DECLARATION
of 25 February 2016
on the billing of supplies and related services in the energy sector
Pursuant to Section 98a (2) (j) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll. and Act No. 131 / 2015 Coll.:
Subject matter
This decree sets out the scope, formalities and deadlines for the billing of electricity, gas and heat supplies and related services in electricity and gas.
Definition of terms
For the purposes of this decree:
(a) by charging an evaluation of the payments made for the performance provided and the total amount of the payment made for the performance on the basis of which the overpayment or underpayment is made;
(b) due account of the accounts made for the settlement period;
(c) an exceptional bill of account made during the accounting period for its part; and
(d) by the correct bill of account, which shall be made by the correct or exceptional bill.
Proof of settlement
(1) The accounting document provided by the electricity trader, electricity producer or distribution system operator to the customer whose demand facility is connected to a low voltage network and the accounting document provided by the gas trader, gas producer or distribution system operator to the household or retail customer shall consist of:
(a) from the basic part marked with PART A,
(b) the detailed part marked with PART B; and
(c) from the accompanying part marked with PART C.
(2) The bill of account provided by the heat energy supplier shall be composed of:
(a) the essential part containing the particulars referred to in Paragraph 14 (1);
(b) a detailed part containing the particulars referred to in Article 14 (2); and
(c) the accompanying part containing the particulars referred to in Article 14 (3).
Narrowed scope of the bill document
(1) If the customer so requests in writing, the bill of account provided under Article 3 may be provided only to the extent of the essential part or, where applicable, the essential part and the detailed parts. At the same time, the person making the bill shall make available to the customer the other parts of the bill in a way that allows remote access.
(2) Where the customer referred to in paragraph 1 requests in writing, he shall be provided with full proof of the bill in accordance with Article 3 (1) and (2).
Formal particulars of the bill
(1) The person making the bill shall enter all the information on the bill in a clear, comprehensible and legible form.
(2) The bill document shall be issued by the person making the bill in paper form or in electronic form as agreed with the customer or customer.
(3) The basic part of the bill referred to in Article 3 shall be provided by the person carrying out the bill clearly separate from the other parts of the bill.
Forms of proof of billing for electricity supply and related electricity services to a customer whose demand facility is connected to a low voltage network
(1) PART A of the proof of billing for electricity supply and related services in electricity
(a) identification of the electricity trader or electricity producer (1);
(b) the trading firm or the name and surname or, where applicable, the name, addendum to the name and surname or surname and address of the client or, where appropriate, other customer identification details;
(c) whether the accounts are duly, exceptional or corrective;
(d) the definition of the settlement period on the date of the first and last day of the settlement period;
(e) the total quantity of electricity delivered to the customer's sampling point or to the customer's sampling points for the settlement period;
(f) the amount of the total invoiced amount for the total quantity of electricity supplied and the associated value added tax services, excluding that tax;
(g) the total amount of advances paid by the customer for the settlement period where the obligation is to cover advances agreed in the contract for combined electricity supply services;
(h) the amount of the excess or arrears for the settlement period;
(i) the date on which the overpayment or underpayment is due and the method of payment thereof;
(j) contact to the electricity trader's customer line or contact to the electricity producer and contact to the distribution system operator's fault line or distribution system operators where PART A is provided to the customer for multiple demand points connected to multiple distribution systems by multiple distribution system operators;
(k) the information necessary for the customer's access to the accompanying and, where appropriate, the detailed and accompanying part of the bill document, provided that the proof of account to the customer is provided to the extent provided for in Section 4 (1);
(l) other elements of the tax document, if the A bill of tax document under the Value Added Tax Act 2), and
(m) a summary of the accounts referred to in Annex 1 to this Order; this summary need not be provided where the bill of lading is issued for more than one sampling point.
(2) PART B of the proof of billing for electricity supply and related electricity services contains for each point of demand:
(a) the address and identification code (UN code) of the sampling point (s);
(b) the electricity trader's product, if agreed, and the electricity distribution rate;
(c) breakdown of payments and electricity supply prices and related electricity services, broken down into total supply payment
1. electricity and related electricity services;
2. force electricity, with an indication of the price per unit of supplied electricity charged for the settlement period or with an indication of the prices per unit of supplied electricity charged for the part of the accounting period, where it has been changed during the accounting period, with a distinction by tariff band; and
3. related services in electricity,
(d) the breakdown of payments for each related electricity service, including the unit price of such services, charged for the settlement period or unit prices charged for the part of the settlement period, if it has been changed during the accounting period, broken down into payment for:
1. ensuring the distribution of electricity, differentiated by tariff time band;
2. system services,
3. the activities of the market operator; and
4. the component of the price for the promotion of electricity from supported energy sources, in accordance with the Act on Supported Energy Sources, including both methods of calculation, with a figure of the lower of the payments;
(e) the total amount of advances paid by the customer for the settlement period and the breakdown of such advances according to the date of payment and their amount, provided that the obligation is to cover advances agreed in the contract for the combined electricity supply services; in the case of multi-point billing, the total amount of advance payments for each point of sampling shall not be provided if the customer expressly requests this;
(f) total quantity of electricity supplied and, for type measurements, C measurement data on the first day of the settlement period, on the last day of the settlement period and on the last day of the calendar year; If the last day of the calendar year is not the first or last day of the settlement period, this figure shall be determined as an indication of electricity consumption at the date of the change of regulated electricity prices under the decree governing electricity measurement (3),
(g) the method of determining the measurement data according to the Ordinance governing the measurement of electricity (3);
(h) the nominal current value of the main circuit breaker before the measuring device;
(i) the class of supply type diagrams assigned under the Ordinance governing the electricity market rules; and
(j) the quantity of electricity delivered to each demand point in the settlement period and at least in the two immediately preceding accounting periods comparable in terms of time, provided that such data is available to the electricity trader or electricity producers through the market operator's information system or the electricity trader or electricity producer supplied electricity to the customer during those periods; information on the quantity of electricity supplied in the accounting periods shall be provided in such a form as to enable a clear comparison of electricity consumption.
(3) PART C of the electricity supply bill and related electricity services contains information on:
(a) the origin of the energy or share of individual sources in the total fuel mix of the electricity trader, broken down into the share of electricity produced
1. coal;
2. nuclear installations;
3. natural gas,
4. from renewable energy sources;
5. from sources using secondary energy sources; and
6. other sources; and
(b) publicly available sources of information on the environmental impacts of electricity production, with data on CO2 emissions and radioactive waste from electricity produced, at least by reference to such publicly available source;
(c) the way in which the complaint is made with proof of the bill of supply of electricity and related services in electricity, including an indication of where and within which time limits the complaint can be applied;
(d) the rights of the customer where a dispute arises between the customer and the electricity trader or the electricity producer in a matter relating to the supply of electricity and related electricity services or their billing, and the means of resolving such disputes; and
(e) contact details for the Energy Regulatory Authority and the Ministry of Industry and Trade, indicating the address of the registered office, including the address of the e-mail office, telephone number and website.
(4) The electricity trader buying or selling guarantees of origin shall indicate in Part C the proof of billing for the supply of electricity and related electricity services provided by him to the respective energy sources in the total mixture of fuels referred to in paragraph 3 (a), including the guarantees of origin applied.
Forms of proof of billing for the supply of electricity to a customer whose demand facility is connected to a low voltage network
(1) PART A of the power supply bill contains:
(a) identification of the electricity trader or electricity producer (1);
(b) the trading firm or the name and surname or, where applicable, the name, addendum to the name and surname or surname and address of the client or, where appropriate, other customer identification details;
(c) whether the accounts are duly, exceptional or corrective;
(d) the definition of the settlement period on the date of the first and last day of the settlement period;
(e) the total quantity of electricity delivered to the customer's sampling point or to the customer's sampling points for the settlement period;
(f) the amount of the total invoiced amount for the total quantity of electricity delivered with or without value added tax;
(g) the total amount of advances paid by the customer for the settlement period where the obligation is to pay advances agreed in the electricity supply contract;
(h) the amount of the excess or arrears for the settlement period;
(i) the date on which the overpayment or underpayment is due and the method of payment thereof;
(j) contact to the electricity trader's customer line or contact to the electricity producer and contact to the distribution system operator's fault line or distribution system operators where PART A is provided to the customer for multiple demand points connected to multiple distribution systems by multiple distribution system operators;
(k) the information necessary for the customer's access to the accompanying and, where appropriate, the detailed and accompanying part of the bill document provided to the customer in accordance with § 4 (1); and
(l) additional elements of the tax document, provided that PART A of the proof of accounting for electricity supply is a tax document under the Value Added Tax Act (2).
(2) PART B of the proof of accounting for the supply of electricity contains for each point of production:
(a) the address and identification code number of the sampling point (s);
(b) the product of the electricity trader, if agreed;
(c) the total payment for the supply of electricity;
(d) the price per unit of supplied electricity charged for the settlement period or the prices per unit of supplied electricity charged for the part of the settlement period, if they have been changed during the accounting period, differentiated by the tariff zone;
(e) the total amount of advances paid by the customer for the settlement period and the breakdown of such advances according to the date of payment and their amount, where the obligation is to pay advances agreed in the electricity supply contract; in the case of multi-point billing, the total amount of advance payments for each point of sampling shall not be provided if the customer expressly requests this;
(f) total quantity of electricity supplied and, for type measurements, C measurement data on the first day of the settlement period, on the last day of the settlement period and on the last day of the calendar year; If the last day of the calendar year is not the first or last day of the settlement period, this figure shall be determined as an indication of electricity consumption at the date of the change of regulated electricity prices under the decree governing electricity measurement (3),
(g) the method of determining the measurement data according to the Ordinance governing the measurement of electricity (3);
(h) the class of supply type diagrams assigned under the electricity market rules decree; and
(i) the quantity of electricity delivered to each demand point in the settlement period and at least in the two immediately preceding accounting periods comparable in terms of time, provided that such data is available to the electricity trader or electricity producers through the market operator's information system or the electricity trader or electricity producer has supplied electricity to the customer during those periods; information on the quantity of electricity supplied in the accounting periods shall be provided in such a form as to enable a clear comparison of electricity consumption.
(3) PART C of the power supply bill contains information on:
(a) the share of individual energy sources in the total fuel mix of the electricity trader or electricity producer, broken down into the share of electricity produced
1. coal;
2. nuclear installations;
3. natural gas,
4. from renewable energy sources;
5. from sources using secondary energy sources; and
6. from other sources,
(b) publicly available sources of information on the environmental impacts of electricity production, with data on CO2 emissions and radioactive waste from electricity produced, at least by reference to such publicly available source;
(c) the way in which the complaint is made with proof of the bill of discharge of the electricity supply, including an indication of where and within which time limits the complaint may be applied;
(d) the rights of the client where a dispute arises between the customer and the electricity trader or the electricity producer in respect of the supply of electricity or its billing and the means of resolving such disputes; and
(e) contact details for the Energy Regulatory Authority and the Ministry of Industry and Trade, indicating the address of the registered office, including the address of the e-mail office, telephone number and website.
(4) The electricity trader buying or selling guarantees of origin shall indicate in Part C of the proof of accounting for the supply of electricity the share of each energy source obtained by him in the total fuel mix referred to in paragraph 3 (a), including the guarantees of origin applied.
Forms of proof of billing for the distribution system service in electricity to the customer whose demand facility is connected to a low voltage network
(1) PART A proof of billing for a distribution system service shall include:
(a) identification of the distribution system operator (1);
(b) the trading firm or the name and surname or, where applicable, the name, addendum to the name and surname or surname and address of the client or, where appropriate, other customer identification details;
(c) whether the accounts are duly, exceptional or corrective;
(d) the definition of the settlement period on the date of the first and last day of the settlement period;
(e) the total quantity of electricity distributed to or from the customer for the settlement period;
(f) the amount of the total invoiced amount for the electricity distribution system service and other services subject to price control with or without value added tax;
(g) the total amount of advances paid by the customer for the electricity distribution system service and other services for the settlement period where the obligation is to cover advances agreed in the electricity distribution contract;
(h) the amount of the excess or arrears for the settlement period;
(i) the date on which the overpayment or underpayment is due and the method of payment thereof;
(j) contact with the distribution system operator's fault line;
(k) the information necessary for the customer's access to the accompanying and, where appropriate, the detailed and accompanying part of the bill document provided to the customer in accordance with § 4 (1); and
(l) other elements of the tax document, provided that PART A of the proof of billing for electricity distribution is a tax document under the Value Added Tax Act (2).
(2) PART B of the proof of billing for the distribution of electricity contains for each sampling point:
(a) the address and identification code number of the sampling point (s);
(b) the price for the electricity distribution system service and the electricity distribution rate;
(c) the breakdown of payments for each of the related electricity distribution services, including the unit price of those services, charged for the settlement period or unit prices charged for the part of the settlement period, if it has been changed during the settlement period, broken down by payment for:
1. ensuring the distribution of electricity, differentiated by tariff time band;
2. system services,
3. the activities of the market operator; and
4. the component of the price of the distribution system service in accordance with the Act on Supported Energy Sources, including both methods of calculation, with a lower number of payments;
(d) the total amount of advances paid by the customer for the electricity distribution system service and other services subject to price regulation for the settlement period and the breakdown of such advances according to the date of payment and their amount, where the obligation is to pay advances agreed in the distribution system service contract; in the case of a multi-point bill, the total amount of the advances for each sampling point;
(e) the total quantity of electricity distributed and, for type C measurements, the measurement figure on the first day of the settlement period, on the last day of the settlement period and on the last day of the calendar year; If the last day of the calendar year is not the first or last day of the settlement period, this figure shall be determined as an indication of electricity consumption at the date of the change of regulated electricity prices under the decree governing electricity measurement (3),
(f) the nominal current value of the main circuit breaker before the measuring device;
(g) the method of determining the measurement data according to the Ordinance governing the measurement of electricity (3); and
(h) the class of supply type diagrams assigned under the electricity market rules decree.
(3) PART C of the electricity distribution bill contains information on:
(a) the way in which the complaint is made with proof of billing for electricity distribution, including an indication of where and within what deadlines the complaint can be applied;
(b) the rights of the client where a dispute arises between the customer and the distribution system operator in respect of the distribution of electricity or its billing and the means of resolving such disputes; and
(c) contact details for the Energy Regulatory Authority and the Ministry of Industry and Trade, indicating the address of the registered office, including the address of the e-mail office, telephone number and website.
Forms of proof of billing for electricity supply, proof of billing for electricity supply and related electricity services and proof of billing for related electricity service provided to the customer whose demand facility is connected to a high or very high voltage network
(1) The proof of billing for electricity supply and related electricity services includes separately quantified unit price, quantity and total payment for:
(a) ensuring the distribution or transmission of electricity, broken down by component and differentiated by tariff time band;
(b) system services;
(c) the activities of the market operator;
(d) the supply of power; and
(e) the component of the price of the distribution system service or the component of the price of the transmission system service to support electricity from the supported energy sources, as defined by the Act on Supported Energy Sources, including both methods of calculation, with a lower number of payments.
(2) The proof of billing for the related electricity service shall contain the separately quantified data referred to in points (a) to (c) and (e) of paragraph 1.
(3) The proof of accounting for the supply of electricity shall contain the separately quantified figure referred to in paragraph 1 (d).
(4) The bill of account referred to in paragraphs 1 and 2 shall also contain a separately quantified indication of:
(a) the maximum measured value of the quarter-hour electrical power taken by the customer; and
(b) the amount of unsolicited supply of reactive power.
(5) Furthermore, the bill of lading referred to in paragraphs 1 to 3 shall contain additional elements of the tax document, provided that the bill of lading is a tax document under the Value Added Tax Act (2).
(6) The power supply bill and the electricity supply bill and associated electricity services shall include information on the share of individual energy sources in the total fuel mix of the electricity trader or electricity producer, broken down into the share of electricity produced by:
1. coal;
2. nuclear installations;
3. natural gas,
4. from renewable energy sources;
5. from sources using secondary energy sources; and
6. from other sources.
(7) The electricity trader buying or selling guarantees of origin shall indicate in the proof of billing for the supply of electricity or in the proof of billing for the supply of electricity and related services in electricity the respective shares of the various sources in the total mixture of fuels referred to in paragraph 6, including the guarantees of origin applied.
Forms of proof of gas supply bill and related gas services to a household or retail customer
(1) PART A of the gas supply bill and related gas services contains:
(a) the gas dealer or manufacturer's identification data is continuous (1);
(b) the trading firm or the name and surname or, where applicable, the name, addendum to the name and surname or surname and address of the client or, where appropriate, other customer identification details;
(c) whether the accounts are duly, exceptional or corrective;
(d) the definition of the settlement period on the date of the first and last day of the settlement period;
(e) the total quantity of gas delivered to the customer's sampling point or to the customer's sampling points during the settlement period;
(f) the amount of the total invoiced amount for the total quantity of gas delivered and related gas services with and without value added tax;
(g) the total amount of advances paid by the customer for the settlement period where the obligation is to cover advances agreed in the contract for combined gas supply services;
(h) the amount of the excess or arrears for the settlement period;
(i) the date on which the overpayment or underpayment is due and the method of payment thereof;
(j) contact to the gas trader's customer line or contact to the gas manufacturer and contact to the distribution system operator's fault line or distribution system operators where PART A is provided to the customer for multiple demand points connected to multiple distribution systems by multiple distribution system operators;
(k) the information necessary for the customer's access to the accompanying and, where applicable, accompanying and detailed parts of the bill of lading, provided that the bill of lading is provided to the customer to the extent provided for in Section 4 (1);
(l) other elements of the tax document, if the A proof of accounting for gas supply and related gas services by means of a tax document under the Value Added Tax Act (2); and
(m) the summary of the accounts referred to in Annex 2 to this Decree, which need not be given where the proof of accounts is issued for more than one point of collection.
(2) PART B of the gas supply bill and related gas services shall contain for each point of collection:
(a) the address and alphanumeric code (EIC code) of the sampling point (s) in accordance with the Decree governing the rules of the gas market;
(b) the gas trader's product, if agreed;
(c) the value of gas consumption used to include the customer's demand point in the demand zone;
(d) the class of supply type diagrams assigned under the regulation governing the gas market rules;
(e) breakdown of payments and gas supply prices and related gas services, broken down by total supply payment
1. gas and related gas services;
2. gas with an indication of the price for the energy unit of the supplied gas charged for the settlement period or of the prices for the unit of supplied gas charged for the part of the settlement period, if it has been changed during the accounting period; and
