land and other agricultural property, as amended
Parliament has decided on this law of the Czech Republic:
In Article 13 of Act No. 229 / 1991 Coll., on the modification of property relations with land and other agricultural property, as amended by Act No. 39 / 1993 Coll., Act No. 183 / 1993 Coll., the Constitutional Court's finding, published under No. 29 / 1996 Coll., Act No. 30 / 1996 Coll., Act No. 253 / 2003 Coll. and the Constitutional Court's finding, published under No. 531 / 2005 Coll., paragraph 8 is added:
"(8) Paragraphs 6 and 7 shall not apply to:
(a) an authorised person who has acquired the right to another land pursuant to § 11 (2) of this Act, as amended by Act No. 183 / 1993 Coll., and its heir,
(b) a relative in a series of direct, spouse, partner or siblings of the person referred to in point (a) who transfers to him the right to another property pursuant to Article 11 (2) of this Act, as amended by Act No. 183 / 1993 Coll.,
Paragraph 11a shall apply mutatis mutandis to the procedure for the transfer of another parcel. '
Transitional provisions
1. Paragraph 13 (8) (b) of Act No. 229 / 1991 Coll., on the treatment of property relations with land and other agricultural property, as amended by this Act, also applies to the transfer of the right between the authorised person or his heir who has acquired the right to another land pursuant to § 11 (2) of Act No. 229 / 1991 Coll., as amended by Act No. 183 / 1993 Coll., on the one hand, and to relatives in a series of direct, spouse, partner or siblings on the other hand, carried out no later than the date of its effectiveness.
2. Article VI of Act No. 253 / 2003 Coll., amending Act No. 95 / 1999 Coll., on the Conditions for the Transfer of Agricultural and Forestry Land from State Property to Other Persons and amending Act No. 569 / 1991 Coll., on the Land Fund of the Czech Republic, as amended, and Act No. 357 / 1992 Coll., on Inheritable Tax, Donation Tax and Real Estate Transfer Tax, as amended, as amended, Act No. 253 / 2001 Coll., and certain other laws do not apply to:
(a) an authorised person who has acquired the right to another land pursuant to § 11 (2) of this Act, as amended by Act No. 183 / 1993 Coll., and its heir,
(b) a relative in a series of direct, spouse, partner or siblings of the person referred to in (a) who transfers to him the law referred to in Article 11 (2) of this Act, as amended by Act No. 183 / 1993 Coll.,
Efficacy
This Act shall take effect on the day of its publication.
