GOVERNMENT REGULATION
of 21 February 2000
laying down measures and the State's share of the conditions for ensuring and maintaining the production of sugar and sugar and stabilising the sugar market
The Government orders the implementation of § 2 (1) of Act No. 252 / 1997 Coll., on Agriculture:
General provisions
§ 1
Subject matter
This Regulation regulates the State's participation in the creation of conditions for ensuring and maintaining sugar and sugar production and stabilising the sugar market in the Czech Republic.
§ 2
Definition of terms
For the purposes of this Regulation:
(a) the marketing year of the period beginning on 1 August 2000 and ending on 30 September 2001;
(b) sugar beet produced during the marketing year in the Czech Republic;
(c) sugar cane or beet sugar and chemically pure sucrose and other sugars, 1)
(d) domestic quota total volume of 380 000 tonnes of sugar produced from sugar beet in the Czech Republic for the purpose of putting into circulation in the Czech Republic,
(e) an export quota of 95 000 tonnes of sugar produced from sugar beet for export during the marketing year;
(f) the strategic sugar producer of the sugar producer, which has produced and marketed on average at least 10 000 tonnes of sugar per year in production facilities within the Czech Republic over the last 5 years,
(g) by an individual quota of the quantities of sugar produced from sugar beet in the Czech Republic for the marketing year determined by each of the strategic sugar producers in point 1 of Annex 1 to this Regulation, taking into account their share of the total production, export of sugar and the volume of sugar put into circulation in the Czech Republic in the last 5 years; the individual quota consists of two parts and consists of a share of the domestic quota and a share of the export quota,
(h) a specific individual quota of sugar produced from sugar beet for the wine year in the Czech Republic, fixed for the marketing year for non-strategic sugar producers for the purpose of putting sugar into circulation; the specific individual quota consists of two parts and consists of a share of the domestic quota and a share of the export quota.
Specific individual quota and financial reserve
§ 3
Specific individual quota
(1) A sugar manufacturer which is not a strategic sugar producer may, no later than 1 month after the date of entry into force of this Regulation, request the Ministry of Agriculture (hereinafter referred to as "the Ministry") to determine the volume of the specific individual quota (hereinafter referred to as "the application"); a specific individual quota may be fixed not more than the quantity specified in point 2 of Annex No 1 to this Regulation.
(2) The application shall contain the particulars set out in Annex No 2 and a declaration of honour, a specimen of which appears in Annex No 3 to this Regulation.
(3) Furthermore, the application must be accompanied by evidence certifying the quantity of sugar produced and marketed in the Czech Republic and the quantity of sugar produced and exported during the previous 5 calendar years.
(4) Applications of applicants whose sugar production has not reached a volume of at least 1 000 tonnes per calendar year in the previous 5 calendar years or applications containing data giving rise to doubts that could not be removed shall not be taken into account.
(5) The special individual quota shall be fixed by the Ministry in such a way that the sum of the specific individual quotas does not exceed the total quantity of sugar referred to in point 2 of Annex 1 to this Regulation.
(6) The Ministry shall fix the holder of the specific individual quota the volume of sugar so that, in total, the domestic part of the specific individual quota does not exceed the total volume of 19 000 tonnes of sugar and the export part of the specific individual quota does not exceed the total volume of 4 750 tonnes of sugar.
(7) Paragraph 4 applies mutatis mutandis.
§ 4
Financial reserve of the holder of an individual quota
(1) The holder of an individual quota will create a financial reserve of CZK 1,950 per tonne of sugar produced and use it in the marketing year to support exports of sugar under the export quota provided for him.
(2) Exports of sugar to the Slovak Republic shall not be considered as exports under paragraph 1.
§ 5
Minimum and maximum price
The minimum price of sugar, the minimum price of sugar and the maximum price of sugar shall be fixed and declared for the marketing year at the latest within 30 days of the entry into force of this Regulation, on a proposal from the Ministry of Finance in the Price Journal2.
Measures to ensure the production of sugar and sugar and to stabilise the sugar market
§ 6
(1) The State contributes to ensuring the production of sugar and sugar and to stabilising the sugar market by measures which it takes in conjunction with sugar growers and sugar producers, in particular by conducting market research, by establishing export possibilities for domestic sugar producers, by providing expert advice to sugar growers, strategic sugar producers and other sugar producers in the event of natural disasters or accidents, or by helping to ensure the purchase of fixed minimum sugar volumes (Section 8).
(2) The State's share of the measures to ensure the production of sugar and sugar and the stabilisation of the sugar market referred to in paragraph 1 shall be subject to compliance with the legislation and the production procedures, measures and conditions laid down by the sugar growers and sugar producers.
§ 7
Provision of expert advice, research into the sugar market and detection of export options
(1) The Ministry provides expert advice and information related to the production of sugar and sugar, and the information needed to ensure the stabilisation of the sugar market in the marketing year to sugar growers and sugar producers, in cooperation with other government authorities, carries out a survey of the sugar market and publishes it in the Ministry of Agriculture Bulletin.
(2) The Ministry, in cooperation with the Ministry of Foreign Affairs, monitors and evaluates the export possibilities of domestic sugar producers and publishes these findings monthly in the Ministry of Agriculture Bulletin.
§ 8
Assistance in ensuring the purchase of sugar
(1) The Ministry, in cooperation with the Administration of State tangible reserves, will provide assistance for the marketing year to ensure the purchase of sugar produced in the Czech Republic up to 10% of the relevant quota by strategic sugar producers and those sugar producers that have received a specific individual quota. The condition is that these producers are not able to ensure the placing on the market of the produced, quota-determined sugar volume in the Czech Republic or to ensure the export of sugar produced in the Czech Republic under the relevant quota, in particular in the event of unforeseen and unremovable barriers.
(2) The purchase by the Ministry of the agreed volume of sugar is made at a minimum price.
Final provisions
§ 9
Provision of information
Holders of individual quotas and special individual quotas shall provide the Ministry with data on the production, stocks, sale and export of sugar by the 10th day of the following calendar month for each calendar month.
§ 10
Quota overrun
Sugar produced in excess of an individual quota or special individual quota may not be marketed in the Czech Republic or in countries where imports of sugar from the Czech Republic are not allowed or are limited by an international treaty binding the Czech Republic. This restriction does not apply to exports of excess sugar from the Czech Republic to other countries.
§ 11
The State shall not apply to sugar growers or sugar producers who do not comply with the conditions laid down in this Regulation measures to ensure the production of sugar and sugar and to stabilise the sugar market (Sections 6 to 8).
§ 12
Efficacy
This Regulation shall enter into force on the day of its publication.
