GOVERNMENT REGULATION
of 2 February 1994
on the adjustment of compensation for loss of earnings after invalidity or invalidity
The Government hereby orders pursuant to Paragraph 447 (3) of the Civil Code:
(1) Compensation for loss of earnings after cessation of incapacity for work or invalidity (hereinafter referred to as "compensation for loss of earnings"), due to civil law, for which entitlement was acquired before 1 January 1993, shall be adjusted by increasing the average net earnings applicable to the calculation of the loss of earnings or, where appropriate, increased in accordance with the previous rules, by:
(a) 18,5% for the second half of 1991;
(b) 5% for the first half of 1992;
(c) 20% for the second half of 1992;
(d) 10% for the first half of 1993.
(2) If a claim for compensation for loss of earnings is made during the half-year, the average net profit for calculating the loss of earnings shall not be increased for that half-year.
(3) The adjustment provided for in paragraph 1 shall be made at the request of the injured party even where, after 31 December 1980, the compensation for loss of earnings was not in his place because the legislation on the amounts limiting the calculation and granting of such refunds did not allow it.
1. In Act No. 160 / 1993 Coll., amending and supplementing the Act of the Czech National Council No. 589 / 1992 Coll., on Social Security Insurance and Contribution to State Employment Policy, as amended by the Act of the Czech National Council No. 10 / 1993 Coll., and some other laws.
(2) The adjustment of the compensation for the loss of earnings provided for in Section 1 shall not take into account the increase in the invalidity or partial invalidity pension provided for in the social security rules.
Compensation for loss of earnings adjusted in accordance with § 1 shall be due from 1 January 1994.
This Regulation shall enter into force on the day of its publication.
