Government Regulation No. 51 / 2017 Coll.

In order to ensure the conservation of the nature and landscape of part of the territory of the river Odra, the Protected Landscape Region of Poodří is hereby declared.

(1) The mission of the protected landscape area is to preserve and restore its natural environment, in particular ecosystems, including wildlife and flora, to preserve and restore ecological functions and processes in the territory and to preserve the typical nature of the landscape while developing an environmentally optimal system for the use of the landscape and its natural resources.

(2) The conservation of the protected landscape area is the harmoniously shaped landscape of the river Oder and its tributaries with preserved natural processes of the natural native ecosystem, with a typical landscape impact formed by a mosaic enclave of meadow aluvial grasslands, meadow forest crops, with a significant representation of trees growing outside the forest, with old arms of watercourses, permanent and periodic tides, a spring in the slopes of river terraces, and ponds with species of colorful flora and fauna with a function of significant pull-off of waterbirds and with natural values of the landscape consisting in the preserved dynamics of the natural river processes of meandering and the regime of surface waters. Wet communities and their associated rare and specially protected species of plants and animals are also the subject of protection, the location and urban structure of the municipalities, including preserved monuments of historic settlement, and the protection of the European significant location Poodří and the European important location Cihelna Kunín.

(1) The protected landscape area is situated in the territory of the Moravian-Silesian Region.

(2) The territorial demarcation and description of the border of the protected landscape area are set out in Annex 1 to this Regulation.

(3) An indicative graphical representation of the protected landscape area is given in Annex 2 to this Regulation.

(4) The marking of the border of the protected landscape area on the basis of a copy of the cadastral map, including the electronic form, is stored in the central lists1).

(1) The territory of the protected landscape area is divided into 4 zones of graduated nature conservation.

(2) Territories with the most significant natural values, in particular natural or man-made forest ecosystems, nature close to ecosystems created and maintained by farming and other particularly significant areas in terms of biodiversity and ecological stability of the countryside, are included in the I. zone.

(3) The territory of water, forest and meadow ecosystems with locally preserved natural values and other naturally valuable areas which are economically used in an environmentally friendly manner are to be classified in the II. zone. This zone also includes economically unused contaminated shrubs, reeds, ponds, periodically flowing old shoulders and periodic ponds, i.e. land not used economically in the flood area of 1-2-year-old waters, as well as areas necessary for the conservation of natural values in zone I.

(4) The III zone includes a significantly modified ecosystem, intensive use of agricultural and forest land, production ponds, dispersed rural development and installation of special purpose buildings, in particular for forestry, agriculture, water management and transport infrastructure.

(5) The IV zone is included in the human activity of a strongly modified part of nature and built-up areas not included in other zones of nature conservation.

(1) In the territory of a protected landscape area outside the built-up territory of the municipalities, only with the prior agreement of the competent nature conservation authority

(a) weigh off-road reductions or modify or alter natural watercourses;

(b) to de-mud water tanks and watercourses and store extracted sediment;

(c) carry out the aerial application of fertilisers and biocides;

(d) damage or remove lithoral crops of ponds and other water areas and floating or submerged vegetation;

(e) indicate pedestrian, cycling, running, riding and other similar routes, routes and paths;

(f) organise events involving more than 100 participants;

(g) keeping or releasing wild ducks and their cross-breeds;

(h) fly on sports flying equipment; or

(i) operate unmanned flying remote control equipment, except for State security, protection of persons, property or public order, and flights for the needs of nature conservation authorities.

(2) In the area of the I and II protected landscape area, only with the prior agreement of the competent nature conservation authority may the mulch and gravel be left in place, not on the maintenance of water works. The prior agreement of the competent nature conservation authority is not necessary in the event of a flood, emergency or emergency climate situation and in the event of fire extinguishing, emergency or emergency situations.

(3) On the territory of the II and III protected landscape areas, only with the prior approval of the competent nature conservation authority can the slurry, fugat, silage and other liquid waste be applied.

(4) In the territory of the III zone, plantations of geographical wood may only be planted on land not intended for the performance of forest functions with the prior consent of the nature conservation authority.

Administrative procedures initiated and not completed by the date of application of this Regulation shall be completed in accordance with existing legislation.

Decree No. 155 / 1991 Coll., on the establishment of the Protected Landscape Area of Poodri, is hereby repealed.

This Regulation shall enter into force on 1 March 2017.

Protected landscape area The field is situated in the cadastral territories of Albrechtka, Bartošovice, Bernartice nad Odra, Bravantice, Butovice, Smooth Livovice, Hukovice, Jeseník nad Odra, Jistebnice, Košatka nad Odra, Kunín, Mankovice, Nová Horka, Petřvaldík, Polanka nad Odra, Proskovice, Pustejov, Stará Bělá, Stará Ves nad Ondřednice, Studenka nad Odra, Suchdol nad Odrou, Svinov, Šenov u Nové Jíčín, Great Albrechtice, Vrné u Oder, Vyškovice u Ovice, Zábřáh nad Odra.

The border leads from the railway stop Mankovice at the railway crossing of the road III / 04732 along the southern border of the railway plot No 2349 in the east, at the point of contact with no 2035 ku. Mankovice passes on its southern edge, and then continues again on the southern edge of the railway body No 2349 ku. Mankovice, 38 m before the intersecting road III / 04810, continues off the border of the parking lot along the south edge of the railway body of 46 m, and then on the south edge of the parks No 2379 ku. Mankovice, and at the south edge of the railway body. At the point of contact of lots No 2379 and 2403, the railway corridor of line No 270 intersects and along the south-east border of the railway plot No 2403 in K. It passes through the built-in territory of the municipality on the road III / 04734 (p. No 2281 / 1, and then at no 535 K. ú. Suchdol nad Odra), circling from the south of the plot No 2281 / 2 K. ú. Suchdol nad Odra and at the crossing point of the road, the railway line No 278 (p. 2072 / 1 K. Odra) turns to the southeast and copies the southern border of the line. After 240 m, plot No 2072 / 1 and 2782 k. oder. Suchdol nad Odrou crosses the railway line and along the northwest edge p. 2781, 2779, 2777 and 2776 k. ú. Suchdol nad Odra turns northeast. It follows the southeast edge of the road III / 04734 to the ČOV complex, from there it continues in the same direction about 40 m after the purpose of communication leading to the former building of the mill to the southern edge of the parcel No. 2000 / 54 in K. Suchdol nad Odrou. At the southeast edge of No. 2000 / 54 K. Suchdol nad Odrou turns northwest. It passes on the border of the demarcated stoppable areas of the existing industrial sites (the eastern edge of the plots No 2000 / 54 and 2722 / 2 ku. Suchdol nad Odra), at the point of the northern tip of p. 2722 / 2 ku. Suchdol nad Odra crosses the plot No 2702 ku. Suchdol nad Odra and further leads to the border of the groove plot No 2627 v. At the point of remeeting with the lot No. 2702 ku. Suchdol nad Odrou crosses it and continues along its southeast edge until the crossing of the border k. ú. Suchdol nad Odra and Lladká Životice, from this place continues along the railway line (p. 1348 / 6 k. Smooth Life) to the northeast. In the direction of the north-east, the runway is followed by a railway plot through the catalogues Lladky Živice (p. No 1348 / 1, 1348 / 2, 1356 / 2, 1356 / 1 k. ú. On the contact of railway lines No 270 and No 325, on the north-east tip of plot No 2206 in the w. Butovice, changing direction, diverting from the railway corridor No 270 and following the western boundary of the railway land (p. No 1191 / 19, 2184 / 5, 1191 / 18, 2184 / 8, 2184 / 9, 2184 / 10, 2184 / 11 and 2184 / 12 k. Pustejov) of line No 375. On the south end of the plot No. 2184 / 12 K. Pustějov turns to the north-east along the existing fenced area on the edge of the Studénky-Butovic (along the west and north edges of the plot No. 2166 / 2 K. Pustějov, the southern edge of the section No. 2168 / 1 K. Pustìjov, which is overloaded after 40 m, and then along the north-west edge of the plot No. 3055, the western edge of the lot No. 3161, 3159, 2986 K. ú. Butovice and the north-west edge of the page No. 3158 K. Butovice, through the north-west edge of the road No. 2165 / 7 K. Butovice) to the emblem II / 464. The road passes (the southeast edge of the road no. 2402 / 8 k. Butovice) and heads towards the edge of continuous construction along the western edge of the road no. 2983 k. Butovice. The construction subsequently passes from the south side, first along the north edge of the road No 2163 / 4, 2163 / 5, 2163 / 10 and 2163 / 9 and the east edge of the road No 2985 K. Butovice, then turns again towards the road II / 464 along its edge to the west edge of the road No 2162 / 2 K. Butovice, continues along the north edge of the road No 2162 / 2, crosses the road and the road No 2160 K. Butovice and continues along the west edge of the road No 2159 and 2154 / 2 K. Butovice. The plot is then intersected with the plot No 2154 / 3 and is directed towards the western point of point No 2981 k. ú. It bypasses isolated housing on the northern edge of the family houses No 2152 / 1, 2152 / 2 and 2152 / 3 K. Butovice and No 2028 / 1 K. Studének nad Odra. In the north-eastern tip of the plot No. 2028 / 1 in the K. Studenka nad Odrou turns to the south (on the west edge of the section No. 2030 and on the west edge of the section No. 1940 K. Studenka nad Odra) and after 200 meters turns again to the east. It leads along the southern edge of the embankment of road III / 46427 (p. No 2325, k. Studenka nad Odra), followed by the southern edge of the parcel no. 1897. At the point of crossing with the road, the border turns south on the eastern edge of p. 2035 / 2 and 2035 / 1 k. Studenek nad Odra, and then continues east along the left bank of the mill drive (on the north edge of p. 1969 / 29, 1969 / 24, 1969 / 5, 1969 / 1, 1969 / 37, 1969 / 40 and again 1969 / 1 k. Údelka nad Odrou) to the body of the former railway line (so-called old Štrambera line). This one passes across and along the eastern perimeter of plot 1962 / 1 in K. Studenka nad Odrou continues in the north direction towards the body of existing railway line 270. It continues 3.5 km northeast along the southeast border of the groove plot 2338 / 10 k. When crossing railway line No 270 with special purpose communication on the contact of plot No 2338 / 10 and 2137 / 8 in K. Studenka nad Odra turns northwest along this communication (along the north edge of p. 2137 / 8, 2138 / 25 and 2137 / 7 k. Studenka nad Odra). It is then separated from the purpose of the communication and followed by a draining ditch with a grown woody vegetation up to road III / 46427. The communication passes across and heads along the trench further northwest to the body of the highway estacada. Here passes Mr 2908 and 2921 k. ou. Great Albrechtice, continues along the southwest edge of Mr 2923 k. ou. Great Albrechtice and from the east, and then the north bypasses Parcel no 2929 in K. Great Albrechtice, subsequently follows the road III / 46419 and from the east avoids the property No. 2674 and 2675 in K. Great Albrechtice (the object of the sewage treatment plant). It passes through the fields along the west side of the plot 2681 and perpendicular to the water tower Jamník and meadow (p. 2067 k. ú. Bravantice) to the southern edge of the forest on the plot 2070 v k. u. Bravantice. On the southern border of this parcel and no. 2069 k. ú. Bravantice turns to the east and after 500 meters changes direction to the north. Along the western border of the plot No. 2071 in K. Bravantice is heading towards the village of Bravantice, it also turns on the northern edges of the plot No. 2071, 2064, 2065, 2061, 2060, 2059, 2058 and 2056. It is then turned south on the eastern edge of p. 2057 and 2056, the northern edge of n. 1691 / 8 and the western edge of n. 2041 k. ú. Bravantice) of 780 m. In the right-hand corner, the border is bent on agricultural land, leads to the northern border of plot 1387 / 1, passes to p. 1400 / 1 and the northeast border p. 1387 / 3 in k. It continues along the perimeter of the forest area of the northern edge of the plot No. 1430 in K. Bravantice, then 43 m leads along the plot No. 1401 / 1 k.ú. Bravantice to the north and then turns towards the boundary of the cadastral territory, represented by the water tower of the Dog Brook, the stream crosses and from the edge of the green turns towards the south through No. 1140 / 1, 1140 / 10 and 1140 / 9 k. Jistebnik to the edge of the green at No. 1345 k. It also leads along the northern border of plot 1345 in km. Here it turns to the northeast along the north edge of the plot no. 1344 / 2 in K. Jistebnik. At the fishing ground of the Střelný výšný pond, the border turns in the southeast direction, crosses the plot No 1344 / 2 in K. Jistebník and follows its southern edge towards the groove plot No 799 / 11 in K. Jistebník, which surpasses and continues in the northeast direction, with a length of 5,7 km, follows the southeast boundary of the groove plot No 799 / 11, 799 / 17 and 799 / 12 in K. Jistebnik and land No 3179 / 1 in K. Polanka nad Odrou. In contact with the purpose of communication between Polanka nad Odra and Pond Podhorník (plot No 644 / 4 in K. Polanka nad Odra), the border is bent in the north direction and the pond system of Polanecky ponds (ponds Palarňová and Pasttive) is circled from the west, along the north edge of p. 3077 / 1, south and west edge of p. 3079 and along the north edge of p. 541 k. Polanka nad Odra. Near the railway stop Polanka nad Odrou goes back to the groove body at No. 3179 / 1 in K. Polanka nad Odrou, along its southeast edge continues north, passes from East No. 3179 / 10 K. Polanka nad Odrou and continues further after No. 3108 / 18 in K. Svinov. Since the contact of the land no. 3108 / 18 with no. 2294 / 3 k. ú. Svinov leads the border further along the east bank of the watercourse (flow ID 10212487). At the point of the confluence it turns northwest, surpasses the water flow and along the west bank the water flow (flow ID 10210979) is directed on plot No 3108 / 18 in K. Svinov to the groove body. Along the south side of the pass exceeds the water flow and along the eastern edge of the road no. 3108 / 18 in K. Svinov then continues towards the north-east 1.3 km towards the estakade of highway D1. At the point of contact of plot No 3108 / 18 and 2467 / 20, it deviates from the groove plot, briefly leading parallel to the estacade towards the northeast. After 100 m it turns to the southeast and 1 km it is accompanied by an unpaved road on plot 2477 in km. It then turns again to the north, along the edge of the forest (east edge No 2474 / 1 and southeast edge No 2474 / 5 k. ú. Svinov) heading towards the foot of the road body I / 11. The border is further traced by the heel of the road body on the property No 3551 / 5 k. ú. Svinov in the southeast direction to the regulated river Odra trough. In contact with the parcel 3432 / 1 k. u. Svinov is turning south. On the west border of this parcel, it's heading upstream to the river bridge. In the direction further south it passes along the southern edge of the bridge on the right-hand side of the regulated section Odra and on the right-hand bank (along the south-easterly edge of the plot No. 1110 / 2 k. ú. Zábřeh nad Odra, at the blind shoulder point, at a section 40 m outside the partyline leads to the north edge of the section No. 933, 930, 896 / 1 and 896 / 2 k. Vyškovice u Ostrava and 3174 / 1 and 3174 / 18 k. Polanka nad Odra) leads to the road II / 478. At the crossing point of road II / 478 with water flow, the border is diverted to the southeast. It follows the southwest edge of the road embankment (plot No 461 k. ú. Polanka nad Odrou, 3853 / 1 and 3816 / 1, 3816 / 3 in K. Stará Belá) until the intersection with road III / 4787. In the built area of Old Belé, it turns southwest. Along the west edge of road III / 4787 passes the built-up territory of Proskovice and continues 2 km to the intersection with road III / 4804 in Staré Vsi nad Ondřednice. Subsequently it leads along the road III / 4804 in a northwest direction to Košatka nad Odrou to the intersection with road III / 4805. Following that border, along the north edge of the road III / 4805 the road to the village of Petřvald-Petřvaldík continues. In the central part of Petřvaldík, plot No 523 and 525 / 2 k. ú. Petřvaldík, dodging northwest direction. Following the northern border of the special purpose communication on the parcel no. 525 / 2 k.Petřvaldek passes through the built-up area and connects to the special purpose reinforced communication to Albrechtiček (p. No 525 / 1 k. Petřvaldík). At the point of contact with Mr No 498 / 5 K. Petřvaldek turns to the southeast and follows the edge of the forest in contact with the agricultural area. On reinforced communication between Petřvaldík and Albrechtiččtícky returns in 350 metres, in a place where communication leaves a continuous forest. Along the north-west edge of the road (plot No 424 / 3 k. Petřvaldík and No 539 / 1, p. 539 / 6, p. 539 / 7, p. 327 / 2, p. 539 / 11, p. 539 / 13, p. 539 / 14 k. Albrechtky) continues in the southwest direction. On the eastern edge of the continuous construction of the village of Albrechtek the border turns south and is connected to communication III / 46431 after 450 metres. In the southwest direction it leads along this road to the residential development of the Studenky-Nové Horky. On communication contacts III / 46431 and local communication on parcel No. 146 / 6 k. u. New Horka turns northwest. Local communication (p. No 146 / 6, 145 / 2 and 141 / 3 in K. Nová Horka) follows the border to the exit on Road II / 464. This road crosses and leads along the road III / 46428 8.2 km through the cadastral territory of Bartošovice and Hukovic to Kunín. At the edge of the built-up territory of the village of Kunín, in the contact of plots No 3263 and 1609 / 1 k. u. Kunín, the border bends north and the existing agricultural area of the Brno University of Veterinary and Pharmaceutical Sciences (along the eastern edge of plots No 1609 / 1, 1609 / 4, the northern edge of p. 1609 / 1 and the western edge of p. 1607 / 1, 1569 / 3, 1607 / 2, 1607 / 3, 1607 / 15 and 3273 / 1 k. Kunín). Before bridging the Jichinka stream, it is connected back to road III / 46428 and subsequently to road I / 57. From this point the border continues in the southern direction, leading 4 km along the road I / 57 built the territory of the village of Kunín and Šenov near Nová Jicin to the turn to the village of Bernartice nad Odrou. At the point of contact of roads I / 57 and III / 05715 turns northwest and continues along road III / 05715. After 2.2 km the direction changes to the southwest and passes through the built-up territory of Bernartic nad Odrou to the village Jeseník nad Odrou - Horka. On the edge of the village, the intersection of roads III / 05715 and III / 0489, the border turns northwest and leads along the road III / 0489 to the roundabout in the village Jeseník nad Odrou. In this place the border turns north and leads 1 km along the road III / 04810. On the edge of the built-up area (in contact with plots No 1179 / 3 and 1149 / 3 in K. Jeseník nad Odra) turns southwest, copies the edge of the installation (Agro Jesenicko a. s.) and heads towards railway line No 270 (along the southern edge of p. No 1149 / 3, 64 and 67 k.Jeseník nad Odrou). This cross-passes and along the northwest border of the groove plot No. 1176 / 1 in K. Jeseník nad Odrou continues southwest towards road III / 0489. Further the border continues along the road III / 0489 northwest until the intersection with road III / 04732 in the village of Vražny. The road III / 04732 and the eastern edge of the plots No 1657 and 1680 k. u Vražny u Oder follow the railway crossing at the railway stop Mankovice.

1. If the border of the protected landscape area is guided by communication, it is viewed as if it were situated outside the protected landscape area. A railway body is considered to be a communication body.

2. The description of the border according to the cadastral register corresponds to the situation in force on 1 January 2017.
