THE LAW
of 27 January 2021
amending Act No. 189 / 1999 Coll., on Emergency Oil Stocks, on dealing with oil emergencies and amending certain related acts (Emergency Oil Stocks Act), as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
The Act No. 189 / 1999 Coll., on the Emergency Oil Stocks, on dealing with oil emergency situations and amending certain related acts (Act on Emergency Oil Stocks), as amended by Act No. 560 / 2004 Coll., Act No. 281 / 2009 Coll., Act No. 161 / 2013 Coll., Act No. 131 / 2015 Coll., Act No. 183 / 2017 Coll. and Act No. 225 / 2017 Coll., is amended as follows:
1. At the end of footnote 1, the sentence "Commission Implementing Directive (EU) 2018 / 1581 of 19 October 2018 amending Council Directive 2009 / 119 / EC as regards methods for calculating the obligations to maintain stocks is added to the separate line. '.
2. In Article 1a, at the end of point (k), the dot is replaced by a comma and the following point (l) is added:
"(l) ticket reservation contract for the priority purchase of certain quantities of oil and petroleum products in the event of an oil emergency."
3. In Paragraph 2 (3), "31 March 'is replaced by" 30 June'.
4. Paragraph 3 (13) reads as follows:
"(13) The storage of emergency stocks of the Czech Republic in the territory of another Member State of the European Union requires the prior approval of the Government. '
5. In Article 3, the following paragraphs 16 and 17 are inserted after paragraph 15:
"(16) The storage of emergency stocks of another Member State of the European Union on the territory of the Czech Republic, including in the form of tickets, requires the prior approval of the Ministry of Industry and Trade (hereinafter referred to as" Ministry ') for the duration of the storage of emergency stocks of another Member State of the European Union on the territory of the Czech Republic. The Ministry will request a statement from the Administration before taking a decision. The prior approval of the Ministry is also required in case of an increase in the volume of stored emergency stocks during the duration of the agreement on storage or extension of the mandate to store emergency stocks of another Member State of the European Union in the Czech Republic.
(17) The request for the approval of the Ministry referred to in paragraph 16 shall include:
(a) identification details of the applicant;
(b) the name of the Member State of the European Union for which emergency stocks are stored in the Czech Republic;
(c) identification of the entity for which the emergency stocks are stored;
(d) the place of storage of emergency stocks of another Member State of the European Union in the Czech Republic;
(e) the quantity of emergency stocks stored;
(f) the period during which emergency stocks will be stored in the Czech Republic,
(g) an indication of whether the stocks are emergency stocks in the form of oil or petroleum products. ';
Paragraph 16 shall become paragraph 18.
6. In Article 5 (1), the text "§ 3 (16) 'is replaced by" § 3 (18)'.
7. in Paragraph 9 (1) (e), the words "Ministry of Industry and Trade" are replaced by the words "Ministry."
8. in Paragraph 9 (1) (f), "Ministry of Industry and Trade" is replaced by "Ministry."
Čl. II
Transitional provision
Applications for government approval to store emergency stocks submitted before the date of entry into force of this Act shall be assessed in accordance with existing legislation.
Čl. III
Efficacy
This Act shall take effect on the 15th day following its publication.
