DECLARATION
of 15 March 2013
amending Decree No 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans, as amended
The Ministry of Agriculture provides pursuant to Article 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 308 / 2011 Coll. and Act No. 359 / 2012 Coll., for implementation of Section 10 (3) of the Act:
Decree No. 299 / 2003 Coll., on measures to prevent and control diseases and diseases communicable from animals to humans, as amended by Decree No. 356 / 2004 Coll., Decree No. 389 / 2004 Coll., Decree No. 214 / 2005 Coll., Decree No. 36 / 2007 Coll., Decree No. 316 / 2007 Coll., Decree No. 288 / 2008 Coll., Decree No. 12 / 2010 Coll. and Decree No. 161 / 2012 Coll., are amended as follows:
1. In § 1, § 5 (1), § 6 (1) and (2), § 7 (1) and (5), § 10 (1) of the introductory part of the provision, § 11 (1) of the provision and point (a), § 15 (1) (a), § 24 (1), § 31 (c), § 32 (1) (c) (5) and (2) (c), § 34 (1) (a) (2), § 36 (1) (c), § 37a of the introductory part of the provision, § 38 (h), § 89, § 95 (1) (c) (5), § 97 (1) (a) (a) (a) (1), § 150 (1) (i), Annex No 6 (27), Annex 12, paragraph 3 (a), Annex 23 (1) (4 (b) (b), and (2) (b) (b) of Annex 24 (1) (1) (1) (1) (1) (1) (a) (1), Annex I), Annex I (i) The amount to be reported in column 060 of this row: In point 2 (a), the words "the European Communities' are replaced by the words" the European Union '.
2. In footnote 1a, the last sentence is replaced by the sentence "Regulation (EC) No 1069 / 2009 of the European Parliament and of the Council of 21 October 2009 laying down health rules concerning animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No 1774 / 2002 (Animal by-products Regulation). '.
3. footnote 1 shall read:
"(1h) Article 3 (1) of Regulation (EC) No 1069 / 2009 of the European Parliament and of the Council. ';
4. footnote 2 shall read:
"(2) Regulation (EC) No 1069 / 2009 of the European Parliament and of the Council."
5. In Paragraph 138 (1), the word "detected 'is replaced by" certified by the Regional Veterinary Administration'.
6. In Article 138 (2), at the end of paragraph 2, the dot is replaced by "a 'and the following point (s) is added:
"s) breeding bees with good cleansing instinct."
7. In Section 139 of the Introductory Part of the Provisions and in Section 140 (1) of the Introductory Part of the Provisions, "(d) 'is replaced by" (c) and (d)'.
8. In Article 139 (1) (c) (1), the words "the closure of an object and its closure 'are deleted and the words" the site' are inserted after the word "the marking '.
9. In Article 139 (1) (c) (2), the words "the sale and any movement of honey and other bee products, with the exception of transfers for industrial processing 'are replaced by the words" which have come into contact with bees or their products from a designated post'.
10. in Article 139 (1) (c), the following point 3 is inserted after point 2:
'3. for the feeding of bees, a prohibition on the use of honey coming from a designated habitat or a honey whose part of the honey is from a designated habitat; ';
11. In Paragraph 139, the dot is replaced by a comma at the end of paragraph 1 and the following point (e) is added:
"(e) carry out an epidemiological inquiry."
12. in Article 140 (1) (a), the word "at least" shall be inserted after the word "circuit" and the word "epidemiological" shall be inserted after the word "taking into account."
13. in Paragraph 140 (2):
"(2) The Regional Veterinary Administration shall, in accordance with Articles 15 and 49 (1) (c) and (d) of the Act, further order the breeder for whom the presence of the disease has been confirmed
(a) 15% or more of the hives at the post, the immediate disposal of all hives at the post, as well as of hives, containers, desks and other apiculture accessories and tools used in the handling of bees and their products, provided that their effective disinfection cannot be ensured, in particular in the case of metal articles, with a previous or subsequent flame-burning process; However, this does not apply to the buildings and structures of bees and nomadic cars; or
(b) in less than 15% of the hives at the site, the immediate destruction of all hives with confirmed disease and hives, and at the same time effective disinfection of all apiculture accessories and instruments which have come or may have come into contact with hives with confirmed disease. If, within a period of 1 year from the date of the destruction of hives with a confirmed presence of the disease, the regional veterinary administration shall order the destruction of hives and establishments referred to in paragraph 2 (a) to be re-confirmed by the presence of the plague or rotting of the bee fruit.
The breeder shall carry out the culling of the hives with petrol and immediately thereafter ensure the beekeeping closure of the hives. The destruction of hives by burning them shall take place no later than the following day after the killing; all flammable material is disposed of at the same time. ';
14. In Article 140 (3), the words "as referred to in paragraph 2 (a) or in paragraph 2 (b) and hives' shall be inserted after the words" as regards the establishment '.
15. In Paragraph 140 (4), the words "before and under beekeeping trips and effective disinfection by burning after previous mechanical cleaning and scraping of all solid, in particular metallic," shall be deleted and the words "normally used" shall be replaced by the words "shall apply."
16. In Article 140 (5), the words "for single use '," (rubber or disposable use)' are inserted after the words "gloves', and the words" footwear and rubber gloves' are replaced by the words "and footwear '.
17. in Paragraph 141, the words "in accordance with" shall be replaced by the words "in the manner laid down."
18. in Article 142 (1) (a) and (b), the words "pursuant to Article 140 (2)" shall be inserted after the words "the establishment."
Efficacy
This Decree shall take effect on 1 April 2013.
