laying down certain conditions for granting specific support to farmers
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll.:
Subject matter
This Regulation amends, following the directly applicable European Union1 ("the European Union Regulation '), certain conditions for granting specific support under the European Union Regulation governing rules for direct support2) granted to farmers (" payment of specific support') The State Agricultural Intervention Fund ("the Fund ').
Application for payment of the specific aid
(1) The Fund shall grant the payment of the specific aid referred to in Article 1 on application to:
(a) starch potatoes;
(b) hops,
(c) calf of the meat type,
(d) ewes or goats, where appropriate, mounted on grassland; or
(e) cows kept in a system with market milk production.
(2) The application for payment of the specific aid must be submitted to the Fund on the form issued by it by 15 May at the latest of the year for which the payment is requested (hereinafter referred to as the "calendar year concerned ').
(3) The application for payment of the specific aid, in addition to the formalities laid down in the administrative and European Union Regulation (3), contains:
(a) the list and the area of all soil blocks referred to in Article 3a (3) of the Agriculture Act, or parts of soil blocks referred to in Article 3a (4) of the Agricultural Soil Act, registered in the Land Register to the applicant pursuant to paragraphs 3a to 3k of the Agriculture Act (hereinafter referred to as "the Register") and their outline in the Soil Block Map, or parts of soil blocks, of a scale of 1: 10 000 or more,
(b) the marking and use method (4) of all soil blocks or parts of soil blocks referred to in (a);
(c) a declaration by the applicant that he has included in the application all the agricultural land he uses and undertakes to comply with the conditions5) throughout the calendar year.
(4) The application referred to in paragraph 2 may not be submitted to the Fund as from 1 April 2015.
Compensation for financial discipline
(1) According to the regulation of the European Union governing the financing, management and monitoring of the common agricultural policy31), the relevant calendar year for offsetting financial discipline is the calendar year of the application for payment of the specific support.
(2) Compensation for financial discipline shall be made for the applicant for payment of the specific aid for which the Fund has made an adjustment to the payments of the specific aid granted following the application for payment of the specific aid submitted in the relevant calendar year.
(3) The percentage of compensation for financial discipline shall be determined by the Fund by the ratio of the amount notified by the European Commission to the sum of all the adjustments to the specific support payments made in the relevant calendar year for applicants referred to in paragraph 2.
(4) The Fund shall determine, by decision of the applicant for payment of the specific support, the amount of compensation for the financial discipline by multiplying the percentage of compensation for the financial discipline referred to in paragraph 3 by the amount of adjustment for the payment of the specific support made to the applicant in the relevant calendar year and shall make payment of compensation for the financial discipline by 16 October of the calendar year following the application for payment of the specific support in the relevant calendar year.
Specific aid for starch potatoes
(1) The applicant for the payment of the specific aid for starch potatoes may be a natural or legal person managing agricultural land registered as arable land in accordance with Article 3i (a) of the Agricultural Act.
(2) The application for payment of the specific aid for starch potato is:
(a) a contract for the cultivation of potatoes for the production of starch or a copy thereof, concluded by the applicant for payment of the specific aid for starch potatoes for the marketing year concerned;
(b) a certificate of the applicant's participation in the professional training for the payment of the specific aid for starch production in the relevant calendar year held by the Central Control and Examination Institute for the production of potatoes for potato starch set out in Annex 1 to this Regulation;
(c) the list and area of the soil blocks and, where applicable, of the parts of the soil blocks covered by the application for payment of the specific aid for starch potato;
(d) drawing of soil blocks or parts of soil blocks as referred to in (c) on a map of soil blocks or parts of soil blocks, if any, of a scale of 1: 10 000 or more;
(e) recognition certificate (7) on the recognition of potato varieties.
(3) The minimum area (8) eligible for payment of the specific aid for starch potatoes is at least 1 hectare of arable land for which starch potatoes are grown. the data recorded in the register are decisive.
(4) The Fund will grant the applicant the payment of the specific starch potato aid for arable land, which is:
(a) registered in the register and fulfils the conditions for payment under this Regulation by the Government;
(b) registered in the applicant's register at least from the date of receipt of the Fund's application by 31 October of the relevant calendar year;
(c) the applicant shall be farmed on an agricultural basis in the relevant calendar year as long as it is registered in the register of the applicant referred to in (a);
(d) maintained under the conditions of good agricultural and environmental condition set out in Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll., laying down requirements according to the acts and standards of good agricultural and environmental condition for the areas of cross compliance rules and the consequences of infringements for the granting of certain agricultural aid throughout the calendar year concerned;
(e) kept under the conditions for the cultivation of potatoes for starch production listed in Annex 1 to this Regulation by 31 October of the calendar year concerned.
(5) The Fund grants to the applicant the payment of the specific aid for starch potato for the area of arable land for which potatoes for the production of potato starch are grown in full in accordance with paragraph 4, provided that the applicant for the payment of the specific aid for starch potatoes complies with the conditions laid down in this Regulation and complies with the good agricultural and environmental condition laid down in Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll., does not provide for a reduction or, where appropriate, non-payment of the specific aid for starch potato under the European Union1 Regulation.
Specific aid for hops
(1) The applicant for payment of the specific aid for hops may be the natural or legal person managing the agricultural land, who is registered as a hops in accordance with Article 3i (d) of the Agricultural Act and is accompanied by an aromatic variety of hops listed in the conditions for the cultivation of hops set out in Annex 3 to this Regulation.
(2) The application for payment of the specific aid for hops includes:
(a) a certificate of the applicant's participation in the professional training for the payment of the specific aid for hops in the relevant calendar year of the Central Control and Examination Institute for the production of hops set out in Annex 3 to this Regulation;
(b) the list and area of the soil blocks or parts of soil blocks to which the application for payment of the specific aid for hops relates;
(c) drawing of the soil blocks or parts of soil blocks referred to in (b) on the soil block map or soil block parts, if any, of a scale of 1: 10 000 or more.
(3) The minimum area (8) eligible for payment of the specific aid for hops is at least 1 ha of hops; the data recorded in the register are decisive.
(4) The Fund grants to the applicant the payment of specific aid for hops for hops, which is:
(a) registered in the register and fulfils the conditions for payment under this Regulation;
(b) registered in the applicant's register at least from the date of receipt of the Fund's application by the end of the relevant calendar year;
(c) the applicant shall be farmed on an agricultural basis in the relevant calendar year as long as it is registered in the register of the applicant referred to in (a);
(d) maintained under the conditions of good agricultural and environmental condition set out in Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll. throughout the relevant calendar year,
(e) kept under the conditions for growing hops listed in Annex 3 to this Regulation throughout the calendar year concerned.
(5) The Fund shall grant to the applicant the payment of the specific aid for hops for the area of hops for which hops are grown in full in accordance with paragraph 4, provided that the applicant for the payment of the specific aid for hops complies with the conditions laid down in this Regulation and complies throughout the calendar year with the conditions of good agricultural and environmental condition set out in Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll., unless the fact leading to a reduction or non-payment of the specific aid for hops pursuant to European Union Regulation (1) or pursuant to Article 8.
Specific aid for meat-type calf
(1) An applicant for the payment of a specific aid to a meat-type calf may be a natural or legal person who has declared the birth of a meat-type calf on a holding registered in a central register kept under the Breeding Act (10) (hereinafter referred to as "central register") in the period from 1 April of the year preceding the submission of the application until 31 March of the relevant calendar year.
(2) The calf mother to whom an application is made for the payment of the specific aid for meat-type calf must be a cow kept in a suckler milk system under European Union rules establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers (11), while the calf's father must be a bovine bull registered in the central register of breeds (12); the list of bovine meat breeds is set out in Annex 4 to this Regulation.
(3) A list of calves referred to in paragraph 1 shall be included in the application for payment of the specific aid for meat-type calf, including their identification numbers and dates of birth, the identification numbers of mothers with a designation of their system of dairy farming, the identification of the father according to the central register of breeders (12) and the calculation of livestock units; the conversion factor for determining the number of livestock units to be paid per meat-type calf is set out in Annex 5 to this Regulation.
(4) The Fund shall provide the applicant with the payment of the specific aid for a meat-type calf for the total number of livestock units determined on the basis of the number of calves born in the period provided for in paragraph 1, on the basis of the data referred to in paragraph 3, where the total amount of direct payments applied for or to be granted before the application of reductions and exclusions from payments in the calendar year concerned is at least EUR 100).
(5) The Fund shall not grant the payment of specific aid for a calf of a meat type to a calf of a type whose mother is a cow for which the payment of specific aid is requested in the same calendar year for cows kept in a system with market milk production pursuant to Article 7.
(6) The Fund shall grant the payment of the specific aid to a meat-type calf in full if the applicant for payment of the specific aid to a meat-type calf complies with the conditions laid down in this Regulation and complies with the good agricultural and environmental condition laid down in Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll. and where there is no fact leading to a reduction or, where appropriate, no payment of the specific aid for meat-type calf under European Union Regulation (1), or under Section 8.
Specific aid for ewes and, where applicable, goats mounted on grassland
(1) The applicant for payment of the specific aid for ewes or goats, if any, on grassland registered on the applicant's register may be the natural or legal person who keeps and passes the ewes or goats, as the case may be, as determined by the European Union Regulation establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers (13), on grassland (14) for a period of at least 15 May to 11 September of the relevant calendar year on the holding registered in the central register.
(2) The applicant for the payment of the specific aid for ewes and, where applicable, goats on grassland shall, within the period laid down in paragraph 1, keep for a period of 5 years from the date of application a grazing record containing the information resulting from:
(a) the identification number of the ewe and, where applicable, of the goats; where the applicant is grazing all ewes, goats, stables or holdings registered in the central register, it is sufficient to indicate in the grazing record, instead of the identification numbers of ewes or goats, if applicable, the stables or farm registration number;
(b) the identification number of the soil block or part thereof used on the relevant calendar day for grazing, where the ewes and, where appropriate, goats, grazing on one calendar day on several soil blocks, the identification numbers of all such soil blocks shall be indicated,
(c) the date of grazing of ewes, or goats, on grassland.
(3) The application for payment of the specific aid for ewes and, where applicable, goats shall include the list of ewes and, where appropriate, goats referred to in paragraph 1, including their identification numbers and dates of birth and, where appropriate, the date of entry into the central register and the calculation of livestock units; the conversion factor to determine the number of livestock units to be paid for ewes or goats, if applicable, on grassland is set out in Annex 5 to this Regulation.
(4) The Fund shall provide the applicant with a payment for ewes or goats, if applicable, on grassland, for the total number of livestock units established by reference to the number of ewes and grazing ewes or goats, on the basis of the data referred to in paragraph 3, with a minimum of two livestock units and the total amount of direct payments applied for or to be granted before the application of reductions and exclusions from payments in a given calendar year being at least EUR 100).
(5) The Fund grants the payment of specific aid for ewes and, where applicable, goats, which are fully covered by grassland, provided that the applicant fulfils the conditions laid down in this Regulation and complies with the good agricultural and environmental condition laid down in Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll. and where there is no fact leading to a reduction or, where appropriate, no payment of the specific aid for ewes, or goats, on grassland under European Union Regulation (1), or under Section 8.
Specific aid for cows kept in a market-producing system
(1) The applicant for the payment of the specific aid for cows kept in a system of market milk production is the natural or legal person who keeps cows in a system of market milk production ("dairy cows") on a holding registered in the central register on 31 March of the relevant calendar year.
(2) The application for payment of the specific aid for cows kept in a market-producing system shall include:
(a) the list of dairy cows kept by the applicant on 31 March of the relevant calendar year, including the identification numbers and dates of birth, and, where appropriate, the date of registration in the central register, the system of dairy farming and the calculation of livestock units; the conversion factor for determining the number of livestock units to be paid to dairy cows is set out in Annex 5 to this Regulation;
(b) a document for determining the proportion of milk proving the proportion of income or sales for milk sold in the total income or sales from agricultural production referred to in Article 2e (3) (a) to (e) of the Agriculture Act for the calendar year preceding the date of application; total revenues or revenues shall not include revenue or revenues from the operation of biomass processing facilities for the production of energy and fuel from renewable sources, subsidies and compensation for the event for the calendar year preceding the date of application,
(c) copies of documents proving the sale of milk to the customer for the calendar year preceding the date of application.
(3) Where the applicant produces and sells milk products from milk produced by dairy cows of the applicant, such milk products shall be considered as having been sold milk as referred to in paragraph 2 (b) and, for the calculation of income or sales, shall be based on monthly reports of direct milk sales pursuant to Government Regulation No 244 / 2004 Coll., laying down closer conditions for the application of the levy in the milk and milk products sector under the common organisation of the market in milk and milk products, as amended, by means of the conversion of milk products into equivalent quantities of milk as set out in the Annex to Government Regulation No 244 / 2004 Coll., as amended, multiplied by the average milk price recorded by the Czech Statistical Office for the calendar year preceding year of application; The Fund shall publish this prize in a way that allows remote access. In this case, the application referred to in paragraph 2 shall also include a calculation showing the proportion of added non-lactic matter in the milk product sold.
(4) The Fund shall grant the payment of the specific aid for cows kept in the dairy market system to the applicant for the payment of the specific aid for cows kept in the dairy market system for the total number of livestock units determined in accordance with the list of dairy cows referred to in paragraph 2 (a), provided that the proportion of income or sales for milk sold in the total income or sales from agricultural production referred to in paragraph 2 (b) and paragraph 3 for the calendar year preceding the date of application is greater than or equal to 15%.
(5) The Fund shall fix the rate for the payment of the specific aid for cows kept in a system with market milk production
(a) in full, where the proportion of income or sales for milk sold in the total income or sales from agricultural production referred to in paragraph 2 (b) and paragraph 3 for the calendar year preceding the date of application is greater than or equal to 30% and where there is no event leading to a reduction or, where appropriate, no payment of the specific aid for cows kept in a market-based milk system under European Union Regulation (1), or
(b) half the amount where the proportion of income or sales for milk sold in the total income or sales from agricultural production referred to in paragraph 2 (b) and paragraph 3 for the calendar year preceding the date of application is greater than or equal to 15% and less than 30% and does not result in a reduction or, where appropriate, not payment of the specific aid for cows kept in a market-based milk system under European Union1), or Article 8.
(6) The Fund will grant payment of the specific aid for cows kept in a system of market production if the total number of livestock units is at least 2 livestock units and if the total amount of direct payments applied for or to be granted before the application of the reduction and exclusion from the payment of the specific aid for cows kept in a system of market production in a given calendar year is at least EUR 100).
(7) The Fund will not grant payment of the specific aid for cows kept in a system with market milk production for cows,
(a) for which, in the same calendar year, a suckler cow payment is requested (15);
(b) for whose calf a payment of the specific aid per meat-type calf is requested in the same calendar year in accordance with Article 5.
(8) The Fund grants the payment of the specific support for cows kept in the system with market milk production in full, provided that the applicant fulfils the conditions laid down in this Regulation and complies with the good agricultural and environmental condition laid down in Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll. and where there is no fact leading to a reduction or, where appropriate, no payment of the specific aid for cows kept in a system with market milk production under European Union Regulation (1), or Article 8.
Reduction of payment or rejection
(1) If the Fund finds that the applicant in the application referred to in Article 2 did not indicate all the area in accordance with European Union16) and the difference between the total area in the application and the total total area in the application and the non-declared application is:
(a) more than 3% but less than or equal to 4% of the area declared in the application, reduce the payment by 1% 16),
(b) higher than 4% but less than or equal to 5% of the area declared in the application, reduced payment by 2% 16),
(c) higher than 5% of the area declared in the application, reducing the payment by 3% 16).
(2) If the Fund finds that the applicant has received a payment application pursuant to § 3 to 7 after the time limit laid down in § 2, or if necessary an amendment to the application after the time limit laid down by European Union17), it will reduce the payment or reject the application under the European Union17).
(3) If the Fund finds that the applicant for payment of the specific aid for starch potatoes has not complied with the conditions for cultivation of starch potatoes set out in Annex 1 to this Regulation, it shall reduce the payment of the specific aid for starch potatoes and, where appropriate, reject the application for payment of the specific aid for starch potatoes under the European Union Regulation (18).
(4) If the Fund finds that the applicant for the payment of the specific aid for hops has not complied with the conditions for growing hops set out in Annex 3 to this Regulation, it shall reduce the payment of the specific aid for hops and, where appropriate, reject the application for payment of the specific aid for hops in accordance with the European Union Regulation (18).
(5) If the Fund finds that the number of livestock units of the meat-type calves born to applicants for payment of the specific aid for meat-type calf during the period provided for in Article 5 is:
(a) more than the number of livestock units indicated in the application for payment of the specific aid for meat-type calf, shall use the number of livestock units indicated in the application for payment of the specific aid for meat-type calf, or
(b) lower than the number of livestock units indicated in the application for payment of the specific aid for meat-type calf, reduce the payment or reject the application for payment of the specific aid for meat-type calf pursuant to the European Union Regulation (19).
(6) If the Fund finds that the number of livestock units of ewes, or goats, raised and herded by the applicant for payment of the specific aid for ewes, or goats, on grassland during the period provided for in Article 6 is:
(a) more than the number of livestock units indicated in the application for payment of the specific aid for ewes or goats, if applicable, on grassland, shall use for the calculation of the payment the number of livestock units indicated in the application for payment of the specific aid for ewes or goats, if applicable, on grassland; or
(b) lower than the number of livestock units indicated in the application for payment of the specific aid for ewes, or goats, if applicable, on grassland, shall reduce the payment, or, where appropriate, the application for payment of the specific aid for ewes, or goats, on grassland shall be rejected in accordance with the European Union Regulation (20).
(7) If the Fund finds that the number of livestock units kept by the applicant for the payment of the specific aid for cows kept in a market-producing system pursuant to Article 7 on 31 March of the relevant calendar year is:
(a) more than the number of livestock units indicated in the application for payment of the specific aid for cows kept in a market-producing system shall use the number of livestock units indicated in the application for payment of the specific aid for cows kept in a market-producing system; or
(b) lower than the number of livestock units indicated in the application for payment of the specific aid for cows kept in a market-producing system, reduced the payment or, where appropriate, rejected the application for payment of the specific aid for cows kept in a market-producing system under the European Union Regulation (19).
(8) Where the Fund finds that the proportion of income or sales of milk sold in total agricultural income or sales referred to in Articles 7 (2) (b) and 7 (3) per calendar year prior to the date of application for payment of the specific aid for cows kept in a market-based milk system pursuant to Article 7 (the "proportion determined ') is:
(a) more than or equal to 15% and less than 30% and the proportion of income or sales for milk sold in the total income or sales of agricultural production referred to in paragraphs 7 (2) (b) and 7 (3) per calendar year prior to the date of application for payment of the specific aid for cows kept in the market-producing system referred to in the application for payment of the specific aid for cows kept in the market-producing system (hereinafter referred to as "the declared percentage") shall be higher or equal to 30%, the Fund shall reduce the applicant's payment resulting from the established proportion for which the applicant has fulfilled the conditions for payment by 50%;
(b) higher than the declared proportion, it shall use the declared percentage for the calculation of the payment.
(9) If the Fund finds cases of irregularities concerning the system for the identification and registration of bovine animals (21), the payment of the specific aid for meat-type calf or the payment of the specific aid for cows kept in a system for the market production of milk shall be reduced or, where appropriate, the application for the payment of the specific aid for meat-type calf or the application for the payment of the specific aid for cows kept in a system for the market production of milk shall be rejected under the European Union Regulation (19).
(10) If the Fund finds cases of irregularities concerning the system for the identification and registration of ewes and goats, it shall reject the payment of specific aid for ewes and, where appropriate, goats on grassland, it shall reduce the application for payment of specific aid for ewes and, where appropriate, goats on grassland under the European Union Regulation (20).
(11) Where the applicant for payment of the specific aid for ewes or goats, as the case may be, mounted on grassland during an on-the-spot check does not submit a grazing record in accordance with Article 6 (2) or if the grazing record is incomplete, the Fund shall not grant the applicant specific aid for ewes or goats, if applicable, on grassland.
(12) The provisions of paragraphs 1 to 11 are without prejudice to the provisions on reductions and exclusions laid down in the European Union Regulation (1).
Publication of payments
The amount of the payment rate referred to in paragraphs 3 to 7 shall be published by the Fund no later than 30 November of the relevant calendar year on its website and in at least one national journal.
Efficacy
This Regulation shall enter into force on 1 March 2012.

Conditions for growing potatoes for starch production
1. The applicant for payment of the specific aid for starch potatoes shall use only certified seed potatoes at a minimum of 2,2 tonnes per ha; he shall submit invoices for the seed and certification certificates delivered when checking this obligation. 22).
2. The applicant for the payment of the specific aid for starch potatoes shall comply with rotational stages in which the starch potatoes shall be repeatedly included in the same soil block or part of the soil block not earlier than the third year and shall keep a record of the rotation of crop practices on those soil blocks or parts of soil blocks.
3. The applicant for payment of the specific aid for starch potatoes shall ensure that the soil blocks on which starch potatoes are to be grown are fertilised with farm or organic fertiliser (23).
4. The applicant for the payment of the specific aid for starch potatoes in addition to farm or organic fertilisation shall use mineral fertilisers in kg of pure nutrients up to the maximum levels specified in Table 1.
5. The applicant for payment of the specific aid for starch potatoes may only use the listed active substances contained in pesticides authorised for use in the Czech Republic in the relevant calendar year in the specified dosage, and are listed in Table 2 to 4.
6. For each treatment against potato mandelins (Leptinotarsa decemlineata), the applicant for payment of the specific aid for starch potatoes may use the active substances contained in insecticides authorised for use in the Czech Republic in the relevant calendar year up to the maximum doses specified in Table 2.
7. For each treatment against potato mould (Phytophthora infestans), the applicant for payment of the specific aid for starch potatoes may use the active substances contained in fungicides authorised for use in the Czech Republic in the relevant calendar year up to the maximum doses specified in Table 3.
8. The applicant for the payment of the specific starch potato aid shall not exceed the maximum doses of the active substances listed in Table 4 when using herbicides authorised for use in the Czech Republic in the relevant calendar year.

Conditions for growing hops
1. The applicant for the payment of the specific aid for hops shall keep a register of hops in which one of the following aromatic varieties of hops is registered.
(a) Žatek half-morning red-red (RF), all its clones,
(b) Malt,
(c) Bor,
(d) Premiant,
(e) Harmonisation,
(f) Kazbek,
(g) Saaz Late,
(h) Bohemia,
(i) Saaz special.
2. In the case of hop planting during the period from 16 May of the year preceding the submission of the application until 15 May of the calendar year concerned, the applicant for payment of the specific hops aid shall:
(a) use only recognised certified hop seed in the health class "VT" or "VF" 30);
(b) in the course of the inspection, provide evidence of the acquisition of recognised certified hop seed in the health class "VT" or "VF" (tax document, planting certificate and recognition certificate 30).
3. The applicant for payment of the specific aid for hops shall use mineral fertilisers in kg of pure nutrients up to the maximum doses shown in Table 1.
4. Only the listed active substances listed in Table 2 contained in pesticides authorised for use in the Czech Republic in the relevant calendar year shall be used by the applicant for the payment of the specific aid for hops in the protection of hops. The applicant for specific hop aid in the protection of hops shall use the concentration of the product used on the basis of registered doses.
5. The applicant shall not use a plant protection product with the same active substance more than two consecutive times during the growing season of the relevant calendar year to ensure the necessary rotation of the different plant protection products. This does not apply to plant protection products authorised to be used only once per growing season of the relevant calendar year.
