on the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on visa-free travel
On 30 March 1978, the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on visa-free travel was signed in Karlovy Vary. The Agreement entered into force pursuant to Article 12 thereof on 30 April 1978.
The Czech version of the Agreement is hereby published at the same time.

AGREEMENT
between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on visa-free contact
Government of the Czechoslovak Socialist Republic and Government of the German Democratic Republic,
basing itself on the Treaty of Friendship, Cooperation and Mutual Assistance between the Czechoslovak Socialist Republic and the German Democratic Republic, signed on 3 October 1977,
led by the desire to continue to deepen brotherhood between the two States, to facilitate the universal recognition of the national citizens of one State by the socialist facilities, history and culture of the other, thereby supporting the process of further convergence of the peoples of both countries,
agree on the following:
National citizens of the Czechoslovak Socialist Republic and the German Democratic Republic shall be exempt from the visa requirement to the extent and under the conditions laid down in this Agreement.
1. National citizens of one State who are resident in its territory or in the territory of a third socialist State which is a member of the Council of Mutual Economic Assistance shall be exempt when crossing the national borders of another State for the purpose of temporary residence or transit from the visa requirement.
2. National citizens of one State resident in the territory of States other than those referred to in paragraph 1 shall be exempt from the visa requirement when travelling through the territory of another State to the State of which they are nationals. The transit through the territory of the other State must take place within the time limit laid down by its legislation.
1. National citizens of one State may stay in the territory of another State for up to 30 days from the date of crossing the national border.
2. The competent authorities of the beneficiary State may, where justified, extend the period of stay within the validity of the travel document for a maximum period of six months, including an extension. In the event of invalidity of a travel document, the stay may be extended only after the diplomatic mission or consular post of the State of which the person is a national citizen has restored the validity of the travel document. Consent for extension shall be granted free of charge.
3. National citizens of one State travelling on official duty in the territory of another State may stay in its territory for the duration of their secondment. This provision shall also apply to members of their families.
1. State citizens of one State resident in the territory of another State may travel to the State of which they are nationals and return without visas.
2. National citizens of one State who are resident in the territory of another State may only travel to the territory of a third State in accordance with the law of the State in whose territory they are resident.
National citizens of one State who intend to reside permanently in the territory of another State shall be obliged to obtain an entry visa of the other State.
State citizens of the Czechoslovak Socialist Republic and the German Democratic Republic may cross national borders to the designated border crossing points.
1. The travel documents in force referred to in the Annex to this Agreement shall be authorised to cross national borders.
2. A minor who does not have his own travel document shall be entered in the travel document of the person with whom he travels in accordance with the legislation of the State of which the minor is a national citizen.
3. Within 30 days of the date of signature of this Agreement, the Contracting Parties shall exchange, by diplomatic means, the specimens of the travel documents referred to in the Annex to this Agreement. The Contracting Parties shall inform each other of any changes to these travel documents by the same means not later than 30 days before their introduction and shall simultaneously send their models.
1. National citizens of one State who have lost their travel document in the territory of another State shall be required to report the loss without delay to the competent authority of that State. That authority shall give them, free of charge, a certificate of notification of the loss of a travel document authorising them to return to the State of which they are nationals.
2. However, only a replacement travel document issued by a diplomatic mission or consular post of the State of which the person who lost his travel document is a national shall be entitled to travel to a third State, on the basis of the confirmation referred to in paragraph 1.
3. Departure on a replacement travel document shall be governed by the legislation of the State in whose territory the travel document has been lost.
National citizens of one State are obliged to comply with its legislation during their stay in the territory of another State.
The Agreement shall be without prejudice to the right of both States to refuse entry into their territory of an undesirable person, to prohibit his or her residence or to expel him or her to a State of which such person is a national citizen. The competent authorities of the Contracting Parties shall inform each other of the implementation of such measures.
The competent authorities of the Contracting Parties shall inform each other, as appropriate, on matters relating to the implementation of this Agreement and shall jointly take the necessary measures to ensure its implementation.
The Agreement shall enter into force 30 days after the date of its signature.
2. The date of entry into force of this Agreement will be the expiry of the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the German Democratic Republic on visa-free travel, signed in Prague on 14 July 1967.
The Agreement shall be concluded for an unlimited period. It shall expire three months after receipt of the written notice from one of the Contracting Parties.
Done in Karlovy Vary on 30 March 1978 in duplicate, each in the Czech and German languages, the two texts being equally authentic.
