on requirements for national reference laboratories and reference laboratories in the field of activities defined by the Act on the Central Audit and Examination Institute of the Agricultural
According to Article 5 (9) of Act No. 147 / 2002 Coll., on the Central Audit and Examination Institute of Agriculture and on the amendment of certain related laws (Act on the Central Audit and Examination Institute of Agriculture), as amended by Act No. 279 / 2013 Coll., ("the Act '):
§ 1
Subject matter
This decree, following directly applicable European Union1) sets out additional requirements for material and personnel equipment and for the targeting, organisation and methods of operation of national reference laboratories of the Central Control and Testing Institute of Agriculture (hereinafter referred to as the Institute) and reference laboratories.
§ 2
Requirements for laboratory material and personnel equipment
(1) For the national reference laboratories of the Institute, the requirements are laid down in the directly applicable European Union1).
(2) The natural or legal person entrusted by the Institute pursuant to Article 5 (4) and (5) of the Act with the activities of the Reference Laboratory for the pursuit of professional activities under Article 5 (1) of the Act must have, in addition to the requirements laid down directly applicable by European Union1)
(a) equipment, instructions and procedures for the use, storage, maintenance and other handling of equipment and material within the scope of the professional activities for which it is to be entrusted;
(b) a procedure for the transport, reception, storage and disposal of samples, including measures against contamination and degradation, and a system of clear identification of samples for the activities for which they are to be entrusted; and
(c) the conditions for granting authorisation under the Feed Act or Fertiliser Act (2) are fulfilled.
§ 3
Requirements for laboratory targeting, organisation and methods of operation
(1) The National Reference Laboratories of the Institute, in addition to the obligations arising from the directly applicable European Union1 Regulations, further ensure:
(a) carrying out laboratory tests;
(b) development, verification and validation of new laboratory procedures and cooperation on research, development, verification and validation of new laboratory procedures;
(c) cooperation on the development and validation of technical standards at national, European and international level and other international practices;
(d) the publication of the uniform working procedures referred to in Article 3 (1) (a) of the Act and their continued addition;
(e) the organisation of inter-laboratory comparative tests pursuant to Article 3 (1) (c) of the Act;
(f) carrying out analyses in the case of disputes concerning the accuracy of the results of laboratory tests;
(g) supporting documents for the granting, modification, withdrawal or revocation of the mandate granted by the Institute pursuant to Article 5 (1) of the Act proving the competence of the laboratories of a natural or legal person;
h) the pursuit of professional activities under Section 5 (1) of the Act;
(i) an assessment of the activities of bodies and reference laboratories referred to in (f); and
(j) the documents for the publication of the list of reference laboratories authorised by the Institute pursuant to Article 5 (4) and (5) of the Act in the Bulletin of the Central Audit and Examination Institute of the Agricultural Institute.
(2) National reference laboratories of the Constitution and reference laboratories, in addition to the obligations arising from the directly applicable European Union1)
(a) apply current procedures and methods in their activities;
(b) ensure the mutual exchange of information at national and international level; and
(c) carry out in their field of activity the number of laboratory tests corresponding to the method in question which will enable the establishment of a functional quality control system.
§ 4
Repeal
The following shall be deleted:
1. Decree No 528 / 2004 Coll., on requirements for national reference laboratories and reference laboratories in the field of activities covered by the Act on the Central Audit and Examination Institute of the Agricultural.
2. Decree No. 204 / 2012 Coll., on the technical requirements for the designation of the Reference Laboratory.
§ 5
Efficacy
This Decree shall take effect on the 15th day following that of its publication.

Commission Regulation (EC) No 1981 / 2006 of 22 December 2006 on detailed rules for the application of Article 32 of Regulation (EC) No 1829 / 2003 of the European Parliament and of the Council as regards the Community reference laboratory for genetically modified organisms, as amended. Commission Regulation (EU) No 283 / 2013 of 1 March 2013 laying down data requirements on active substances in accordance with Regulation (EC) No 1107 / 2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market. Commission Regulation (EU) No 284 / 2013 of 1 March 2013 laying down data requirements on plant protection products in accordance with Regulation (EC) No 1107 / 2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market.
2) Act No. 91 / 1996 Coll., on Feed, as amended. Act No. 156 / 1998 Coll., on fertilisers, auxiliary substances, auxiliary plant preparations and substrates and on agrochemical testing of agricultural soils (Fertilisers Act), as amended.
