DECLARATION
of 26 February 2020
amending Decree No 388 / 2011 Coll., implementing certain provisions of the Law on the provision of benefits to disabled persons, as amended
The Ministry of Labour and Social Affairs provides pursuant to Section 37 of Act No. 329 / 2011 Coll., on the provision of benefits to disabled persons and on the amendment of related laws, as amended by Act No. 331 / 2012 Coll. and Act No. 313 / 2013 Coll., for the implementation of Sections 9 (13) and 34b (2) of this Act:
Decree No. 388 / 2011 Coll., on the implementation of certain provisions of the Act on the provision of benefits to persons with disabilities, as amended by Decree No. 356 / 2012 Coll., Decree No. 409 / 2012 Coll., Decree No. 333 / 2013 Coll., Decree No. 388 / 2013 Coll., Decree No. 116 / 2014 Coll., Decree No. 337 / 2014 Coll. and Decree No. 408 / 2017 Coll., are amended as follows:
1. In Article 1, the words "with a severe defect in the carrier or movement system, severely hearing impaired persons, severely visually impaired persons and persons with severe or deep mental retardation 'are replaced by the words" with disabilities the nature of a long-term unfavourable health condition'.
2. In Annex 1, Part III, point 4 (a):
"(a) an aid for listening to equipment capable of reproducing radio or television broadcasts or an aid for listening to equipment for reproducing sound or visual recordings;"
3. In Annex No 1, Part III, point 4 (c), the words "if necessary i 'shall be inserted after the words" a'.
4. In Annex 1, Part III, point 5, the words "visual communication devices allowing online interpretation into the sign language; it is a device with the support of 3G and LTE (4G) Internet, a front camera of at least 2 Mpx and a display of at least 6" 'is replaced by "a device enabling visual communication; it is a device with at least 4G LTE Internet support, a front camera of at least 2 Mpx, a display of at least 5,5" and optical image stabilization. "
5. In Annex No 1, the following Part IV is inserted after Part III:
"IV. Special aids intended for disabled persons of an internal nature causing severe mobility restriction
Persons with disabilities listed in Part I. (4) of the Annex to the Act shall be identified by the following specific aids:
(a) discards;
(b) portable ramp,
(c) setolez,
(d) vertical lifting platform, including installation;
(e) inclined lifting platform, including installation;
(f) grate ramp, including installation;
(g) staircase seat, including installation;
(h) additional modifications to the motor vehicle; these are modifications requiring installation, such as manual control, facilitating boarding, loading of the trolley,
(i) works related to the extension of the door in the apartment,
(j) works related to the adaptation of bathrooms and toilets, including works related to the extension of doors in the context of the adaptation of bathrooms and toilets; the construction work and the material necessarily related thereto, but not the tiles, floor coverings, sanitation, etc. ';
Part IV to date is renumbered Part V.
6. In Annex 1, Part V., "4 'is replaced by" 5'.
7. In Annex 4, point 1 (j), the words "including a highly functional type of autism 'are replaced by the words"; in the case of a moderate degree of autistic disorder with adequate communication and behaviour in normal situations, with difficult social contacts, with special or inadequate responses to social stimulation of the surroundings'.
8. In Annex 4, point 2 (m), the words "including a medium-functional type of autism 'are replaced by the words"; in the case of a moderate degree of autistic disorder with conspicuous deficits in verbal and non-verbal communication, significantly abnormal or disruptive behaviour, with a significantly reduced or significantly abnormal response to social stimulation of surroundings'.
9. In Annex 4, point 3 (m), the words "including a low-functional type of autism 'are replaced by the words"; in the case of a severe degree of autism disorder with severe verbal and non-verbal disorder, severe abnormal or disruptive behaviour, with minimal response or severe abnormal response to social stimulation of the surroundings'.
Efficacy
This Decision shall enter into force on 1 March 2020.
