Ministry of Transport
of 27 March 1964
on port rules for Czechoslovak ports
In agreement with the participating central authorities, the Ministry of Transport provides, pursuant to § 17 and 24 of Act No. 26 / 1964 Coll., on Inland Navigation:
General provisions
(1) Users of Czechoslovak ports (hereinafter referred to as "ports") are obliged to follow the instructions, challenges and orders of the State Navigation Administration in Bratislava and their authorities * (hereinafter referred to as "the Navigation Administration").
(2) Ports intended for public use (§ 3 of Decree No. 27 / 1964 Coll.) can be used by everyone.
(3) In particular, it is for the seaports to manage
(a) ensure safe, smooth and economical operation of ports;
(b) monitor compliance with the rules on navigation;
(c) to allocate and collect compensation for the use of ports intended for public use;
(d) keep records of navigation operations in ports intended for public use;
(e) ensure that port areas are kept in proper condition.
In order to ensure safe and smooth operation of the navigation service in a single port, the navigation service shall declare:
(a) where it is permitted to handle flammable or other dangerous substances (goods);
(b) how many vessels may be unbundled or anchored at each site (handling positions),
(c) how many vessels may enter the port tank at the same time.
(1) If port users do not follow instructions, calls and navigation instructions, the navigational authority may, in particular if there is a risk of delay, take the necessary measures for the cargo and the danger of the port user.
(2) Port users shall be obliged to provide the navigation service with the necessary assistance, to allow its authorities free access to the premises and to the vessels and to provide them with the explanation necessary to fulfil their tasks.
Navigation
(1) The vessel may enter the port freely unless the safety, hygiene and anti-epidemic or customs regulations prevent it.
(2) In particular, the special authorisation of the navigational authority for entry into port needs:
(a) vessels at risk of sinking;
(b) floating machinery, floating equipment and other vessels serving as dwellings, workshops or warehouses;
(c) vessels carrying dangerous goods or loaded with substances which are light on fire (e.g. hay, straw, reeds, etc.) or smell, if they wish to use a port other than the port or part of the port designated for them;
(d) vessels with a communicable disease or suspected occurrence.
(3) Vessels on which a fire has been fired may enter only that part of the port designated to them by the navigational authority; shall land in such a way as not to endanger port facilities or other vessels.
(4) For reasons of general interest, the VMC may order the vessel to be removed from port.
(1) The master of the vessel or his representative must log and log the vessel arriving at the port immediately before leaving the port.
(2) Vessels which land and leave the port with unchanged cargo and crew within 24 hours may also be cancelled on application.
(3) If, for any reason, a vessel that has already been checked out has remained in port for more than 24 hours, any other changes shall be notified immediately.
(4) The navigational authority will issue a confirmation of the application and check-out.
(1) Exemption from reporting obligations
(a) vessels of the Ministry of Interior and the Ministry of National Defence;
(b) vessels intended exclusively for port service;
(c) rescue and fire craft moving towards the site of an accident or fire;
(d) vessels transporting persons under a public timetable.
(2) Other vessels may also be exempt from reporting obligations by the VMC or allow relief from that obligation.
(1) Check-in (application) and departure (check-out) shall be submitted in writing to the navigation service. The report shall indicate the type and designation of the vessel, its load capacity, draught, machine performance, the place where the vessel has arrived (where it is going), the time of arrival (departure) and the necessary cargo data.
(2) At the same time as the application has been lodged, the shipping documents must be submitted.
(3) The seafaring authority may withdraw the certificate or the branding licence and deposit it until the vessel leaves port.
(4) The master of the vessel or his representative shall, at the same time as the application, notify the navigational authority of any circumstances relevant to the voyage which he has detected on the way to the port (e.g. accidents, damage and sinking of vessels, obstacles to navigation, insufficient depth, defects in the fairway marking), as well as the findings of marking material and components of other vessels' marine equipment, and, where appropriate, the loss of ship's equipment.
(5) Until the navigational authority confirms the check-out, the vessel shall not leave port.
(1) The vessel may land upon arrival at a place where it does not make navigation difficult; the port must take the position (handling position) determined by the navigational authority. The board may order the vessel to change its position (handling position).
(2) The management of the vessel may order permanent posts to individual vessel operators, permit landing facilities to be installed and lay down detailed conditions for their use.
(3) Seats intended for certain vessels, certain vessel operators or certain costs may not be used by other vessels or operators or for other cargo without the authorisation of the navigational authority.
(4) It shall be prohibited to land on vessels carrying dangerous cargo. A vessel carrying a dangerous cargo vessel shall withdraw from it immediately upon landing.
(5) The leaders and crew of individual vessels are obliged to assist each other in landing and departure as well as in the movement of vessels and the assembly of lifts.
(1) Vessels must be properly and safely removed from their stations, only on equipment intended for this purpose. If there are no such facilities in port, the master of the vessel shall ensure that the vessel is otherwise properly unloaded.
(2) Trailers, if not carried on board, must be tied to the waterfront of the vessel.
(3) The crew of the vessel may release another vessel only with the permission of its leader, representative or patrol officer and shall immediately release them properly.
(4) Braces to maintain the vessel at a reasonable distance from the shore may be deployed only in such a way as not to damage the shores.
(5) Reflectors must be inserted between vessels, port walls, port bridges, etc., as well as between vessels facing each other.
(6) Tightening of ropes, chains, etc. through a fairway or port tank is only allowed in emergencies without permission of the navigation authority; This shall be notified immediately to the navigating authority and shall ensure constant supervision or appropriate marking.
(7) Leaders of vessels standing in port [except those referred to in points (a) to (c) of Paragraph 6 (1)] shall, if necessary, allow another vessel to be carried out when the safety or the activity of its own vessel is not thereby compromised.
(8) Anchors in port tanks are only allowed in case of emergency.
(9) When staying in a port, all objects which extend overboard (the edge of the ship) must be stowed so that the vessels are as small as possible in the port and cannot be damaged by each other.
(1) Vessels standing by the shore must be equipped with a footbridge *) or other equipment. The gangway and equipment shall be illuminated at night and allow safe access from shore to the vessel.
(2) If the vessels stand side by side, the leaders of the vessels that are closer to the shore must allow the crossing of those vessels to be established and, if they are not translated on them, allow the goods to be carried and the necessary measures to be taken.
(1) The repair of vessels may be carried out only in such a way as not to make port traffic difficult.
(2) When releasing steam and hot water from vessels, measures must be taken to avoid endangering persons or damaging property.
(3) Vessels may test the operation of propellers or wheels only at navigation points declared for that purpose. In such cases, vessels shall be notified in an appropriate manner and in a timely manner at the close proximity or approach. In case of danger, the machine must be stopped immediately.
(1) There shall still be a sufficient number of crew members on board the vessel at port which are necessary to carry out the necessary manoeuvres or measures safely.
(2) The VMS may give consent to leave the vessel at rest in the port tank unmanned. In that case, the operator of the vessel shall take care of the appropriate watch. A joint patrol may be established for a group of vessels standing still in the port tank.
(3) The board may, as appropriate (large water, ice running, etc.), order an increase in patrol on board vessels.
(4) The management may establish a special watch for the cargo and danger of the operator for dangerous goods vessels and non-gas tanker vessels, if they are outside their designated positions, as well as for vessels whose crews have failed to comply with the duties of the patrol service. The instructions, calls or orders of these special patrols shall be followed immediately.
(1) All vessels must, before entering port tanks, reduce speed in time to prevent the harmful effects of wave or intake and damage to other vessels or banks.
(2) In port exits, the inbound vessel shall have priority. The master of the vessel may only enter the port entrance or the port tanks with his vessel if he has satisfied himself in good time that the entry is free; stopping and standing at port and individual tanks shall be prohibited.
(3) Before entering the port entrance and the individual tanks, and before leaving the port and when passing the port entrance, a signal provided for by the rules of navigation safety must be given.
(4) In port tanks, vessels may perform maneuvers and assemble lifts only if there is sufficient space and with utmost care. There must still be plenty of space left in the port tank for navigation.
During the stay of the vessel in the port, the master or his representative shall immediately notify the navigational authorities of any damage and defects observed at port and transfer facilities, the loss and discovery of objects in port territory and the findings of objects fished out of water. The master of the vessel shall also report objects falling into the water which may compromise the safety of port operations. Where articles are taken from their own vessel, the master must remove them immediately; If this is not possible, the place must be marked.
Other operations
(1) Port users are obliged to ensure that traffic is not hampered in port territory, barriers are not built on shore, port facilities are not damaged and there is no mutual damage. In their premises and in areas used, they shall comply with the rules on the protection of life and health at work, hygiene and veterinary care and shall take appropriate fire protection measures. In winter, port users are obliged to remove snow on the areas they use and sprinkle it on ice.
(2) The seafarer may, if necessary, permit limited operations in individual parts of the port territory or close them completely for operation. The same applies to port facilities.
(3) Only journeys and crossings intended for this purpose may be used in port territory. Road rules apply to the establishment and maintenance of such roads.
(4) Anyone staying in port must demonstrate his identity to the authorities of the navigation authorities.
Railway traffic in port shall be governed by the relevant railway regulations within the framework of the provisions of these Regulations.
(1) The handling of goods (translation and folding) is permitted only at the places designated for it or by the navigational authorities ordered. *)
(2) When the goods are translated, security measures must be taken to avoid injury to persons or damage to goods. Unauthorised persons shall not be present in the vicinity of translation facilities in service.
(3) Port users shall be obliged to provide adequate night-time lighting for ancillary transfer facilities.
(4) Port users are obliged to remove any pollution caused by translation and other works immediately after the completion of the work.
(5) Goods and articles of any kind may be stored in port territory only in warehouses or places designated for that purpose (complex or navigational management).
(6) At the risk of large water or before the ice runs, the vulnerable parts of the port territory shall be immediately cleared at the call of the navigation service.
(1) The port shall be prohibited:
(a) unnecessary use of signal devices (such as whistle, siren, bell rings), rooting and other disturbances of calm;
(b) any misuse of port facilities, namely rescue facilities on shore.
(2) In the absence of exceptions by the navigational authority, the following shall be prohibited:
(a) use of the port for entertainment and sports purposes;
(b) bathing outside designated places and entering frozen water areas;
(c) the collection of sand, gravel and other soil and ice;
(d) catching fish.
(3) For reasons of general interest, the VMC may issue prohibitions other than those referred to in the preceding paragraphs.
Overwintering
Overwintering in a winter or protective port shall be authorised by the navigational authority at the request of the skipper or operator of the vessel. The permit for the winter-winter of floating machinery and floating equipment shall be requested by 15 November at the latest.
(1) Vessels carrying dangerous goods may, as a general rule, only hibernate after unloading of the cargo and after carrying out the necessary safety measures. The VM may allow an exemption if the operator takes measures to prevent the risk to other vessels and surrounding areas.
(2) For wintering, transitions shall be established between each vessel and between the vessels and the shore, which shall be maintained so that they are safely usable in each weather. They must be illuminated in the dark.
(1) On icing, the crew of the vessel shall release the vessel from the ice as instructed by the navigational authority.
(2) The operators (leaders) of the transboundary vessels shall be required to provide their cargo, at the request of the navigational authority, to the crew, vessel or equipment to remove the ice in the port or to other measures required for the overwintering.
(3) According to local conditions and the need for additional binding measures for the winter period, the management of the ship.
Health and veterinary care
(1) All vessels in port shall be subject to health and veterinary supervision in accordance with the relevant rules. Vessel leaders shall report immediately to the navigation authority any occurrence or suspicion of communicable disease and any accident or death on board. *) The sailing authority shall be informed of the occurrence or suspicion of a communicable disease by the competent doctor or veterinarian, of the accident or death of the relevant part of Public Security.
(2) The master (operator) of the vessel and other authorised persons on board vessels are required to allow the competent doctor or veterinarian access to all the premises of the vessel, to provide the requested explanations and to follow their instructions and regulations.
(3) Where a health or veterinary inspection has been ordered, no one may leave the vessel before completion of the inspection and without the consent of the competent doctor or veterinarian.
(1) A vessel in which a communicable disease (a dangerous animal disease) has occurred or suspected to occur, in particular an epidemic disease (plague, cholera, smallpox, yellow fever, spotted and return typhoid and from dangerous animal diseases anthrax, swine or horse fever and foot-and-mouth disease), or arriving from an infected area, must raise a black and yellow flag according to the international signal code. In darkness, the flag is replaced by two orange lights placed on the mast below and visible from all sides.
(2) Where quarantine (isolation) of a vessel has been ordered, contact with such vessel shall be governed by the instructions of the competent doctor or veterinarian and the navigational authority.
(3) Health or veterinary surveillance measures shall be binding on all port users and on all persons present in port territory and vessels.
Other security and operational measures
(1) Only securely sealed and fixed or suspended lamps with metal tanks or electric lamps may be used for lighting.
(2) The lamps used shall always be covered in such a way that they do not interfere with port and navigation traffic.
(3) Portable electrical lamps used in the cargo or storage areas of vessels shall be equipped with breathable protective glass and, where appropriate, with a protective basket or grid. Other portable lamps shall be securely secured when used in such spaces; they shall be lit or extinguished only outside these spaces.
(4) The power supply on board shall comply with the regulations in force in general and shall not be an obstacle to port operation.
(5) The development and maintenance of open fire in port territory and on board vessels is permitted only with the consent of the navigation authority. Open fire, if its use is permitted by the navigational authority, shall still be under the supervision of a reliable person and measures shall be taken in advance to quench it rapidly.
If there is a fire on board, measures must be taken to extinguish the fire and, in the event of a threat to the environment, the vessel must be immediately moved to a safe place or, if necessary, removed from port. If this is not possible under the circumstances, the vessels in danger shall be immediately removed. At the request of the navigational authority, vessels burning in port may be sunk if necessary.
Stones, sand, waste, residues of packaging, ash, creams, rags, oil and oil waste, corrosive liquids etc. may be stored in the perimeter of the port.
Vessels sunk in port or stranded, as well as objects obstructing navigation, shall be marked and removed within a specified period. If this is not the case and if there is a danger of delay, the navigational authority shall be entitled to arrange for the removal of the obstacle to the cargo and the danger of the debtor.
Final provisions
(1) Paragraphs 3, 10, 12, 20 (2) and 21 (2) do not apply to persons, vessels and equipment of the services of the Ministry of Interior and the Ministry of National Defence. The measures referred to in Articles 4 (4), 22 (2), 23 (3), 25 and 27 concerning these vessels may only be taken in agreement with the relevant departments.
(2) Paragraph 4 to 8, § 14, § 19 to 21 applies only to ports which are intended for public use.
This Decree shall take effect on 1 April 1964.

*) Conditions for handling goods are laid down in the Transit and Warehouse Regulations, Regulations of the Ministry of Transport on Dangerous Goods Handling, Health Regulations of the Ministry of Health and the Ministry of Agriculture, Forestry and Water Management, etc. Food, raw materials and articles which may carry dangerous diseases must be handled in accordance with the veterinary care rules (exc. No 154 / 1961 Coll. and the Ministry of Agriculture, Forestry and Water Directives 600 / 62-43).
