DECLARATION
of 27 February 2019
amending Decree No 71 / 2005 Coll., on Basic Art Education, as amended by Decree No 197 / 2016 Coll.
The Ministry of Education, Youth and Sports provides in accordance with Sections 112 and 123 (5) of Act No. 561 / 2004 Coll., on Pre-School, Basic, Medium, Higher Vocational and Other Education (Education Act):
Decree No. 71 / 2005 Coll., on Basic Art Education, as amended by Decree No. 197 / 2016 Coll., is amended as follows:
1. In Paragraph 1 (1), the word "artistic ', the word" and' shall be replaced by the word "or ', and at the end of the paragraph, the phrase" more than one artistic field may be established in a school shall be added.';
2. In Article 1 (3), the words "4 to ', the words" 3 or' and the last sentence are deleted.
3. Paragraph 1 (4) reads as follows:
"(4) For pupils who did not attend or have successfully completed basic level I studies in a given course of study according to Section 7 (1), it is possible to organise initial degree for primary level II studies, which is one year."
4. In Article 1 (5), the words "pupils of grade I and level II primary education who show extraordinary talent and excellent educational results' are replaced by the words" gifted and extremely gifted pupils of primary education who demonstrate the conditions for fulfilling the educational content defined in the school curriculum for study with an extended number of teaching hours'.
5. In Paragraph 1, the words "for basic artistic education 'shall be added at the end of paragraph 7.
6. In Paragraph 1 (8), the words "and the date of completion of the tests' shall be inserted after the word" tests'.
7. In Article 1 (9), the words "in accordance with the school curriculum 'are deleted and the words" concerts, exhibitions and performances, trips abroad and other events related to educational activities' are replaced by the words "events related to educational activities, in particular concerts, exhibitions, competitions, shows, performances and trips abroad '.
8. In Article 1 (10), the words ", the State of the European Economic Area or the Swiss Confederation 'shall be inserted after the words" the European Union', and at the end of the paragraph, the sentence "The underage pupil shall also submit the written consent of the legal representative. ';
9. In the second sentence of Article 1 (11), the words "eligible for legal action 'are replaced by the words" fully qualified'.
10.Paragraph 2 (3) reads as follows:
"(3) In a study with an extended number of teaching hours, the principal of the school shall accept a gifted or extraordinarily gifted pupil of primary education who has successfully passed the comic examination referred to in § 6 (1) (d). '
11. in the first sentence of Article 2 (4), the words "exceptionally talented tenderers who have not reached the age laid down" shall be replaced by the words "gifted and exceptionally talented tenderers who have demonstrated their qualifications and have not reached the age laid down."
12. in Article 3 (2):
"(2) The results of the education of the pupil in the individual compulsory and optional subjects provided for in the school curriculum shall be evaluated in such a way as to make clear the level of education achieved by the pupil, in particular in relation to the expected outputs formulated in the curriculum, its educational and personality assumptions and age. ';
13. In Paragraph 3 (5), the words "if the main object is rated by the degree of benefit 1 - excellent, in any compulsory subject it is not evaluated by the degree of benefit worse than 2 - commendable and the average of the degrees of benefit of compulsory subjects does not exceed 1,5. If the main subject is not specified, the pupil has benefited with distinction," deleted.
14. in Article 4 (1), "framework" is replaced by "school."
15. in Paragraph 4 (2), the words "Exceptionally gifted pupil," shall be replaced by "A gifted or extremely gifted pupil."
16. In the first sentence of Paragraph 5 (1), the words "from a non-main subject 'are replaced by the words" in one of the compulsory subjects', the words "in the last week 'are replaced by the words" to the end' and the last sentence is deleted.
17. In Article 5, the words "until the end of September of the following school year 'shall be added at the end of the text of paragraph 2 and the sentence" Until the completion of the test according to the sentence of the second pupil attends a higher year' shall be added.
18. in Paragraph 6 (1), the following point (a) is inserted:
"(a) when receiving applicants for training,"
Points (a) to (e) shall be renumbered (b) to (f).
19. in Paragraph 6 (1) (d), the words "tests from the main subject matter" shall be replaced by the words "admission."
20. in Article 6 (1) (e), the words "gifted or" shall be inserted after the word "reassignment."
21. In the first sentence of Paragraph 6 (2), the words "and consists of experts of the subject or field concerned" shall be replaced by the words "the majority of the members of the examination committee must be experts of the subject or arts."
22. in the second sentence of Article 7 (1), the words "or the exhibition" shall be replaced by the words "exhibition" and the words "exhibition" shall be replaced by the words "or other form of presentation enabling the evaluation of the results of the pupil's education."
23. in Article 7 (2) (d), the words "within the prescribed time limit" are replaced by the words "even within the time limit set by the school director in accordance with Article 8 (5)."
24. In Article 8, the following paragraph 5 is added:
"(5) If the legal representative of a minor is not paying the remuneration within the time limit referred to in paragraph 4, the school director shall invite him to be paid in writing and shall set a reasonable deadline for payment. ';
25. in Article 9, the words "pupils, for the exchange of experience and for the comparison of educational results" are replaced by the words "and extremely gifted pupils" and the words "subjects" are replaced by the words "training courses."
Efficacy
This Regulation shall enter into force on 1 September 2019.
