DECISION
President of the Republic
of 3 February 1993
On the occasion of my entry into the office of the President of the Republic, I exercise the right conferred on me by the Constitution of the Czech Republic and declare this
amnesty:
(1) I hereby order that it be not initiated and, if it has been initiated, that criminal prosecution be brought to an end for offences committed negligently before the date of this Decision, provided that the law provides for a custodial sentence of not more than three years.
(2) I shall waive the prison sentences, the non-executed punishments and the remnants thereof, imposed by force before the date of this Decision for the offences referred to in paragraph 1, with the effect that the date of this Decision shall be regarded as not being convicted of the perpetrators.
(3) The provisions of paragraph 2 shall not apply to aggregate or aggregate penalties imposed for the offence referred to in paragraph 1 in the run-up to a criminal offence committed out of negligence, the upper limit of which is more than three years or with an intentional offence.
(1) I hereby require the Attorney General and the Minister of Defence to submit to me, after examination, proposals for a decision in which cases will not be initiated and, if it has been initiated, criminal prosecution will be terminated or applications for remission of the sentences or remnants imposed prior to the date of this Decision for the offences of non-establishment of the armed forces in accordance with Article 269 (1) of the Criminal Law committed after 17 January 1992.
(2) I hereby order the Attorney General, the Minister of Justice and the Minister of Defence to submit to me, after examination, proposals for a decision to stop the prosecution, to forgive or to reduce the penalties imposed on offences committed prior to the date of this Decision by persons not covered or covered only in part by this Decision, if:
(a) pregnant women,
(b) women or lonely men caring for a child under the age of 15;
(c) men over 60 and women over 55, and
(d) persons who are disabled or suffering from a serious disease.
