GOVERNMENT REGULATION
of 3 February 2016
on the parameters and values of permissible pollution of waste water and the particulars of the permit for discharge of waste water into groundwater
The Government orders pursuant to § 38 paragraphs 5 and 8 of Act No. 254 / 2001 Coll., on Water and on the Amendment of Certain Laws (Water Act), as amended by Act No. 20 / 2004 Coll., Act No. 150 / 2010 Coll. and Act No. 350 / 2012 Coll., hereinafter "the Act ':
Indicators and values of permissible waste water pollution
(1) The parameters for the permissible pollution of waste water discharged into groundwater and the maximum permissible values for these indicators (hereinafter referred to as emission standards) are set out in Annex 1 to this Regulation.
(2) The classification of the CE-labelled product, which is an essential part of the water works declared under Article 15a of the Act, is set out in Annex 2 to this Regulation.
Formats of authorisation for discharge of waste water into groundwater
(1) The permit to discharge waste water into groundwater contains in addition to the general requirements
(a) the period for which the authorisation is issued;
(b) the method of discharge of waste water;
(c) identification of the place (s) in which the waste water is discharges, in X-coordinate, Y-coordinate the semi-rapid component in the S-JTSK coordinate system for which the authorisation is issued, with the number of the hydrogeological area, the body of groundwater and the hydrological number of the river basin order;
(d) the maximum annual quantity of waste water discharged;
(e) emission limits which are the maximum permitted values of the waste water pollution indicators to be complied with at the sampling point;
(f) the method, frequency, type and place of sampling of waste water discharges;
(g) the method for determining the quantities of waste water discharged;
(h) the method of carrying out the analysis of discharges of waste water by individual pollution indicators specified in the permit for discharges of waste water into groundwater according to the relevant technical standard; where the relevant technical standard is not issued, the water authority shall determine the method of analysis on an individual basis on the basis of available supporting documents;
(i) how to evaluate the results of the analyses of the different pollution indicators and the results of the measurements and the determination of the volume of waste water discharged into groundwater and the quantity of pollutants discharged for the purposes of recording and checking;
(j) the method, form, frequency and date of transmission of the results of the measurements to the water authority.
(2) The minimum frequency of measurement of the rate of waste water pollution referred to in paragraph 1 (f) shall be twice a year with sample type A, which shall mean a two-hour composite sample obtained by passing 8 incremental samples of the same volume at an interval of 15 minutes. If the cleaning device is equipped with a storage area for cleaned waste water allowing a hydraulic delay period of at least 2 hours, a single sample type taken from the storage compartment may be used.
(3) For the purpose of analysis of microbiological parameters, a sterile sample panel shall be used, the sample shall be cooled to 2 to 8 ° C during sampling and transport to the laboratory and processed within 18 hours after collection; measurements shall be evenly distributed over the year and shall take into account the nature of the pollution source activity.
(4) The quantity of waste water discharged referred to in paragraph 1 (g) shall be determined according to the water-meter readings taken from drinking water and utility water or measured at the outlet of the cleaning plant. For cleaning plants with a capacity below 50 equivalent inhabitants, an estimate of the quantity from the indicative number of the annual water needs1 may be used if it is not technically possible to use the method of measurement according to the first sentence.
Determination of permitted pollution values
(1) When authorising discharges of waste water from individual buildings for housing and family recreation, the Water Authority shall determine the permitted pollution values up to the emission standards set out in Table 1A of Annex 1 to this Regulation.
(2) When authorising discharges of waste water from individual buildings providing accommodation services, the Water Authority shall determine the permitted pollution values up to the emission standards set out in Table 1 B of Annex 1 to this Regulation.
(3) Where the statement of a person with professional competence (2) shows that, in view of the hydrogeological characteristics found and the amount of waste water discharged, the groundwater contamination is liable to be caused by microbiological contamination, the Water Authority shall, in addition to the permitted levels of pollution referred to in paragraph 1 or 2, also determine the permitted levels of pollution of microbiological parameters as set out in Table 1 C of Annex 1 to this Regulation.
(4) In the case of the determination of the permissible levels of contamination of microbiological indicators referred to in paragraph 3, microbiological pollution shall be eliminated by means of a technical installation which is part of a sewage treatment plant and the technology of which shall allow the achievement of the values of microbiological indicators established by the water authority and shall not have a negative effect on the chemical composition of waste water.
(5) When authorising discharges of waste water in areas with special protection pursuant to § 30 or 33 of the Act, the Water Authority shall specify permitted pollution values more stringent or for several indicators according to the nature and requirements for the protection of those territories.
(6) Where a waste water treatment facility notified under Section 15a of the Water Act is used for the treatment of waste water, it shall fall under the classification of the CE-labelled product set out in Annex 2 to this Regulation.
(7) Acceptable levels of pollution shall not be considered to be complied with if dilution of waste water, such as precipitation waters, has been used to achieve them.
Transitional provision
The classification of the CE-labelled product referred to in Article 3 (6) for the Ncelk indicator shall be fulfilled no later than 18 months after the date of entry into force of this Regulation.
Final provision
This Regulation has been notified in accordance with Directive (EU) 2015 / 1535 / EU of the European Parliament and of the Council of 9 September 2015 on the procedure for the provision of information in the field of technical and information society services, as amended.
Repeal
Government Decree No. 416 / 2010 Coll., on the parameters and values of permissible pollution of waste water and the formalities for the authorisation to discharge waste water into groundwater, is repealed.
Efficacy
This Regulation shall enter into force on 1 March 2016.

Explanatory notes:
* The number of equivalent inhabitants (EO) is calculated from the balance in the BSK5 indicator in kg per calendar year on the inflow to the cleaning plant divided by 18,7. If there is no indication of the amount of pollution in the inflow, the design capacity of the cleaning plant may be used to include the cleaning plant in the size category. The design capacity shall be sufficient to ensure appropriate treatment of waste water at the maximum expected load of the cleaning plant.
* * "m" is the excess value of the pollution indicator of waste water discharged into groundwater, expressed in mg / l.
* * * "m" is the excess value of the pollution indicator of waste water discharged into groundwater, expressed in cfu (colony forming units) / 100 ml. This indicator is set by the Water Authority where the expression of a person with professional competence 4) results in the necessary limits on microbiological pollution.
