Law on real estate transfers and land leases

on real estate transfers and land leases.
The National Assembly of the Czechoslovak Republic decided on the following Act:
§ 1.
(1) The regional national committee should be elected to transfer real estate and rent agricultural or forestry land. As a transfer of real estate, the division of real estate is also considered.
(2) If the transfer or rental is attributable to the general interest, the district national committee shall refuse the admission.
§ 2.
There is no need for admission under Paragraph 1,
1. if the property is transferred to state socialist property,
2. where agricultural or forestry land is hired by a public authority or a socialist legal person; or
3. transfer or lease of national property.
§ 3.
The Ministry of the Interior, and if it is agricultural or forestry land, the Ministry of Agriculture, shall, in agreement with the participating central authorities, lay down directives in which, in the interests of general interest, the acceptance pursuant to Article 1 is to be refused or granted, where appropriate, provide for allowances for small-scale leases; And they shall take special account of the transfers between those close to them.
§ 4.
(1) The provisions of the existing rules shall be repealed if they require official consent to transfer or distribute the property or rent agricultural or forestry land.
(2) The provisions on the management of national property, the management of socialist legal persons and the special official supervision of the financial management of other property owners remain without prejudice. It shall also remain without prejudice to the provisions under which official consent is required to burden the property or rent a property which is not agricultural or forest land.
§ 5.
(1) Transfers or leases made prior to the application of this Act, for which official consent was not required under the existing rules or for which official consent has already been granted under the existing rules, shall not be affected unless they were speculative transfers or leases (paragraph 2).
(2) Transfers or leases, carried out for speculative reasons after 1 January 1946, may be reviewed and declared invalid by the District National Committee.
(3) Requests for official consent to transfers or leases which have not been effectively decided on before the application of this law shall be assessed accordingly.
§ 6.
This Law shall take effect on the 30th day following its publication; It shall be implemented by the Home and Agriculture Ministers in agreement with the participating members of the Government.
