GOVERNMENT REGULATION
of 27 February 2013
on the conditions for evaluating the results of research, experimental development and innovation
The Government mandates, pursuant to Article 49 (6) of Act No. 218 / 2000 Coll., on budgetary rules and on the amendment of certain related laws (budgetary rules), as amended by Act No. 26 / 2008 Coll., to implement § 3 (3) (e) of Act No. 130 / 2002 Coll., on the promotion of research, experimental development and innovation from public funds and on the amendment of certain related laws (Act on the promotion of research, experimental development and innovation), as amended by Act No. 110 / 2009 Coll.:
§ 1
Substantial or financial evaluation of exceptional research, experimental development and innovation results
(1) The evaluation of exceptional research, experimental development and innovation results under the Law on the promotion of research, experimental development and innovation may be granted to the natural person who has achieved such results. The evaluation of exceptional results of research, experimental development and innovation may be granted by:
(a) the government as:
1. national government prize in the form of a financial award of CZK 1 000 000,
2nd prize of government awarded to a student in the form of a financial award to 3 students in the amount of CZK 50,000 each,
b) Provider under the Act on the Promotion of Research, Experimental Development and Innovation, which is an organisational component of the State (hereinafter referred to as "Provider") in the form of a financial or material valuation up to the amount or value of up to CZK 500,000.
(2) The prize of government to a gifted student is awarded to one student in the category
(a) student of secondary and higher vocational school;
(b) a student in a Bachelor's or Master's degree programme;
c) a student in a doctoral study programme.
(3) The government shall decide on the award of the national government or the award to a gifted student on a proposal from the Research, Development and Innovation Council (hereinafter referred to as the Council). This award is provided from the budget chapter of the Office of the Government of the Czech Republic and can only be awarded once in a calendar year.
(4) The award of the valuation referred to in paragraph 1 (b) shall be decided by the relevant provider on the basis of whose support the result has been obtained and from whose budget chapter the valuation is provided. The provider may award one or more awards in one calendar year, with the fact that the aggregate value of the valuation of that provider in one calendar year may not exceed CZK 500,000.
§ 2
Financial award of promotion or popularisation of research, experimental development and innovation
(1) A financial evaluation of the promotion or popularisation of research, experimental development and innovation under the Research, Experimental Development and Innovation Support Act may be awarded to a natural person for an important work in the field of research development, experimental development and innovation, including promotion or popularisation thereof, or to a natural person who has largely deserved to promote or popularize research, experimental development and innovation by publishing, passing on or otherwise popularly disseminating knowledge and knowledge in research, experimental development or innovation.
(2) The valuation referred to in paragraph 1 may be awarded:
(a) the President of the Council as the Prize of the President of the Research, Development and Innovation Council;
(b) any provider whose budget chapter provides support for research, experimental development and innovation.
(3) The evaluation referred to in paragraph 2 (a) is provided from expenditure on research, experimental development and innovation of the budget chapter of the Office of the Government of the Czech Republic and can be awarded only once in one calendar year of up to CZK 400,000.
(4) The valuation referred to in paragraph 2 (b) shall be provided from the budget chapter of the provider which has decided to award the valuation. In one calendar year, the provider may award more awards, with the fact that the aggregate value of the valuation of that provider in one calendar year may not exceed CZK 500,000.
§ 3
Selection of the award candidate
(1) The Council shall follow the following criteria when selecting a candidate for the national government award:
(a) the contribution of the candidate to research, experimental development and innovation for the Czech Republic;
(b) the international importance of the results achieved by the candidate; and
(c) the activity of the candidate in the field of research, experimental development and innovation, including in particular participation in research, experimental development and innovation projects, publishing and teaching activities and membership of scientific bodies or organisations.
(2) When selecting a candidate for the award of a government award to a student, the Council assesses in particular the quality and benefit of the results of its research, experimental development and innovation.
(3) When selecting a candidate for evaluation pursuant to § 1 (1) (b), the provider shall assess in particular the benefits of the results achieved by the candidate in the field of research, experimental development and innovation, or the application of these results, for the Czech Republic and the international importance of the results achieved by the candidate.
(4) The selection of the award candidate referred to in Article 2 (1) shall in particular assess the number, scale and quality of the popularisation public speeches and the number, scope and quality of the written popularisation contributions, taking into account the impact on the public, in particular in terms of supporting the long-term prospects of research, experimental development and innovation.
§ 4
Efficacy
This Regulation shall take effect on 15 April 2013.
