Ordinance on certain obligations of manufacturers and operators of steam boilers (steam generators) and other pressure vessels and amending certain provisions on the safety and economy of these technical installations

DECLARATION
Ministry of Energy and Water Management
of 27 April 1960
adapting certain obligations of manufacturers and operators of steam generators and other pressure vessels and amending certain provisions on the safety and economy of these technical installations
The Ministry of Energy and Water Management shall, in agreement with the participating central authorities and the Central Council of Trade Unions pursuant to Article 10 (1) of Decree-Law No 53 / 1952 Coll., provide for the safety and economy of the operation of certain technical installations:
Čl. I
Obligations of manufacturers and steam generators and other pressure vessels
§ 1
(1) Manufacturers are required to submit to the Institute of Technical Supervision (hereinafter referred to as the Institute) for approval structural materials of steam boilers (steam generators) with structural overpressure over 16, pressure vessels stable at the highest working pressure over 25, metal pressure vessels for the transport of gases with test pressure over 33 and all metal pressure vessels for the transport of ammonia and chlorine; The scope and type of such structural documents shall be laid down in the relevant provisions. *)
(2) However, the obligation referred to in paragraph 1 shall apply only to those establishments whose construction is substantially different from those already approved by the Institute; where there is doubt as to whether there is a substantial difference, the manufacturer shall request a binding opinion from the Constitution.
§ 2
(1) Manufacturers shall, after completion of steam boilers (steam generators) and pressure vessels stable for their construction and first pressure tests; such tests may also be carried out by assembly plants if they have written consent from the manufacturer. Manufacturers are also obliged to draw up and supply revision books for these manufactured equipment. *)
(2) After a successful construction and first pressure test, the manufacturer or assembly plant shall mark the rivets of the factory label and the safety valves with a 10 mm round steel trap with its mark or abbreviated race name, if applicable; it also confirms the revision books with its signature and bears a round stamp of 35 mm in diameter with the same marking.
(3) The tests and operations referred to in paragraphs 1 and 2 shall be carried out by the technical inspection (OTK) department of the manufacturer and, where appropriate, the assembly plant whose qualifications have been verified by the Institute.
(4) In the case of steam boilers (steam generators) and pressure vessels stable as referred to in Article 1 (1), manufacturers or assembly plants, as the case may be, are required to declare the date of the construction and the first pressure tests of the Institute at least 14 days in advance in order to be able to take part in those tests by their authority.
§ 3
In order to ensure the safe, reliable and economical operation of steam boilers (steam generators) and pressure vessels stable, their operators are required to carry out the necessary revisions (inspections and tests) in the framework of scheduled maintenance; the results of these revisions are recorded in the operating record book.
§ 4
In particular, the institutions of the Institute shall check:
(a) whether and how manufacturers ensure that manufactured steam boilers and other pressure vessels comply with technical regulations and standards, as well as the requirements of safe and economical operation;
(b) whether and how operators of steam boilers (steam generators) and pressure vessels stable ensure their proper operation and maintenance and operate such equipment safely, reliably and economically; checks on operators shall be carried out by the Institute's authorities according to the condition of the installation,
pressure tests, however, not later than 9 years,
internal inspections no later than 5 years,
external inspections no later than 3 years
since the last test or inspection of the same species. The results of these tests and inspections shall be recorded by the control authority in the revised books of the establishments checked.
§ 5
(1) When carrying out inspections and tests pursuant to Article 4 (1) (a) (ii) (ii) of Regulation (EC) No 1069 / 2009, the competent authority shall: (b) it is not possible or is associated with serious technical difficulties with regard to the design, location or operating conditions of steam boilers (steam generators) and pressure vessels stable, the Institute may specify other means of control or other time limits for such inspections and tests.
(2) The Institute may waive inspections and tests of pressure vessels stable in accordance with § 4 (b). (b) in establishments with a number of such pressure vessels higher than 100, after verification of the qualifications of the professional staff (review technicians) of such plants for the purpose of carrying out revisions within the meaning of Article 3 and after consultation with the competent superior central authority; Revision technicians in these cases only enter the results of the revisions in the revision books, contrary to the provisions of Section 3.
Čl. II
Amendments and additions to Decree No. 188 / 1957 Ú. l., on metal pressure vessels for the transport of gases
Decree No 188 / 1957 Ú. l, concerning metal pressure vessels for the transport of gases, is amended as follows:
1. Paragraph 6 is added to paragraph 7, which reads: "Gas containers shall be tested in accordance with Article 5.122 of the Code by 31 December 1960 at the latest. '
2. Article 8, including the title, shall be deleted;

This decree shall take effect from the date of its publication.

*) Testing, publishing of revision books, as well as maintenance of metal pressure vessels for the transport of gases is regulated by the Regulations and Technical Rules for metal pressure vessels for the transport of gases, published by Decree No. 188 / 1957 Ú. l.
