DECLARATION
of 16 February 2023
amending Decree No. 346 / 2013 Coll., on the submission of statements by banks and branches of foreign banks to the Czech National Bank, as amended, and Decree No. 426 / 2013 Coll., on the submission of statements by savings and credit cooperatives to the Czech National Bank, as amended
Czech National Bank provides pursuant to § 41 paragraph 3 of Act No. 6 / 1993 Coll., on the Czech National Bank, as amended by Act No. 227 / 2013 Coll.:
Amendment of the Order on reporting by banks and branches of foreign banks to the Czech National Bank
Decree No. 346 / 2013 Coll., on the submission of statements by banks and branches of foreign banks to the Czech National Bank, as amended by Decree No. 216 / 2014 Coll., Decree No. 300 / 2015 Coll., Decree No. 325 / 2019 Coll., Decree No. 246 / 2021 Coll. and Decree No. 230 / 2022 Coll., is amended as follows:
1. Paragraph 6 (4) reads as follows:
"(4) A bank which is not included in the prudential consolidation at the level of the Czech Republic and a branch of a bank from a non-Member State shall be established and submitted for:
(a) by 15 March of each calendar year, by 31 December of the preceding year, the FP (IND) statement 01-01 "Financing plans on an individual basis"; and
(b) the previous financial year by 15 June of the following calendar year, the REMHE (IND) statement 01-01 "Information on the remuneration of high-income workers." ';
2. In Article 6, the following paragraph 6 is added:
"(6) The Bank shall draw up and submit by 15 June of the following calendar year a statement of REMHR (IND) 01-01" Approved higher ratios between the variable and fixed remuneration components "and every two years."
3. In Article 7 (1), at the end of point (b), the word "a 'is replaced by a comma.
4. In Article 7, at the end of paragraph 1, the dot is replaced by "a 'and the following point (d) is added:
"(d) for the previous financial year up to 15 June of the following calendar year, the REMHE (CON) statement 01-01" Information on the remuneration of high-income workers on a consolidated basis. "';
5. The following points 34 to 36 are added at the end of Annex 1:
"34. REMHE (IND) 01-01" Information on the remuneration of high-income workers "
The statement shall include information on the number of workers with remuneration equivalent to EUR 1 000 000 and more broken down by working grade and structure of the remuneration of those workers.
35. REMHE (CON) 01-01 "Information on the remuneration of high-income workers on a consolidated basis"
The statement shall include information on the number of workers with remuneration equivalent to EUR 1 000 000 and more broken down by working grade and structure of the remuneration of those workers.
36. REMHR (IND) 01-01 "Authorised higher ratios between variable and fixed remuneration components"
The statement shall contain data on an agreed variable-fixed remuneration ratio of more than 100% and the number of staff selected who have been awarded remuneration with a variable-fixed remuneration ratio exceeding 100% for the financial year. ';
Transitional provisions
1. The statement referred to in § 6 (4) (b) of Decree No. 346 / 2013 Coll., as effective from the date of entry into force of the Order, shall be submitted by a bank which is not included in the prudential consolidation at the level of the Czech Republic and by the branch of a bank from a non-Member State for the first time by 15 June 2024.
2. The statement provided for in Article 6 (6) of Decree No 346 / 2013 Coll., as effective from the date of entry into force of the Order, shall be submitted by the Bank for the first time by 15 June 2025.
3. The statement referred to in Article 7 (1) (d) of Decree No 346 / 2013 Coll., as effective from the date of entry into force of the Order, shall be submitted by a bank which is a domestic controlling bank and which is not controlled by a European financial holding company and by the financial holding company for the first time by 15 June 2024.
Amendment of the Order on the submission of statements by savings and credit cooperatives of the Czech National Bank
Decree No. 426 / 2013 Coll., on the submission of statements by savings and credit cooperatives to the Czech National Bank, as amended by Decree No. 310 / 2014 Coll., Decree No. 301 / 2015 Coll., Decree No. 326 / 2019 Coll. and Decree No. 246 / 2021 Coll., is amended as follows:
1. Paragraph 3 (7) reads as follows:
"(7) A cooperative reserve which is not included in prudential consolidation at the level of the Czech Republic is compiled and submitted for
(a) by 15 March of each calendar year, by 31 December of the preceding year, the FP (IND) statement 01-01 "Financing plans on an individual basis"; and
(b) the previous financial year by 15 June of the following calendar year, the REMHE (IND) statement 01-01 "Information on the remuneration of high-income workers." ';
2. In Article 3, the following paragraph 8 is added:
"(8) The cooperative reserve shall draw up and submit by 15 June of the following calendar year a statement of REMHR (IND) 01-01" Approved higher ratios between the variable and fixed remuneration components "and every two years. '
3. The following points 10 and 11 are added at the end of Annex 1:
"10. REMHE (IND) 01-01" Information on the remuneration of high-income workers "
The statement shall include information on the number of workers with remuneration equivalent to EUR 1 000 000 and more broken down by working grade and structure of the remuneration of those workers.
11. REMHR (IND) 01-01 "Authorised higher ratios between variable and fixed remuneration components"

Transitional provisions
1. The statement provided for in Article 3 (7) (b) of Decree No. 426 / 2013 Coll., as effective from the date of entry into force of the Decree, shall be submitted by the cooperative reserve which is not included in the prudential consolidation at the level of the Czech Republic, for the first time by 15 June 2024.
2. The statement provided for in Article 3 (8) of Decree No. 426 / 2013 Coll., as effective from the date of entry into force of the Decree, shall be submitted by the cooperative reserve for the first time by 15 June 2025.
EFFECTIVE
This Decree shall take effect on 1 July 2023.
