of 31 May 1984
on the eligibility conditions of ISO series 1 containers for safe and smooth operation
The Federal Ministry of Transport provides in the agreement with the participating central authorities pursuant to § 29 of Act No. 51 / 1964 Coll., on Railways:
(1) ISO Container Series 1 (hereinafter referred to as "container") means a means of transport, (1) which must facilitate the transport of consignments by one or more modes of transport, be adapted for handling mechanisms and for this purpose equipped with upper and lower corner elements, enabling the mechanisation of loading, transhipment and unloading operations as well as the automation of sorting operations. A container equipped with a specific device which is used when the container is empty shall bear a limited use of the device.
(2) Container also means accessories and equipment of the container which are transported with the container.
(3) Only a container the type of which has been approved may be in service; (2) it has an approval plate and it shall bear:
(a) labelling in accordance with relevant international agreements, 3)
(b) the marking of the tests carried out, periodic and special examinations;
(c) other particulars (prohibition of loading of certain goods, etc.), laid down by special regulation.4)
(1) The operator (owner) of the container shall be responsible for the technical condition of the container and for its introduction to periodic and extraordinary inspections and repairs of damaged containers. In particular, it shall:
(a) within 5 years of the date of manufacture of the container, ensure the first periodical inspection of the container (5) and its approval (§ 4 (3));
(b) ensure, within 30 months, a subsequent periodic inspection of the container (5) and its approval (§ 4 (3));
(c) ensure, within 1 year, a subsequent periodic inspection of the thermal container and its approval (§ 4 (3));
(d) arrange for inspection and repair of containers intended for the transport of dangerous goods within the time limits specified by the Special Regulation (6) and their approval (§ 4 (3));
(e) to arrange for an emergency inspection and repair after a crash or other emergency and its approval (§ 4 (3));
(f) to arrange for an emergency inspection of refrigerating or heating containers after ship transport and its approval (§ 4 (3)),
(g) ensure that the tests are carried out after repairs and approved (Section 4 (3)).
(2) The inspection, repair and testing of containers is authorised by the authority or organisation which will have a certificate of competence to carry out this activity (Section 4 (4) (a)). The administrator (owner) shall communicate the following information:
(a) the date and place of manufacture of the container;
(b) the manufacturer's identification number (if any);
(c) the maximum gross weight;
(d) proof that the container has been manufactured according to an approved type (type number) and a mass production permit;
(e) the result of the previous inspection (tests, checks) of the container,
(f) other particulars necessary to complete the approval mark.
(1) In the manufacture of containers it detects the characteristics of the container produced, checks and approves its competence, safety and operability of the Czechoslovak shipping registra.7) The Czechoslovak shipping register checks and tests the number of containers it considers necessary at any stage of production of the container of the approved type.
(2) The Czechoslovak shipping register must, in the exercise of technical supervision, monitor, inter alia, whether the manufacturer has established an internal control system in production which ensures that the containers manufactured by it comply with the requirements laid down and that the records of the containers manufactured will contain the manufacturer's identification number, the date of delivery and the name of the container manager (s) for which the container is manufactured and to which it will be delivered.
(3) The manufacturer shall inform the Czechoslovak shipping register of the start of production of each new series of approved container type.
(4) The manufacturer shall keep a clear list of the containers manufactured according to the approved type.
(1) How the maintenance, inspection, inspection and repair of containers are organised, whether their competence, safety and operability is ensured and whether the conditions for the maintenance and repair of containers 8) to the appropriate extent and type are ensured, is monitored by the state technical officer. 9)
(2) State expert technical supervision shall monitor whether workers in the handling, maintenance and repair of containers are competent for the performance of their activities and if they are regulations issued by the administrator (owner) of the container to ensure the safety of persons and goods in the handling of containers in accordance with this Decree and other regulations.
(3) If the inspection, repair or test ensures the safety and operation of the container, the State technical supervision will approve it. The approval authorises the organisation responsible for carrying out the repair, inspection and testing of containers to affix the container with an approval plate.
(4) State technical supervision shall assess whether the container is fit for safe and smooth operation:
(a) verify that the organisation which corrects, revises and tests the containers has competence in this activity and gives it the relevant certificate;
(b) examine and certify the professional competence of workers to carry out container inspections and tests;
(c) evaluate the technical level of welding and issue the relevant certificate of competence and welding of containers;
(d) records serious failures (accidents) in containers and accidents occurring during the operation, maintenance, repair and testing of containers.
This Decree shall take effect on 1 January 1985.

5) The guidelines for carrying out periodic inspections of the CSLA containers and for their approval are laid down in an agreement with the Federal Ministry of Defence.

7) Technical supervision shall be carried out on the basis of the FMD measures 26246 / 76 - 021 of 11.1.1977 and according to the Rules for Containers adopted at the Conference of the Registers of the Member States of the Intergovernmental Agreement of 15.12.1961 on cooperation in the field of technical surveillance (Annex 3 to the XV. Meeting of the FVHP Protocol). Rules for containers of the Czechoslovak register approved by the Federal Ministry of Transport under No 15822 / 73-28.
8) Designated technical equipment (§ 20 paragraph 2 of Act No. 51 / 1964 Coll., as amended by Act No. 104 / 1974 Coll.).
