DECLARATION
of 2 February 2005
on the registration of accidents involving children, pupils and students
The Ministry of Education, Youth and Sports provides, pursuant to § 29 (3) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act):
§ 1

(1) All accidents involving children, pupils and students (hereinafter referred to as "accidents') occurring in the activities referred to in Paragraph 29 (2) of the Education Act shall be recorded in the list of accidents at the latest by the end of the teaching day following the date on which the legal person operating the school or school establishment (hereinafter referred to as" school or educational establishment ') becomes aware of the accident. Where the period referred to in the first sentence expires when a multi-day event is held outside the place where the education or provision of education services is carried out, registered in the school register and in the educational establishment, the period shall be extended until the end of the teaching day following the end of the event.
(2) The list of accidents shall include:
(a) the serial number of the accident;
(b) the name and, where appropriate, the name, surname and date of birth of the injured party;
(c) a description of the accident;
(d) a description of the accident, including the date and place of the event;
(e) whether and by whom the accident has been treated,
(f) the name and, where appropriate, the names of the staff member of the legal person carrying out the activity of the school or educational establishment which entered the accident book;
(g) further information if necessary to draw up an accident record.
(3) Personal data which are part of the accident record may be processed only for the purpose of recording accidents or, where appropriate, as a basis for drawing up an accident record.
§ 2
Injury record
(1) The record of the accident shall be made by the school or school establishment, if applicable
(a) an accident resulting in the absence of a child, a pupil or a student (hereinafter referred to as "the pupil") in a training course involving at least two consecutive teaching days;
(b) fatal injury; a fatal injury for the purposes of this decree means health damage which has caused death following an accident or the consequences of which a pupil died within one year of the occurrence of the accident at the latest; or
(c) an accident which is likely to result in a claim for compensation for pain or compensation for the inconvenience of social application caused by that accident and which is not referred to in (a) or (b).
(2) The record of the accident shall be drawn up on a form the model of which is set out in the Annex hereto.
(3) One copy of the accident record shall be transmitted by the school or school establishment to the adult pupil, in the case of a minor pupil to his legal representative.
(4) The school or school establishment updates the accident record without undue delay
(a) where compensation has been granted for pain or compensation for the inconvenience of social application caused by the accident; or
(b) in the case of a fatal accident, where the death occurred after an accident alert has been made.
§ 3
Injury report
(1) The school or school establishment shall report to its legal representative without undue delay on the accident of a minor student.
(2) If the findings indicate that a crime or offence has been committed in connection with the accident, or if there is a fatal accident, the school or educational establishment shall report without undue delay to the competent department of the Czech Police Department.
(3) The school or school establishment shall report the accident without undue delay to the insurance undertaking for which the school or school establishment is insured in the event of its responsibility for the damage caused to the life and health of the pupils, provided that the school or school establishment has such insurance.
(4) The school or school establishment shall, without undue delay, report the accident referred to in Article 2 (1) also to the competent county labour inspectorate or, where appropriate, to the competent district mining office, where the accident occurred in the practical training of secondary school pupils or in the practical training of students of higher vocational schools.
§ 4
Sending an accident record
(1) The record of the accident referred to in Article 2 (1) (a) and (c) shall be sent by the school or school establishment for the preceding calendar month, no later than the fifth day of the following month,
(a) a pupil's health insurance undertaking; and
(b) Czech school inspection.
(2) The record of a fatal accident shall be sent by the school or school establishment within 5 working days of the report referred to in Article 3 or the update of the record referred to in Article 2 (4) (b).
(a) the organiser;
(b) the pupil's health insurance undertaking;
(c) Czech school inspection; and
(d) the competent department of the Police of the Czech Republic.
(3) School and school establishments shall send the accident records and updates to the organiser on the basis of his written request.
(4) The record of the accident updated in accordance with § 2 (4) shall be sent by the school or school establishment no later than the fifth day of the following month after updating the Czech School Inspection Centre.
(5) The record of the accident and update of the accident record is transmitted electronically to the Czech School Inspection Office via the Czech School Inspection Information System. The entry or update of the entry referred to in the first sentence shall contain the information set out in the Annex to this Order, except for signatures.
§ 5
Efficacy
This decree shall take effect on the day of its publication.
