of 6 February 2013
laying down rules for the classification of road motor vehicles in emission categories and on emission plaque
The Government orders pursuant to § 14 (8) of Act No. 201 / 2012 Coll., on Air Protection:
§ 1
Preliminary provisions
(1) This Regulation provides for:
(a) the way in which road motor vehicles are classified in emission categories;
(b) patterns of emissions plaque;
(c) the rules governing the marking of a road motor vehicle with the appropriate emission plaque;
d) closer conditions for the distribution of emissions plaques and their price.
(2) This Government Regulation has been notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended by Directive 98 / 48 / EC.
§ 2
Method of classifying road motor vehicles into emission categories
(1) A road motor vehicle shall be classified in the emission category according to the degree of compliance of the exhaust emission limit values according to the European Union Regulation (1).
(2) Where the information referred to in paragraph 1 is not available, the date of the first entry of a road motor vehicle in the register of road vehicles in the State where the road motor vehicle was first put into service.
(3) The level of compliance with the emission limit values referred to in paragraph 1 or the date of first entry of a road motor vehicle in the register of road vehicles referred to in paragraph 2 shall be demonstrated for the purpose of determining the emission category by registration in the road vehicle technical licence.
(4) The method of classification of road motor vehicles in emission categories is set out in Annex 1 to this Regulation.
§ 3
Emission plaque models
(1) Emission plaques differ in colour according to the respective emission category. The following are used as basic background colours for plaques:
(a) red for emission category 2,
(b) yellow for emission category 3,
(c) green for emission category 4.
(2) Vehicles with emission category 1 are not subject to any emission plaque.
(3) Emission plaque shall have the shape of an octagonal diameter of a circle inscribed 60 mm. The field for registration of the vehicle registration mark shall be white. Emission plaque has a black frame 2 mm wide around the perimeter.
(4) On the front of the emission plaques visible from the outside of the road motor vehicle are the following elements:
(a) an emission category number with a height of 25 mm placed 5 mm below the upper edge;
(b) a white field for the registration of a vehicle registration plate measuring 45 × 15 mm located at the bottom;
(c) original guilloche frames in the plaque colour area;
(d) a silver-coloured holographic element with a protected graphic pattern placed in the upper half of the plaque to the left of the emission category number,
(e) the security features covered by the classified information regime under another legislation (2) contained in the section of the technical specification of the product.
(5) On the rear side of the emission plaques visible from the interior of the road motor vehicle are the following elements:
(a) information on its use and location;
(b) the written serial number of the series and the six-digit serial number of the emission plaque.
(6) The model of the emissions plaque is set out in Annex 2 to this Regulation.
§ 4
Rules for the marking of a road motor vehicle with an emission plaque
(1) The emission plaque shall contain an indication of the registration mark of a road motor vehicle whose authorised entry into the low emission zone is demonstrated by the plaque. The registration mark shall be marked when the emission plaque is issued after a documentary check showing the classification of the road motor vehicle in the relevant emission category.
(2) The emissions plaque must be applied to the whole surface on the inside of the clear glass of the front window of the road motor vehicle at the right lower edge of the glass so that the driver's vision from the vehicle is as limited as possible and the plaque is well visible from the outside of the vehicle.
(3) If the road motor vehicle is not equipped with front glass, it is sufficient for its driver to prove that it has a plaque on it.
§ 5
Closer conditions of distribution and cost of emissions plaques
(1) The price of the plaque is 80 CZK.
(2) Where an application for an emission plaque is sent by post or in electronic form, the applicant shall include a copy of the road vehicle technical licence. In this case, the person who provides the distribution of the plaque shall send the plaque to the applicant by mail. The cost of sending the plaque shall be borne by the applicant.
(3) The emission plaque distributor shall keep a record of the emissions plaque issued by him. The registration shall contain a series and six-digit serial number of the emission plaque shown on the back of the emission plaque, the emission category, the registration number of the road vehicle and the information on who and when issued the emission plaque.
§ 6
Efficacy
This Regulation shall take effect on the 15th day following its publication.
