DECLARATION
Federal Ministry of Fuel and Energy
of 25 April 1988
amending and supplementing Federal Ministry of Fuel and Energy Decree 172 / 1982 Coll., on the basic conditions of supply of heating gases, oil and gazoline
The Federal Ministry of Fuel and Energy, in agreement with the participating central authorities and the State Arbitration of the Czechoslovak Socialist Republic, provides for the provisions of Section 392 (1) of the Economic Code and Article 26 of Act No. 67 / 1960 Coll., on the production, distribution and use of heating gases (Gas Act):
Decree No. 172 / 1982 Coll., on the basic conditions of supply of heating gases, oil and gazoline, is amended as follows:
1. In Article 7 (1), the following sentence is added at the end:
"This obligation shall not apply to the withdrawals referred to in paragraph 7. ';
2. Paragraph 7 (7) reads as follows:
"(7) For newly built plants and plants or, where applicable, reconstructed sampling facilities, the supplier shall negotiate with the customer, during the period of their construction and putting into service, specific conditions of collection, in particular the method of rectifying the collection at the time of publication of the regulatory measures and evaluating consumption. The duration of the special conditions shall be determined taking into account the technical conditions of the customer for the period strictly necessary. The daily sampling diagram shall be agreed to the estimated value. ';
3. Article 13 (2) reads as follows:
"(2) The swelling curves are:
1. curve - basic sampling according to agreed diagram,
2. curve - quantity contracted reduced; this does not concern health, education, housing, etc.,
3. Curve - collection reduced to contracted level of safety and technical minima. The reduction shall not concern the necessary health services, the daily supply of the population with essential living needs and special agricultural establishments. ';
4. Paragraph 13 (3) (b) reads as follows:
"(b) for customers of a heating character [§ 2 (2) (b)]

5. the last sentence of Paragraph 25 (1) (b) shall read as follows:
"In the event of a finding of breach of customer discipline when imposing regulatory measures on customers of a technological nature and on the 3rd heating curve for customers of a heating character, periodic penalty payments shall be calculated over the whole period of regulation after each day. ';
6. In Paragraph 25, the following paragraph 2 is inserted after paragraph 1:
"(2) Collectors with agreed special conditions of collection pursuant to Article 7 (7) shall be penalised only if they declare restrictive degrees and emergency stages. '
Paragraph 2 shall become paragraph 3.
This Decree shall take effect on 1 June 1988.
