GOVERNMENT REGULATION
of 4 February 2004
amending Government Regulation No 462 / 2003 Coll., on the issue of the Customs Tariff and fixing the rates of import duty applicable to goods originating in developing and least-developed countries and the conditions for their application (Customs Tariff) and amending certain related provisions
The Government mandates pursuant to Sections 56 (2) and 57 (1) (a), (c), (d), (f) and (g) of Act No. 13 / 1993 Coll., Customs Act:
Government Regulation No 462 / 2003 Coll., on the issue of the Customs Tariff and on the fixing of import duty rates for goods originating in developing and least-developed countries and the conditions for their application (Customs Tariff) and amending certain related provisions shall be amended as follows:
1. In Annex 1, Chapter 15, Additional Note 2:
'2.A. Headings 1509 and 1510 cover only oils obtained exclusively from the processing of olives having the following analytical characteristics of the fatty acids and sterols content:

Headings 1509 and 1510 do not cover chemically modified olive oil (in particular reesterified olive oil) and mixtures of olive oil with other oils.
B. Subheading 1509 10 covers only olive oils as defined in paragraphs I and II below, obtained solely by mechanical or physical processes, under conditions which do not entail a change of oil and which have not undergone any treatment other than washing, decanting, centrifugation or filtration. Olive oils obtained with solvents or aids having chemical or biochemical effects or a re-esterification process and any mixtures with other oils are excluded from this subheading.
I. For the purposes of subheading 1509 10 10, "olive oil for lighting," whatever its acidity, olive oil:
(a) with a wax content not exceeding 300 mg / kg;
(b) containing an erythrodiol and uvaol content (urs-12-en-3,28-diol) not exceeding 4,5%;
(c) with a saturated fatty acid content at the second position of triglycerides not exceeding 1,5%;
(d) the sum of trans- oleic acid isomers not exceeding 0,10% and the sum of trans- linoleic acid isomers not exceeding 0,10%;
(e) a stigmastadiene content not exceeding 0,5 mg / kg;
(f) the difference between the HPLC results and the theoretical content of triglycerides with ECN42 0,3 or less;
(g) with one or more of the following characteristics:
1. a volatile halogenated solvent content exceeding 0,2 mg / kg or more than 0,1 mg / kg for any of these solvents;
2. organoleptic properties showing moderate defects exceeding 2,5.
II. For the purposes of subheading 1509 10 90, "virgin olive oil 'means olive oil having the following characteristics:
(a) an acid content, expressed as oleic acid, not exceeding 2,0 g / 100 g;
(b) a peroxide number not exceeding 20 millimoles of active oxygen per kg;
(c) a wax content not exceeding 250 mg / kg;
(d) a content of volatile halogenated solvents not exceeding 0,2 mg / kg in total and not exceeding 0,1 mg / kg in each of them;
(e) an extinction coefficient of K270 not exceeding 0,25;
(f) an extinction coefficient deviation (ΔK) in the 270-nanometer area not exceeding 0,01;
(g) organoleptic characteristics showing moderate defects not exceeding 2,5;
(h) an erythrodiol and uvaol content not exceeding 4,5%;
(ij) a saturated fatty acid content at the second position of triglycerides not exceeding 1,5%;
(k) the sum of trans- oleic acid isomers not exceeding 0,05% and the sum of trans- linoleic acid isomers not exceeding 0,05%;
(l) a content of stigmastadienes not exceeding 0,15 mg / kg;
(m) the difference between the HPLC results and the theoretical content of triglycerides with ECN42 is 0,2 or less.
C. Subheading 1509 90 covers olive oil obtained by the treatment of olive oils falling within subheading 1509 10 10 or 1509 10 90, whether or not mixed with virgin olive oil, having the following characteristics:
(a) an acid content, expressed as oleic acid, not exceeding 1,0 g / 100 g;
(b) a wax content not exceeding 350 mg / kg;
(c) a K270 extinction coefficient not exceeding 0,90;
(d) an extinction coefficient deviation (K) in the 270 nm area not exceeding 0,15;
(e) an erythrodiol and uvaol content (urs-12-en-3,28-diol) not exceeding 4,5%;
(f) a saturated fatty acid content at the second position of triglycerides not exceeding 1,8%;
(g) the sum of trans- oleic acid isomers not exceeding 0,20% and the sum of trans- linoleic acid isomers not exceeding 0,30%;
(h) the difference between the HPLC results and the theoretical content of triglycerides with ECN42 is 0,3 or less.
D. "crude oils" of subheading 1510 00 10 shall be taken to be oils obtained mainly from olive pomace having the following characteristics:
(a) an erythrodiol and uvaol content (urs-12-en-3,28-diol) exceeding 4,5%;
(b) a saturated fatty acid content at the second position of triglycerides not exceeding 2,2%;
(c) the sum of trans- oleic acid isomers not exceeding 0,20% and the sum of trans- linoleic acid isomers not exceeding 0,10%;
(d) the difference between the HPLC results and the theoretical content of triglycerides with ECN42 is 0,6 or less.
E. Subheading 1510 00 90 covers oils obtained from the processing of oils of subheading 1510 00 10, whether or not blended with virgin olive oil, and oils which do not have the characteristics of oils specified in Additional Notes 2B, 2C and 2D. The oils of this subheading must have a saturated fatty acid content at the second position of triglycerides not exceeding 2,2%, the sum of trans- isomers of oleic acid less than 0,40%, the sum of trans- isomers of linoleic acids and linolenic acids less than 0,35% and the difference between the HPLC results and the theoretical content of triglycerides with ECN42 not exceeding 0,5. '
2. In Annex No 1, Chapter 15, column 2, for tariff subheading 1509 10 10, the words "Virgin olive 'are replaced by the words" Olive'.
This Regulation shall enter into force on 10 February 2004.
