on the method of financial settlement for land rent allocated by the Land Authority
The Government of the Czech Republic orders pursuant to § 19 paragraph 4 of Act No. 229 / 1991 Coll., on the modification of property relations with land and other agricultural property, as amended by Act No. 93 / 1992 Coll.:
(1) The owner of the land to which the Land Office shall, after the opening of the land adjustment proceedings under the special rule (1), grant up-to-date lease of land of other owners, is obliged to pay remuneration to those owners,
(a) the amount and time limits agreed between the Parties; or
(b) an annual amount equal to one percentage of the price of the land allocated to a time-limited lease, unless the agreement referred to in (a) is reached. The remuneration shall be calculated on a pro rata basis for the duration of a limited lease not equal to one year; until that time, the month in which the Land Authority's decision to allocate the land to a limited lease has acquired legal authority and the month in which the Land Authority's decision to approve the land modification has acquired legal authority. The remuneration shall be payable no later than the end of each calendar year and in the calendar year in which the Land Authority issues the land-use change approval decision, the remuneration shall be payable no later than 30 days after the date on which the decision becomes final.
(2) The price of land referred to in paragraph 1 (b) shall be the price determined pursuant to a special rule (2) at the date of the Land Authority's decision to allocate land to a limited lease.
This Regulation shall enter into force on the day of its publication.
