publishing the measures of the Central Board of Trade Unions on changes in insurance premiums
The Prime Minister announces, pursuant to § 63 (1) of Act No. 54 / 1956 Coll., on the sickness insurance of employees, the attached measure of the Central Council of the Unions of 13 January 1967 on changes in the insurance contributions of sickness insurance.

MEASURES OF THE CENTRAL COUNCIL OF THE UNION
of 13 January 1967
on changes in insurance premiums sickness insurance
With the agreement of the Government of the Czechoslovak Socialist Republic pursuant to § 63 (1) of Act No. 54 / 1956 Coll., on the sickness insurance of employees:
The measures of the Central Council of Trade Unions on the organisation and conduct of staff sickness insurance published by the Prime Minister's Order of 28 December 1958 No 91 Coll., as amended by Decree No 191 / 1960 Coll., are hereby amended as follows:
Paragraph 24 to 28 read:
"Reporting, clearing and payment of benefits and premiums
(1) The sickness insurance benefits which the plant has paid (settled) under Paragraph 16 are paid to it in accordance with the conditions laid down below.
(2) The race is required to report for each calendar month to the Regional Trade Union Council, which is responsible for it (Sections 10 (3) and (4)), the levy charged. Benefits granted unjustly, amounts exceeding the correct amount of benefits and benefits which are not documented, cannot be declared and paid by sickness insurance.
(1) If the establishment is an organisation which pays the contributions to the State Budget or to the National Committee as part of a gross income or profit payment, *) as part of the income tax payment of cooperative and other organisations * *) or as part of an agricultural tax payment, * * *) or is incorporated into such an organisation, the relevant regional trade union board shall report only the amounts charged to the prescribed statement of benefits.
(2) The plant presents a statement of benefits and collects the funds to cover them through a branch of the Czechoslovak State Bank, where the sickness insurance fund is held by the Regional Trade Union Council responsible for it. The statement of benefits, together with the corresponding transfer order, shall be submitted by the establishment to that branch for each calendar month at the latest on the day that the establishment is designated for the payment of wages and salaries for the month covered by the statement. The Czechoslovak State Bank will not execute the order unless it is supported by a statement of benefits.
(3) If the plant has wrongly chosen a remuneration for benefits which it may not pay under Paragraph 24 (2), the Regional Trade Council shall prescribe a premium of the amount of the wrongful remuneration. This premium shall be paid in full within 15 days of delivery of the payment notice directly to the Regional Trade Union Council for the benefit of the sickness insurance fund account.
(4) The provisions of the preceding paragraphs shall also apply to budgetary and contribution organisations in respect of which the insurance is compensated by an appropriate adjustment to their budgets.
(1) A plant not covered by Paragraph 25 is required to calculate the premiums for each calendar month itself and to report them together with the levies charged for that month to the relevant Regional Trade Council on the prescribed statement of premiums and benefits.
(2) The statement of premiums and benefits is presented to the Regional Trade Union Council through the Czechoslovak State Bank branch, where the plant has an account. At the same time, it gives the branch an order to pay the difference between insurance premiums and benefits in favour of the sickness insurance fund account administered by the relevant Regional Council. The plant shall be obliged to present these documents no later than the day on which the plant is designated for the payment of wages and salaries for the month covered by the report and, if not specified, no later than 8 days after the end of the month covered by the report. However, if the benefits are higher than the insurance premiums, the plant shall submit a statement of premiums and benefits to the branch of the Czechoslovak State Bank, with the account of the relevant Regional Trade Council, together with an order to pay the difference on the account of sickness insurance funds administered by the Regional Trade Council.
(3) If the plant does not have an account with a branch of the Czechoslovak State Bank, it is obliged to submit a statement of premiums and benefits directly to the relevant regional trade union board no later than 8 days from the due date of the premium and to pay the difference by which the premium exceeds the benefits by no later than the same period. If the benefits are higher than the insurance premiums, the Regional Trade Council shall pay the amount due to the establishment within 8 days of the date of receipt of the statement.
(4) The Regional Trade Council shall prescribe insurance premiums by the payment rate of the establishment referred to in paragraph 1 if the establishment:
(a) it has not declared them at all or calculated them and has reported them incorrectly at a lower rate; or
(b) incorrectly deduct from insurance benefits which, pursuant to Article 24 (2), may not be recognised and paid, thereby shortening the undue contribution.
If the plant does not provide the supporting documents necessary to establish the correct amount of the premiums it was intended to pay, the Regional Trade Council may prescribe an insurance policy according to the ratios in a similar plant of approximately the same size. The prescribed premium shall be paid by the plant no later than 15 days from the date of delivery of the full amount of the payment notice to the Regional Trade Union Council in favour of the sickness insurance fund account.
Reinsurance premium
(1) If the establishment does not comply with the rules on safety and health at work or with the rules on health and safety at work, or with the national health authority's final decision, or if, according to the findings of these authorities, the plant is not properly installed or properly operated, the district trade union council will impose a premium on the insurance.
(2) The premium is imposed up to 5% of the total wage determined in accordance with Paragraph 21. It shall apply from the first day of the calendar month following that in which the decision or finding of deficiencies in the establishment has been taken. Where a time limit has been set for the correction of deficiencies, the premium shall apply from the first day of the calendar month in which the period passed without result. The obligation to pay the premium shall expire on the last day of the calendar month in which the deficiencies in the establishment have been remedied; the proof of this shall be provided by certifying the authority which decided on the deficiencies.
(3) The premium imposed shall be paid by the plant for each calendar month directly to the relevant Regional Trade Council in favour of the sickness insurance fund account.
(4) The provisions of Sections 21 to 23 and 28 to 34 apply mutatis mutandis to the premium premium.
Penalties
(1) If the plant has not paid within 8 days of the date of maturity of the premium which under the previous provisions is required to pay the Regional Trade Council for each calendar month, or has not paid the difference between the premiums declared and the premiums declared within 8 days of the date of maturity of the premium, it shall be obliged to pay a penalty of 0,05% for each day of delay from the due date, but at least in the case of one delay of 10 CZK.
(2) With the prescribed rate of insurance (Sections 25 (3) and 26 (4)), the plant is obliged to pay a penalty payment of 0,05% for each day from the date on which the premiums were reduced or, where applicable, from the date on which they were due, to the date on which the payment was settled on its account to the Regional Trade Council, but not less than 10 CZK for each regulation.
(3) If the plant has not been properly completed within the prescribed time limit (§ 25) or the insurance and benefit statement (§ 26), the Regional Trade Union Council may prescribe a penalty payment of between 20 CZK and 200 CZK.
(4) For periodic penalty payments under the preceding paragraphs as well as for periodic penalty payments under other provisions of this measure (§ 13 (4), § 50 (3)), the provisions on the reporting of arrears, on enforceability, enforcement, limitation period and reimbursement of premiums shall apply (§ 29 to 34). '
1. Reporting, settlement and payment of benefits and premiums shall take place in accordance with this measure, starting with the levies and the premiums charged on the bill of account and payment for the month of January 1967.
2. Paragraph 27 on the premium as amended by this measure applies for the first time to the premium for January 1967.
This measure shall take effect on the day of its publication.
