DECLARATION
of 26 February 2024
determining a comparable length of the period for which a fixed lending rate is agreed and dividing consumer housing credits into groups for the purpose of compensating for the early repayment of certain consumer housing credits
The Czech National Bank provides pursuant to Section 160 of Act No. 257 / 2016 Coll., on Consumer Credit, as amended by Act No. 462 / 2023 Coll., for the implementation of Section 117a (3) of this Act:
Subject matter
This decree provides for the reimbursement of the costs of early repayment of certain consumer housing loans
(a) determination of a comparable length of the period for which a fixed lending rate is agreed;
(b) breakdown of consumer loans for housing into groups according to the comparable length of the period for which a fixed lending rate is agreed and whether it is a consumer loan for housing
1. pursuant to Article 2 (2) (b) of the Consumer Credit Act, secured by a lien on immovable property,
2. under Paragraph 2 (2) (b) of the Consumer Credit Act, unsecured by a mortgage on a immovable property,
3. pursuant to Paragraph 2 (2) (c) of the Consumer Credit Act, secured by a lien on immovable property,
4. pursuant to Paragraph 2 (2) (c) of the Consumer Credit Act, unsecured by a mortgage on a immovable property.
Determination of a comparable period length
The comparable length of the period for which a fixed lending rate is agreed shall be determined as the period with a fixed lending rate
(a) up to 1 year;
(b) over 1 year to 3 years;
(c) over 3 years up to 5 years;
(d) over 5 years up to 10 years;
(e) over 10 years.
Breakdown of consumer loans for housing into groups
Consumer loans for housing
(a) according to Article 2 (2) (b) of the Consumer Credit Act secured by a mortgage on immovable property, it is subdivided into groups according to the comparable length of the fixed lending rate period
1. up to 1 year,
2. over 1 year to 3 years,
3. over 3 years to 5 years,
4. over 5 years up to 10 years,
5th over 10 years,
(b) according to Paragraph 2 (2) (b) of the Consumer Credit Act, unsecured by a mortgage on immovable property, it is subdivided into groups according to the comparable length of the fixed lending rate period
1. up to 1 year,
2. over 1 year to 3 years,
3. over 3 years to 5 years,
4. over 5 years up to 10 years,
5th over 10 years,
(c) according to Paragraph 2 (2) (c) of the Consumer Credit Act secured by a mortgage on immovable property, it is subdivided into groups according to the comparable length of the fixed loan rate period
1. up to 1 year,
2. over 1 year to 3 years,
3. over 3 years to 5 years,
4. over 5 years up to 10 years,
5th over 10 years,
(d) according to Article 2 (2) (c) of the Consumer Credit Act, unsecured by a mortgage on immovable property, it is subdivided into groups according to the comparable length of the fixed lending rate period
1. up to 1 year,
2. over 1 year to 3 years,
3. over 3 years to 5 years,
4. over 5 years up to 10 years,
5th over 10 years.
Efficacy
This Decree shall take effect on 1 April 2024.
