DECLARATION
of 13 December 2005
amending Decree of the Ministry of Transport No. 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended
The Ministry of Transport provides pursuant to § 52 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended by Act No. 358 / 1999 Coll. and Act No. 118 / 2004 Coll.:
Decree No 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended by Decree No 83 / 2000 Coll. and Decree No 186 / 2005 Coll., is amended as follows:
1. In footnote 1, the words "Directive 97 / 68 / EC of the European Parliament and of the Council on the approximation of the laws of the Member States relating to measures against the emission of gaseous and particulate pollutants from internal combustion engines intended for non-road mobile machinery, as amended by Directive 2004 / 26 / EC of the European Parliament and of the Council of 21 April 2004 amending Directive 97 / 68 / EC 'are added.
2. in Annex 2, point 1.02 (k), the dot is replaced by a comma and the following points (l) to (o) are added:
"(l) a designated inland vessel - a vessel intended to sail on inland waterways of a length of 20 m or more and having a displacement of 100 m3 or greater, or a towing or pushing tug or pushing vessel of a length equal to or greater than 20 m or a lateral formation of such vessels; the displacement of the vessel is the volume calculated in accordance with the formula L x B x T, where L is the maximum hull length without rudder, B is the maximum torso width measured to the outer edge of the shell (without side wheels, belts and the like) and T is the vertical distance between the lowest torso point at the lower edge of the daytime lining or keel and the maximum line of the dive;
(m) particles - material parts which, at a temperature of not more than 52 ° C, are caught on a filter after dilution of the exhaust gas by a compression ignition engine of a specified inland vessel with filtered clean air;
(n) pollutants - carbon monoxide, hydrocarbons (HC), nitrogen oxides and particulate matter,
(o) emissions - pollutants in the exhaust gases of a diesel engine which is a propulsion device for a fixed inland vessel. ';
3. In Annex No 2, at the end of point 5.03, the following paragraph 5.03.3 is added:
"5.03.3. In the case that the propulsion equipment of a fixed inland vessel is a compression-ignition engine, the emissions of pollutants in the exhaust gases shall not exceed the following values for each category of compression-ignition engines:

These values of emissions of pollutants in exhaust gases, which shall not be exceeded, shall also apply to auxiliary compression ignition engines above 560 kW on specified vessels.
Compliance with the declared emission values of pollutants in the exhaust gases of the diesel engine of a fixed inland vessel shall be demonstrated by a type-approval certificate according to European Community law (4).
The emission values of pollutants in exhaust gases do not apply to compression-ignition engines of designated inland vessels of the State Navigation Administration, Fire Rescue Corps of the Czech Republic, Armed Forces and Safety Corps (5) of the Czech Republic, the municipal police and watercourses managers, if they are intended for service purposes, vessels of the components of the Integrated Rescue System, if they are intended to carry out rescue and disposal operations. In addition, the emission values of pollutants in exhaust gases shall not apply to compression-ignition engines of vessels intended for the construction, maintenance or operation of waterworks or other structures on watercourses, vessels intended for flood protection, vessels intended for the transport of up to 12 passengers, excluding crew and recreational sailplanes (6).
4) Article 4 and the following Directive 97 / 68 / EC of the European Parliament and of the Council on the approximation of the laws of the Member States relating to measures to be taken against the emission of gaseous and particulate pollutants from internal combustion engines for non-road mobile machinery, as amended by Directive 2004 / 26 / EC of the European Parliament and of the Council of 21 April 2004 amending Directive 97 / 68 / EC.
5) Act No. 361 / 2003 Coll., on the service ratio of members of the Security Corps. Act No. 585 / 2004 Coll., on the defence obligation and its provision (the defence law). Act No. 15 / 1993 Coll., on the Army of the Czech Republic and on amendments and additions to certain related regulations.
(6) Government Decree No 174 / 2005 Coll., laying down technical requirements for recreational craft, for semi-manufactured recreational craft and for their selected parts, for water scooters and propulsion engines for recreational craft and for water scooters. '
Transitional provisions
1. Article I (3) shall apply to compression-ignition engines of categories V1: 1, V1: 2 and V1: 3 only if they have been manufactured and installed on designated inland vessels after 31 December 2006.
2. Article I (3) shall apply to compression-ignition engines of categories V1: 4 and V2 only if they have been manufactured and installed on designated inland vessels after 31 December 2008.
Efficacy
This decree shall take effect on the day of its publication.
