GOVERNMENT REGULATION
of 2 February 2009
amending Government Regulation No 147 / 2008 Coll., laying down the conditions for the grant of subsidies for the conservation of the forest-based economic population under the Natura 2000 measure in the forests
The Government hereby orders, pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., (hereinafter referred to as "the Act '), to implement § 2c (2) (b) of the Act and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Government Decree No. 147 / 2008 Coll., laying down the conditions for the grant of subsidies for the conservation of the forest-based economic population under the Natura 2000 measure in the forests, is amended as follows:
1. in Sections 2 (2) and (4), 6 (2), 7 (2), 7 (2) (d), 7 (4) and (5) and 9 (5), the word "area" shall be replaced by "area."
2. in § 3 (3) (a), § 7 (2) of the final part of the provision and § 9 (5), the word "area" shall be replaced by "area."
3. In Paragraph 3 (3), the comma at the end of point (g) is replaced by a dot and point (h) is deleted.
4. in Articles 3 (5), 7 (6), 8 (2) and 9 (1) and (2), the word "area" shall be replaced by "area."
5. in Article 4 (3) (a):
"(a) indicate in the application for subsidy the area of the selected crop group for which it applies for the grant, the data from the plan or outline, the clear identification6) of the selected ethos and, where appropriate, the indication of the recovery carried out;"
6. In Article 4, at the end of paragraph 3, the dot is replaced by a comma and the following point (d) is added:
"(d) in the event of a change in the type of crop type of economic ensemble chosen, within the limits of the list set out in Annex 1 to this Regulation, which is carried out with a view to maintaining or achieving a favourable state of the object of conservation in Natura 2000 areas, the Ministry of the Environment, issued under the Nature Conservation and Landscape Act, shall, together with a request for subsidy, submit an opinion to the Ministry of the Environment.";
7. In Article 5, the words "the grant shall be granted even if there is a change within the meaning of Article 4 (3) (d) 'shall be added at the end of the text in point (c).
8. In Article 5 (f), the words "or with notification pursuant to Article 7 (9) 'are inserted after the word" file'.
9. In Article 5, at the end of point (g), the dot is replaced by a comma and the following point (h) is added:
"(h) the applicant shall, throughout the commitment period, have a valid plan or outline for the selected crop group stored in digital form in a data warehouse.";
10.Paragraph 6 (3) reads as follows:
"(3) The Fund will grant a subsidy in the currency of the Czech Republic; the rate of subsidy referred to in paragraph 1 shall be recalculated according to the exchange rate published in the first Official Journal of the European Union, issued in the calendar year for which the payment is granted, which shall be as close to the date of the beginning of that calendar year. ';
11. In Article 7, at the end of the text of paragraph 2, the words "if the area is reduced within the period referred to in paragraph 4, the Fund shall grant a subsidy corresponding to the reduced area in subsequent years' shall be added.
12. in Article 7 (3):
"(3) If, during the relevant 20-year period, the applicant has reduced the area on the basis of factors other than those referred to in paragraph 2, the applicant shall amend the application for the grant for the relevant calendar year; The Fund shall grant a subsidy reduced by a proportion corresponding to a reduction in the area and shall decide at the same time to refund the subsidy granted to the area by which the original area was reduced. ';
13. in Article 7 (4), the words "by order of the application procedure" shall be replaced by the words "reject it."
14. in Paragraph 7 (4), the following sentence is inserted after the second sentence: "If an applicant submits an application for a reduction of the area allocated as a result of the facts referred to in paragraph 2, he may not at the same time change the initial application for grant for the calendar year concerned."
15. in Article 7 (6), the words "change of area" shall be replaced by "change of area" and the words "classified areas" shall be replaced by "inclusion."
16. in Article 7 (7), the word "Fund" shall be inserted after the word "applicant."
17. in Article 7 (8), the word "change" shall be replaced by "changes relating to a plan or outline."
18. In Article 7, the following paragraph 9 is added:
"(9) The applicant shall submit to the Fund a notification with a new description of the border marking of the selected grassland groups which are not clearly identifiable if their marking has changed. ';
19. in Article 9 (2), "(d) or (e)" shall be replaced by "(d), (e) or (h)";
20. in Article 9 (5), the words "paragraph 3" shall be replaced by "paragraph 4."
21. in Annex No 2 (II) (e) (1), "area" is replaced by "area."
22. In Annex No 2, point II (f), the word "Element 'is replaced by the words" Elected Element'.
Efficacy
This Regulation shall enter into force on 28 February 2009.
