DECLARATION
of 25 February 2020
amending Decree No 342 / 2012 Coll., on animal health and protection, on movements and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, as amended
The Ministry of Agriculture provides, pursuant to Article 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll., Act No. 139 / 2014 Coll., Act No. 250 / 2014 Coll., Act No. 264 / 2014 Coll., and Act No. 368 / 2019 Coll.
Decree No. 342 / 2012 Coll., on animal health and protection, on movements and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, as amended by Decree No. 429 / 2013 Coll., Decree No. 313 / 2014 Coll., Decree No. 164 / 2016 Coll., Decree No. 18 / 2018 Coll. and Decree No. 19 / 2018 Coll., is amended as follows:
1. in Sections 1 (c), 7 (2) and 8 (1) of the first sentence, paragraphs 2, 3, 5 and 6, the word "isolation" is replaced by "quarantine."
2. In Article 1 (m), the words ", 67a or 67b 'shall be inserted after the words" Article 67'.
3. In Article 1 (n), the words "and the keeping of the list of trained persons' are replaced by the words" and the certificate of trained persons, the keeping of the list of trained persons and the model of the certificate of trained persons'.
4. In Section 1, at the end of the text of point (u), the word "a 'is deleted.
5. In Article 1 (v), the words "and the keeping of the list of peers' shall be replaced by the words" and the certificate of peers' peers', the keeping of the list of peers' peers' and the model of the peers' licence '.
6. In Article 1, at the end of point (v), the dot is replaced by "a 'and the following point (x) is added:
"(x) organisation of specialised professional training of staff of slaughterhouse operators with a focus on assisting in carrying out tasks relating to official controls and on sampling or testing related to official controls, method and organisation of verification of knowledge acquired, certification and maintenance of the list of persons who have completed such specialised training.";
7. The following Section 2a is inserted after Section 2:
Pigs' breeders shall establish a permanent continuous fencing of all:
(a) structures intended for the breeding of pigs;
(b) ancillary structures and parcels used for the storage of feed and litter for pigs; and
(c) the parcels to which the pigs are kept have access; such parcels shall be fenced by pig farmers with at least a double fence. ';
8. Article 5 shall be deleted;
9. In Section 7, "Isolation 'is replaced by" Quarantine'.
10. in § 7 (1) of the introductory part of the provision, § 8 (3) to (6) and § 9, the word "isolation" is replaced by "quarantine."
11. in Articles 8 (1), 10 (1) (b) (2) and 11 (1) (b) (5), the word "isolation" is replaced by "quarantine."
12. in Paragraph 8 (3), "Isolation" is replaced by "Quarantine."
13. in Paragraph 8 (4), "isolated animals" is replaced by "animals in quarantine."
14. in Article 11 (1) (b) (5), the word "isolated" is replaced by "placed in quarantine."
15. In Paragraph 14, the words "if it is a breeder and the hunting identification code, if it is a wanker 'shall be added at the end of the text of paragraph 2.
16. In Paragraph 14 (3), the word "in particular 'is deleted.
17. in Article 14 (3) (a), the words "wild game has been caught or killed and agricultural crops and crops on agricultural land have not been harvested" shall be inserted after the words "slaughtered."
18. In Article 14 (3), the words "wild game caught or culled and for agricultural crops and crops on agricultural land subject to exceptional veterinary measures' shall be added at the end of the text in point (b).
19. The heading of Section 19 reads:
"Attestation studies
(K § 59 (6) of the Act) '.
20. in Article 19 (2) (a), the words "and has at least 1 year experience in the field" shall be deleted;
21. in Paragraph 19 (2) (b), the words "and has at least 3 years of experience in the field" shall be deleted;
22. in Paragraph 20 (1):
"(1) The basic part of the attestation study is common to all participants in this study and is organised in the form of weekly concentration to 2 expert blocks: public veterinary and veterinary hygiene with laboratory diagnostics in veterinary hygiene, epizootiology and welfare of animals with laboratory diagnostics in epizootiology. '.
23. In Paragraph 20 (2), "4 'is replaced by" 3' and ", animal welfare and 'is replaced by" and animal welfare,'.
24. In Paragraph 21 (5), the first sentence is replaced by the following: "A participant in a test study who did not pass the test may request a repetition of the test at the latest 6 months after the date on which he was notified that he did not pass the test."
25. in Paragraph 21, paragraph 6 is deleted;
Article 26 (22) to (25) shall be deleted, including the title.
27. in Paragraph 31 (4):
"(4) On the basis of a composite test, a specialist training participant shall obtain a certificate of competence for the investigation of wild game bodies and a certificate of a trained person. The model certificate is set out in Annex 5 to this Order. The model of the certificate of the trained person is set out in Annex 12 to this Order. ';
28. In the heading of § 39g, the words "and the certificate of peers' shall be inserted after the word" certificate '.
29. in Paragraph 39h (5):
"(5) On the basis of the successfully completed examination referred to in paragraph 1, a specialist training participant shall obtain a certificate of aptitude for the inspection of bees with the disassembly of the bee work and the certificate of the peekeeper. The model certificate is set out in Annex 13 to this Order. The model of the pedigree search card is set out in Annex 14 to this Decree. '
30. The following Sections 39j to 39l, including the title and footnote 15, are inserted after Section 39i:
"Organisation of specialised training to assist in carrying out tasks related to official controls and sampling or testing related to official controls
(K § 21a (5) of the Act)
Specialised training to assist in carrying out official control tasks and sampling or testing related to official controls shall be organised by the organiser in accordance with Article 14 of Commission Delegated Regulation (EU) 2019 / 62415.
(1) At the end of the specialised training provided for in § 39j, its participants shall be subjected to the examination before the examination committee, which is three members. The Chairman, who is a representative of the State Veterinary Administration, and other members of the Examination Board, shall be appointed and removed by the organiser from the representatives of the State Veterinary Administration and the organiser. The organizer determines the date and place of the exam. The test shall take the form of a written test and a practical part.
(2) Test result shall be assessed by the Test Panel at stage: test taken, test not taken. The test shall be performed if the participant has passed the successful written test and has complied with the practical part. The examination referred to in paragraph 1 shall be carried out by the Chairman of the Examination Committee in a report indicating the name and surname of the members of the Examination Committee, the date and place of the examination, the identification details of the participants in the specialised training and the results of their evaluation. The protocol shall be signed by all members of the examination committee. The Protocol shall be registered and kept by the organiser for the duration of the certificate issued.
(3) On the basis of the successfully completed examination referred to in paragraph 1, a specialist training participant shall obtain a certificate of competence to assist in carrying out tasks related to official controls and sampling or testing related to official controls. The model certificate is set out in Annex 15 to this Order.
(4) A participant in specialised training under § 39j who has not passed the examination may request the organizer to repeat it in writing not earlier than 3 months after the date on which he was notified that he did not pass the examination. The test may be repeated only once.
(5) A participant in specialised training under § 39j who did not pass the examination and did not apply for it to be repeated no later than 6 months from the date on which he was notified that he had not passed the examination and a participant in specialised training which did not take nor repeated the examination shall receive re-specialised training before the next examination.
(1) The organiser shall keep a list of participants in the specialised training provided for in Section 39j in electronic form.
(2) The list of participants consists of data on:
(a) the name and, where applicable, the names of the participant in the specialised training, the date and place of birth and the address of the participant in the specialised training; and
(b) the date and result of the examination according to § 39k.
(3) Entry into the list of participants shall be carried out by the organiser without undue delay after evaluation of the examination by the examination committee in accordance with § 39k, but no later than 5 days from the date of evaluation by the examination committee, and the updated list of persons holding the certificate in accordance with § 39k (3) shall be provided without delay by the State Veterinary Administration.
(4) When keeping the list of participants, the organiser will ensure that all the information referred to in paragraph 2 is kept, regular backup of the data from which the data contained in the list of participants can be reconstructed. Data backup shall be carried out without undue delay after the entry of the data referred to in paragraph 2 in the list of participants.
15) Commission Delegated Regulation (EU) 2019 / 624 of 8 February 2019 on specific rules for the implementation of official controls on meat production and for production and relaying areas for live bivalve molluscs in accordance with Regulation (EU) 2017 / 625 of the European Parliament and of the Council. ';
31. In the heading of Section 40, "[K § 53 (6) (b) of the Act] 'is replaced by" [K § 53 (8) (c) of the Act'.
32. Annexes 8 to 10 shall read as follows:

Transitional provisions
1. The pig breeders shall establish a permanent continuous fence in accordance with Article 2a of this Decree by 31 December 2020 at the latest.
2. Attestation studies started before the date of entry into force of this Order shall be completed in accordance with Decree No. 342 / 2012 Coll., as effective before the date of entry into force of this Order.
(3) The official certificates of the veterinary inspector, official veterinary assistant and inspector of the state surveillance of the classification of carcases of animals for slaughter issued in accordance with Decree No 342 / 2012 Coll., as effective before the date of entry into force of this decree, may be used until 31 December 2020 at the latest.
Efficacy
This Decision shall enter into force on 15 March 2020.
