zur Durchführung des Gesetzes über bestimmte Maßnahmen zum Verbot chemischer Waffen
Gemäß Artikel 35 Absatz 7 des Gesetzes Nr. 19/1997 Slg. über bestimmte Maßnahmen im Zusammenhang mit dem Verbot chemischer Waffen und der Änderung und Änderung des Gesetzes Nr. 50/76 Slg., über die Straf- und Bauvorschriften (Baugesetz), geändert, Gesetz Nr. 455 / 1991 Slg., über das Handelsunternehmen (Handelsgesetz), geändert, und Gesetz Nr. 140 / 1961 Slg., Strafgesetz, geändert,
Bestimmte Stoffe werden in Einzellisten gemäß der in Abschnitt 7 des Gesetzes vorgesehenen Aufschlüsselung wie folgt aufgenommen:
(a) sehr gefährliche Stoffe in Liste 1, wie in Anhang Nr. 1 festgelegt;
b) gefährliche Stoffe in Liste 2 gemäß Anhang Nr. 2;
c) weniger gefährliche Stoffe in Liste 3 gemäß Anhang 3.
Die Behandlung von hochgefährdeten Stoffen, die gemäß § 8 Absatz 2 des Gesetzes im Sinne von § 6 Absatz 1 des Gesetzes in der Liste 1 aufgeführt sind, kann in folgenden Betrieben durchgeführt werden:
a) die Reaktoren in Produktionslinien nicht für den kontinuierlichen Betrieb angepasst sind, das Volumen jedes Reaktors 100 Liter nicht überschreitet und das Gesamtvolumen aller Reaktoren höchstens 500 Liter beträgt;
b) in einem einzigen Gegenstand für Schutzzwecke die tatsächliche Gesamtproduktion in diesem Gegenstand 10 kg pro Jahr nicht überschreitet;
c) in Objekten für Forschungs-, Medizin- oder Pharmazwecke beträgt die tatsächliche Gesamtproduktion solcher Objekte mehr als 100 g pro Jahr, jedoch nicht mehr als 10 kg pro Jahr pro Objekt;
d) in Laboratorien für Forschungs-, Medizin- oder Pharmazwecke, bei denen die tatsächliche Gesamtproduktion 100 g pro Jahr pro Labor nicht überschreitet;
e) andere Objekte für Forschungszwecke, die nicht hochgefährdete Stoffe erzeugen.
Die Verpflichtung zur Erklärung gemäß Absatz 20 Absatz 1 des Gesetzes gilt für folgende Mengen gefährlicher Stoffe:
a) mehr als 1 kg gefährlicher Stoff, der in der Liste 2 von Teil A aufgeführt ist;
b) mehr als 100 kg anderer gefährlicher Stoffe, die in Teil A der Liste 2 aufgeführt sind;
c) mehr als 1000 kg gefährlicher Stoffe gemäß Teil B 2.
Das Register der spezifizierten Stoffe wird gemäß Anhang 4 dieses Erlasses aufgegliedert.
Diese Verordnung tritt am 1. April 1997 in Kraft.
