on the minimum quantity of biofuels or other fuels from renewable sources in the range of motor petrol and diesel fuels on the Czech market
The Government orders the implementation of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Air Protection Act), as amended by Act No. 521 / 2002 Coll., Act No. 92 / 2004 Coll. and Act No. 186 / 2004 Coll.:
Subject matter
(1) This Regulation implements the relevant provisions of the European Community1) and sets a minimum quantity of biofuels or other fuels from renewable sources in the range of motor petrol and diesel fuels on the Czech market.
(2) The provisions of this Regulation do not apply to stored and changed motor gasoline, except for petrol with the addition of ethyl tercbutyl ether in accordance with the relevant Czech technical standard (2), and containing a maximum of 0,3% by volume of free ethanol in petrol, and diesel fuel, intended for emergency stocks (3) and for national tangible reserves.
Basic concepts
For the purposes of this Regulation:
(a) energy content - the minimum calorific value of the fuel to be declared in kJ / kg or kJ / l fuel,
(b) the volume determined - the quantity of biofuels to which the financial support system is applied.
Minimum amount of biofuels in the range of motor petrol and diesel fuels
(1) The minimum ratio of biofuels and other fuels from renewable sources is set as a national indicative target as follows:
(a) the minimum value at 31 December 2005 is 2% of biofuels and is calculated on the basis of the energy content of the total quantity of diesel and diesel fuels sold on the Czech market for transport purposes,
(b) the minimum value at 31 December 2010 is 5,75% of biofuels and is calculated according to the energy content of the total quantity of diesel and diesel fuels sold on the Czech market for transport purposes.
(2) Minimum amount of biofuels means the proportion of biofuels in the volume of the range of motor petrol and diesel fuels included in the free tax circulation (4) in the Czech Republic in a calendar year which is binding at a fixed volume for all operators reporting motor petrol and diesel for free circulation in the Czech Republic to the extent of their shares in the internal market for motor petrol and the internal market for diesel in the previous calendar year. This commitment shall apply from 1 January 2009 to those entities which store and protect emergency stocks and the national fuel reserves.
(3) The fixed volume of bioethanol for the period 1 January 2007 to 31 December 2012 is 2 million hectolitres per year.
(4) The fixed volume of biodiesel for the period 1 January 2007 to 31 December 2012 is 200 000 tonnes per year.
Efficacy
This Regulation shall enter into force on 15 February 2005.
