DECLARATION
Czech Mining Office
of 31 March 1994
on ensuring safety of work and operation at bulk storage facilities
The Czech Mining Office provides pursuant to § 6 (6) (a) of the Act of the Czech National Council No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration:
§ 1
Scope
(1) The Decree applies to legal and natural persons (hereinafter referred to as "organisations"), 1) dealing with the design, construction, manufacture, assembly, operation, service, maintenance, reconstruction and repair of bulk storage facilities in mining and mining activities.
(2) The Decree does not apply to underground storage facilities resulting from mining works in natural rock structures.
§ 2
Interpretation of terms
For the purposes of this decree:
(a) a storage facility for bulk materials (hereinafter referred to as "storage facilities") of a stable facility or spatial structure allowing storage of bulk material, the volume of which exceeds 3 m3 and in which bulk matter of a height exceeding 1500 mm may be stored;
(b) storage of bulk filling materials, storage and emptying of storage facilities;
(c) bulk material composed of individual particles with a consistency resulting from friction, the bulk angle of which, expressed in degrees, is formed by a horizontal plane and the surface line of the free cone does not exceed 60 °;
(d) continuous monitoring of the work of workers and the status of the workplace in which the worker designated by the operator must not be removed from the workers and must be employed by nothing but supervision;
(e) dangerous space where there is a risk of falling into the open space, and places at risk of flooding, explosion, high temperatures, chemicals, static electricity, electricity, etc.
Design, construction and production of storage facilities
§ 3
(1) The design and construction of storage facilities must address all known risks to the life and health of persons, as well as the safety of technical installations, and must provide for measures to prevent emergency situations, in particular to avoid the creation of vaults, funnels, overhangs or to avoid the cladding of stored bulk material on walls when storing bulk materials.
(2) Parts of equipment are designed to withstand the highest permissible pressure or vacuum.
(3) Storage facilities shall be protected against the dangerous effects of static electricity and shall be protected against adverse effects of power supply.
(4) The design shall ensure safe access to the internal storage area.
§ 4
(1) The accessories of the storage facility and parts thereof shall be so placed as to:
(a) the controls are safely accessible and their purpose and function are permanently and clearly marked with symbols or inscriptions;
(b) the main electrical power switch and other power supply for storage facilities shall be capable of being secured in an off-mode position;
(c) the openings for entering the storage facility have no dimensions of less than 700 mm;
(d) no outlets or other components have interfered in the inlet space;
(e) the entry openings located below the highest level of stored materials are opened inside.
(2) In cases where the accumulation of gas, dust or mixtures thereof in explosive concentrations cannot be excluded in the storage of bulk materials, all necessary measures should be taken to prevent the explosion and to limit its possible consequences, in particular:
(a) preventing the formation of an explosive mixture of gases or dust;
(b) preventing ignition sources from occurring;
(c) the use of blast-resistant systems;
(d) taking measures to contain the explosion.
General requirements for equipment
§ 5
The documentation from the storage facility manufacturer (s) shall include data on:
(a) technical parameters and description of the storage facility;
(b) the type and characteristics of the bulk materials for which the plant is intended to store;
(c) instructions for installation, operation and maintenance, including maintenance and repair plans;
(d) prohibited activities;
(e) the measures necessary to enter the storage facility.
§ 6
(1) Storage facilities must be permanently marked in a visible place with data on:
(a) manufacturers and, where appropriate, suppliers;
(b) year of manufacture, production number, type,
(c) the type of bulk storage;
(d) an indication of the internal environment in terms of risk of explosion, fire or other hazards,
(e) the maximum permissible operating value.
(2) A storage facility which is part of a technological installation may bear the marking referred to in paragraph 1, together with other data on that installation.
(3) The storage facility from which bulk mass is removed by vehicles is defined as the largest dimensions of vehicles allowed to pass.
§ 7
For the safe operation of the storage facility it is essential that
(a) the floors of the operating and maintenance workspaces were flat, undamaged, without obstacles, no slippery and outdoor platforms, footboards and staircases were constructed so that dust, mud, water and other substances would not accumulate on them;
(b) for service and control posts located more than 500 mm above the floor level, platforms or bridges of at least 500 mm wide have been established;
(c) safe approaches with a width of 500 mm or more have been firmly built into platforms and platforms;
(d) a storage facility in which all functional and handling points are not directly visible from the control point has been equipped with appropriate signals to alert persons to bring the equipment into operation;
(e) where the concentration of pollutants exceeds the limits of the permitted values laid down in the applicable rules, the storage facility shall be equipped with a pollution separation device;
(f) the pressure relief device prevents the safe working pressure in the system being exceeded when filling is carried out by blowing;
(g) the safety device prevents the creation of an underpressure exceeding the permissible value when filling is carried out by suction;
(h) the automatic device has stopped filling when the storage device filled is automatically fully filled.
§ 8
Protective equipment
(1) In order to protect both individuals and storage facilities, it is necessary to install equipment which:
(a) prevent access to sources of danger, dangerous contact or capture of persons and parts of their clothing;
(b) prevent persons from falling,
(c) to protect persons and equipment from falling, departing or scattered bulk matter;
(d) prevent the undesirable entry of foreign objects into mechanisms or equipment;
(e) reduce noise, reduce dust and prevent the dispersion of loose matter.
(2) Installed protective devices must be protected against spontaneous release; the removable parts shall be locked with a key or other tool.
(3) The size and shape of the holes of the protective devices are determined taking into account the distance of the source of danger from the cover, structure and size of stored bulk materials and the possibility of forfeiting persons or objects. The gap between bars or mesh dimensions of rigid wire nets shall not exceed 200 mm.
§ 9
Inputs and openings into the storage facility
It is essential that
(a) entrances and openings to closed storage facilities are secured against unwanted entry and fall of persons;
(b) bars, grates, etc., which need to be moved for operational reasons, have no openings the size of which would allow the foot to fall,
(c) the discharge holes correspond to the characteristics of the stored bulk mass and their seals are in such a way that they cannot be accidentally opened and ensure reliable leakage for the material under consideration and for maximum allowable pressure or vacuum;
(d) for open storage facilities where there is a possibility of permanent access to the upper opening, the protection preventing the fall into the interior of the device, the barrier formed by a fixed double-bar railing having the upper handle fixed at a height of 1,1 m
§ 10
Operational documentation
The operator shall indicate in the operational documentation:
(a) personnel authorised to operate, operate and maintain equipment;
(b) the dates, scope and manner of maintenance;
(c) arrangements for entering the storage facility, in particular the working process, the way in which the signal or communication is made, the provision against unintended start-up, the security of workers and their entry at least two additional workers with a line of continuous surveillance, etc.,
(d) measures to ensure safety of work in a harmful environment in the detection of hazardous substances;
(e) the method of securing entry holes into closed storage facilities;
(f) the operator's procedure if emptying is interrupted;
(g) the dates and scope of checks on the properties of stored bulk materials in terms of possible self-ignition, explosion, etc.,
(h) prohibited operations and activities, in particular entry through the discharge hole, unless the storage facility is empty, entering the stored material, controlling the storage device closure from the loading area of the means of transport and stalling on the loading area throughout its filling or emptying, cleaning, repairing, adjusting the storage facility in operation, unless expressly permitted, handling by an unauthorised person, etc.,
(i) requirements for protection against static electricity discharge.
§ 11
Operation of storage facilities
In order to ensure the safe operation of the storage facility, it is necessary
(a) operate storage facilities in accordance with the operational documentation;
(b) provide constant lighting of the permanent operating site and of the places where persons are present in storage facilities, including their accessories and surrounding areas (e.g. a tie conveyor is not considered as accessories),
(c) identify the type, meaning and use of warning signs and inform the relevant staff;
(d) identify the sources of danger by means of safety colours, marks and tables;
(e) keep evidence of maintenance carried out;
(f) prevent the restocking of stored bulk in the vicinity of fillers of storage facilities located below the ground level or the floor above 1500 mm from the surrounding ground or floor level;
(g) in the event of an emergency, take measures to ensure that, according to the nature of the work carried out, personal protective equipment and work equipment are available to workers under the conditions of operation and the nature of the bulk storage;
(h) personal protective equipment and equipment, such as safety belts and harness, additional and safety ropes, etc., to be stored in the prescribed manner, to be placed in the applicable state after each use and to verify their reliability and functionality by regular tests and inspections at specified times;
(i) arrange for inspections of storage facilities and their accessories at specified times, including inspections of pressure or vacuum-controlled security devices;
(j) ensure that the storage facility is immediately disabled until the fault has been remedied when a fault is detected which endangers the safety of work and operation.
§ 12
Transitional provisions
(1) The design, construction and production requirements under this Decree apply to those storage facilities the design, construction and production of which started after the date of its entry into force.
(2) Storage facilities put into service before the entry into force of this Order may be operated provided that they comply with the requirements of generally binding legislation in force at the time of entry into service. During the reconstruction or overhaul, these devices shall be brought into conformity with this decree.
§ 13
Exceptions
(1) The provisions of this Decree may be derogated from to the strictly necessary period in cases where there is a risk of delay in the rescue of persons or of the liquidation of an operational accident (accident), (2) where the necessary safety measures are implemented.
(2) The Czech Mining Authority may, where justified, allow exemptions from the provisions of Sections 10 (h) and 11 (f), following a request submitted together with a proposal for a replacement measure.
§ 14
Final provisions
The decree of the Czech Labour Safety Authority and the Czech Mining Authority No. 92 / 1985 Coll., on ensuring the safety of the work of stable bulk containers, does not apply to organisations carrying out mining or mining activities on the date of entry into force of this decree.
§ 15
Efficacy
This decree shall take effect on the day of its publication.
