DECLARATION
of 9 December 2004
amending Decree No. 157 / 2003 Coll., laying down requirements for fresh fruit and fresh vegetables, processed fruit and processed vegetables, dry nuts, mushrooms, potatoes and their products, and other means of labelling
According to Article 18 (1) (a) and (g) of Act No. 110 / 1997 Coll., on Food and Tobacco Products, and amending and supplementing certain related laws, as amended by Act No. 316 / 2004 Coll., hereinafter referred to as "the Act":
Decree No 157 / 2003 Coll., laying down requirements for fresh fruit and fresh vegetables, processed fruit and processed vegetables, dry nuts, mushrooms, potatoes and their products, and other means of labelling thereof, shall be amended as follows:
1. the following Section 5a is inserted after Section 5 under the heading "Processed fruit ', including footnotes 3a and 3b:
This section (3a) implements the relevant European CommunityRegulation (3b) and regulates other requirements concerning processed fruit.
3a) It is issued on the basis and within the limits of the law, the content of which allows the relevant provisions of the European Communities to be incorporated by decree.
(3b) Council Directive 2001 / 113 / EC of 20 December 2001 concerning fruit jams, jellies and marmalades and chestnut cream intended for human consumption. '
2. Paragraph 14 (1) reads as follows:
"(1) In addition to the information provided for in the law and implementing legislation1), processed vegetables shall be further marked:
(a) the botanical name of the vegetable species used in accordance with § 3 (c), unless included in the product name,
(b) the species of brine used,
(c) the name of the group;
(d) indicating whether the product is a spicy vegetable product,
(e) in the case of sterilised peas, onions, cucumbers, whether they are peas, onions, cucumbers of size graded with indication of the size class of processed vegetables, or whether they are vegetables of a size unsorted;
(f) for prepared chilled fresh vegetables and dairy vegetables

3. In footnote 7, the words "ČSN 46 3088 Salted almonds in shell 'are replaced by the words" ČSN 46 3088 Sweet almonds in shell' and the words "ČSN 46 3089 Salted almonds' are replaced by the words" ČSN 46 3089 Sweet almonds'.
4. Paragraph 30 (7) is deleted.
5. In Annex No 16, Tables 1 to 3 read:

6. Annex No 17 is deleted.
Transitional provision
Foodstuffs produced and put into circulation before the date of entry into force of this Order shall be assessed in accordance with existing legislation.
Efficacy
This decree shall take effect on the day of its publication.
