Communication from the Federal Ministry of Foreign Affairs on the negotiation of an amendment to the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland on the facilitation of travel for citizens of both states

The Federal Ministry of Foreign Affairs states that an amendment to the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland on the facilitation of travel to the citizens of the two states signed in Warsaw on 20 July 1977 was agreed by exchange of personal notes of 2 August 1990 in Prague and 24 September 1990 in Warsaw. The amendment to the Agreement entered into force on 24 September 1990.
The Czech version of the Czechoslovak note and the translation of the Polish note are announced simultaneously.

Dear Minister,
I have the honor To inform you that the Government of the Czech and Slovak Federal Republic has agreed to make the Czechoslovak-Polish Friendship Road available to third-country citizens in order to further expand tourism in accordance with the relevant provisions of the documents adopted in the Helsinki process. With reference to the previous negotiations between representatives of the Czech and Slovak Federal Republic and the Polish Republic on this issue, I have the honour to propose, under the authority of the Government of the Czech and Slovak Federal Republic, the following amendment to the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the Polish People's Republic on the facilitation of travel for citizens of both states of 20 July 1977.
"The following amendments shall be made to Article 7 of the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland to facilitate the travel of citizens of the two States, signed in Warsaw on 20 July 1977:
(a) the following paragraph 2 is added:
"" 2. The paths of Czechoslovak-Polish friendship, leading to the ridges of the Giant Mountains, may be used by citizens of third countries if they have a travel document. Citizens of third States shall be subject to the laws of the Contracting Party in whose territory they are located. "'.
(b) paragraphs 2 and 3 shall become paragraphs 3 and 4. ";
I propose that this note and note of your Excellency, confirming the agreement of the aforementioned proposal, should form an agreement between both our governments.

Dear Minister,
I have the honour of confirming receipt of your note of 2 August 1990, as amended below:
I have the honour to inform you that the Government of the Czech and Slovak Federal Republic, in order to further expand tourism in accordance with the relevant provisions of the documents adopted in the Helsinki process, has agreed that "The path of Czechoslovak-Polish friendship" should also be made available to third-country citizens.
With reference to the previous negotiations between representatives of the Czech and Slovak Federal Republic and the Republic of Poland on this issue, I have the honour to propose the following amendment of the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the Polish People's Republic on the facilitation of travel for citizens of both states of 20 July 1977.
"The following amendments shall be made to Article 7 of the Agreement between the Government of the CSSR and the Government of the PLR on the facilitation of travel for citizens of both States, signed in Warsaw on 20 July 1977:
(a) the following paragraph 2 is added:
"" 2. The paths of Czechoslovak-Polish friendship, leading to the ridges of the Giant Mountains, may be used by citizens of third countries if they have a travel document. Citizens of third States shall be subject to the laws of the Contracting Party in whose territory they are located. "'

I propose that this note and note of your Excellency, confirming the agreement with the above proposal, should constitute an agreement between both our governments. "
Under the authority of the Government of the Republic of Poland, I have the honour to agree to the abovementioned amendments in Article 7 of the Agreement between the Government of the CSSR and the Government of the PLR on the facilitation of travel for citizens of both states, signed in Warsaw on 20 July 1977.
In my note of 5 February 1990, Minister, I proposed to you that, in accordance with the conclusions adopted during our meeting on 11 January 1990 and during the talks of Prime Minister Tadeusz Mazowiecki with Prime Minister Marián Čalfa in Prague on 22 January 1990, citizens of third countries may benefit from the common "Czechoslovak-Polish friendship paths" since 1 April 1990.
Your note, Minister, and this answer is therefore a defining confirmation of the consent of our governments to the practice used since 1 April 1990 and also provides for an agreement between them.
