DECLARATION
of 18 February 2019
amending Decree No 62 / 2001 Coll., on the Management of Organisational Components of the State and State Organisations with State Property, as amended
The Ministry of Finance provides for the Act No. 219 / 2000 Coll., on the assets of the Czech Republic and its presentation in legal relations, as amended by Act No. 229 / 2001 Coll., Act No. 503 / 2012 Coll. and Act No. 51 / 2016 Coll.:
Decree No. 62 / 2001 Coll., on the Management of Organisations of the State and State Organisations with State Property, as amended by Decree No. 569 / 2006 Coll. and Decree No. 82 / 2016 Coll., is amended as follows:
1. In Section 21 (1) of the introductory part of the first sentence, the words "tangible real estate 'shall be inserted after the words" purchase' and the words "on the Office's website 'shall be inserted after the words" material real estate'.
2. In Paragraph 21 (1) of the introductory part of the second sentence, the word "published 'is replaced by" published'.
3. In Article 21, the following paragraphs 2 and 3 are inserted after paragraph 1, including footnotes 23 to 26:
"(2) In the case of a material movable item sold, the terms of the selection procedure shall be published on the website of the relevant organisational body or state organisation and on the website of the Office. Depending on the nature and condition of the case sold, the relevant organisational body or state organisation may ensure publication in another appropriate way.
(3) The procedure provided for in paragraph 2 shall not be used for weapons (23), ammunition, ammunition, explosives and security material24) of the armed forces of the Czech Republic (25), security corps (26), the Ministry of Defence and the Ministry of Interior, where the relevant organisational body publishes the terms of the selection procedure in an appropriate manner according to the nature and condition of the case being sold.

24) For example, Act No. 229 / 2013 Coll., on the treatment of certain items which can be used for defence and security purposes in the Czech Republic (Act on the Management of Security Material), as amended.
25) Act No. 219 / 1999 Coll., on the Armed Forces of the Czech Republic, as amended.
26) Act No. 361 / 2003 Coll., on the service ratio of members of the Security Corps, as amended. '
Paragraph 2 shall become paragraph 4.
4. In Article 24, the words "to 3 'shall be inserted after the words" paragraph 1'.
This Decision shall enter into force on 1 June 2019.
