on the complete version of Decree No. 32 / 1954 Coll., on the adaptation of certain ratios of members of national committees
In accordance with Article II of Decree-Law No 39 / 1958 Coll. I declare in the annex the full text of Decree-Law No 32 / 1954 Coll., on the modification of certain ratios of members of the national committees, as follows.

The Government of the Czechoslovak Republic hereby orders, pursuant to Articles 27 and 33 (1) and (2) of Act No. 13 / 1954 Coll., on National Committees, and under the legal measure of the Bureau of the National Assembly No. 38 / 1958 Coll., on the heads of trade unions of national committees:
Members of the national committees shall be obliged to perform the function to which the people have called them, conscientiously and honestly, in the spirit of the people's democratic establishment. They are guaranteed to perform their duties without prejudice to their working earnings. In order not to interfere with the functioning of the national economy and to ensure the greatest possible economy, the national committees shall organise the activities of their members in a fundamental way so that they can perform their duties mainly outside working hours.
(1) The employer shall, at the request of the Board of the National Committee, provide the staff member who is a member of the National Committee with the necessary time to fulfil the obligations arising from his membership of the National Committee.
(2) The employer shall, at the request of the Board of the National Committee for which the member is a member, provide the Presidents, their Vice-Presidents and the Secretaries of the National Committees in employment with the unpaid leave of employment required for the performance of his duties.
(3) In accordance with the principles referred to in paragraphs 1 and 2, single agricultural cooperatives and other production cooperatives shall also release their members for their duties in the National Committee.
(1) For the period of leave provided under Paragraph 2 (1), the staff member shall be entitled to all benefits in cash as if he had worked for him during that period.
The cash benefits payable by staff members during the period of leave shall be calculated on the basis of the staff member's average earnings over the last three months. During such leave, staff members shall have in-kind benefits if they can take them.
(2) The members of the national committee who are not in employment (members of single agricultural cooperatives, privately employed farmers, etc.), or who are domestic workers, shall, at their request, provide the national committee with adequate compensation for the profits lost from their duties.
(3) Members of the national committees are entitled to reimbursement of the necessary expenses incurred in the performance of their duties. This expenditure shall be borne by the national committee. The provisions applicable to civil servants shall apply mutatis mutandis to the right to reimbursement of the expenditure and to the determination of its amount.
The national committee shall provide the chairpersons, their deputy and the secretaries of the national committee with remuneration for the performance of their duties. Remuneration is an assessment of the extent of liability and the importance of the function and includes compensation for lost earnings.
The Presidents, their Deputy and Secretaries of the National Committees, who are unable to carry out their previous duties, shall be assessed in the light of the Regulations on Recoveries and for the purposes of sickness and pension insurance as staff of the National Committees.
(1) A staff member who has been granted leave to perform the duties of a member of the national committee (§ 2 (1) and (2)) cannot, for this reason, be reduced to the rights and entitlements arising from the employment relationship (for example, when he is assigned to the working or pay classes and groups as regards the entitlement to and the length of his or her leave, in terms of sickness insurance, pension insurance, loyalty allowance, etc.).
(2) Membership of the National Committee cannot justify the transfer (transfer, transfer) of a staff member to a post which would make it impossible for him to perform his duties, or to work less qualified, or to release his employment. If the employer infringes this provision, the competent ministry shall, on a proposal from the Board of the National Committee, arrange for immediate redress.
The provisions of Sections 2 (2) and 4 and 5 shall also apply to members of the boards of the national committees responsible for the management of trade unions of the national committees.
More detailed regulations will be issued by the Ministry of the Interior in agreement with the Ministry of Finance, the State Office of Planning, the Central Council of Trade Unions and the State Office of Social Security. *)
This Regulation shall enter into force on 1 June 1954;
*) With regard to sickness insurance and pension insurance, this competence was transferred to the Central Council of Trade Unions and the State Social Security Office (§ 2 (3) (c) and § 9 of Act No. 54 / 1956 Coll., on Social Security for Employees, and § 3 (3) (c) and § 32 of Act No. 55 / 1956 Coll., on Social Security).
