DECLARATION
Ministry of Industry and Trade
of 7 March 1997
implementing the Law on certain measures relating to the prohibition of chemical weapons
According to Article 35 (7) of Act No. 19 / 1997 Coll., on certain measures related to the prohibition of chemical weapons and on the amendment and amendment of Act No. 50 / 1976 Coll., on the zoning and construction rules (Construction Act), as amended, Act No. 455 / 1991 Coll., on the Commercial Enterprise (Trade Act), as amended, and Act No. 140 / 1961 Coll., Criminal Act, as amended, ("the Act '):
§ 1
Determined substances shall be included in individual lists in accordance with the breakdown provided for in Section 7 of the Act as follows:
(a) highly dangerous substances in List 1, as set out in Annex No 1;
(b) dangerous substances in list 2, as set out in Annex No 2;
(c) less dangerous substances in List 3, as listed in Annex 3.
§ 2
The treatment of highly hazardous substances as listed in List 1 in aggregate pursuant to Section 8 (2) of the Act for the purposes of Section 6 (1) of the Act may be carried out in the following establishments:
(a) in a single single-purpose low-tonnage facility, the reactors in production lines are not adapted for continuous operation, the volume of each reactor does not exceed 100 litres and the total volume of all reactors is not more than 500 litres;
(b) in a single object for protective purposes, the actual aggregate production in that object does not exceed 10 kg per year;
(c) in objects for research, medical or pharmaceutical purposes, the actual aggregate production of such objects is more than 100 g per year but does not exceed 10 kg per year per object;
(d) in laboratories for research, medical or pharmaceutical purposes, where the actual aggregate production does not exceed 100 g per year per laboratory;
(e) other objects for research purposes not producing highly hazardous substances.
§ 3
The obligation to declare pursuant to Paragraph 20 (1) of the Act shall apply to the following quantities of dangerous substances:
(a) more than 1 kg of dangerous substance identified (*) in list 2 of Part A;
(b) more than 100 kg of other dangerous substances listed in Part A of list 2;
(c) more than 1000 kg of dangerous substance listed in Part B 2.
§ 4
The register of specified substances shall be broken down in accordance with Annex 4 to this Decree.
§ 5
This Decree shall take effect on 1 April 1997.
