defining the activities carried out by the crew members of the vessel and setting out the details of the verification of the competence of persons to conduct vessels, their operation and other activities in inland navigation
According to Article 52 (1) of Act No. 114 / 1995 Coll., on Inland Navigation, as amended by Act No. 372 / 2022 Coll., ("the Act '), the Ministry of Transport provides for the implementation of § 24 (4), § 24e (6), § 24g (3), § 24h (9), § 24l (6), § 24o (5), § 24q (5), § 24q (4), § 24s (4), § 26f (5) and § 26i (6):
§ 1
Subject matter
This decree implements the relevant provisions of the European Union1) and provides for
(a) activities carried out by crew members of a vessel;
(b) the knowledge and skills which are the subject of the theoretical knowledge test and the practical skills test for the individual functions of the crew member of the vessel, the course of such tests and the method of their evaluation;
(c) the skills which are the subject of the examination of the practical skills needed to conduct a vessel operating by means of radar, the course of carrying out the test and the method of its assessment;
(d) knowledge and skills which are subject to examination of theoretical knowledge and practical skills for the individual functions of a crew member of a vessel or a leader of a vessel operating by means of a radar or vessel that provides for the movement of a pressurised assembly of vessels with a surface area of at least 7 000 m2, the course of such examination and the method of its evaluation;
(e) the skills which are the subject of the examination of the practical skills necessary for the performance of the passenger transport expert or the activities of the liquefied natural gas expert and their examination, the course of carrying out and such examination and the manner in which they are assessed;
(f) the knowledge which is the subject of the examination of the theoretical knowledge needed to operate the floating machine and its examination, the course of this examination and this examination and the method of their evaluation;
(g) knowledge which is the subject of an examination of the theoretical knowledge needed to lead a small vessel or a vessel in coastal sea waters, the course of such examination and the method of its evaluation;
(h) knowledge which is the subject of the examination of the theoretical knowledge necessary for the conduct of a small or recreational vessel, the conduct of that examination and the method of its evaluation;
(i) the skills which are the subject of the examination of the practical skills needed to conduct the small or recreational vessel, the course of the examination and the method of its evaluation, the content of the record of the course and the outcome of the test and the model of the certificate of its successful composition;
(j) skills which are the subject of an examination demonstrating competence to carry out the examination of the practical skills required for the conduct of a small or recreational vessel, the course of that examination and the method of its evaluation;
(k) theoretical knowledge and practical skills, the acquisition of which must be ensured by training intended for a crew member or for the pursuit of the activities of a passenger transport expert, and the manner and course of such training;
(l) a detailed breakdown of the data to be included in the plan for the provision of training for a crew member of a vessel or for the performance of the activities of a passenger transport expert;
(m) the knowledge and skills which are the subject of an examination demonstrating the competence to carry out training for a crew member of a vessel or to carry out the activities of a passenger transport expert and to carry out the final examination, the conduct of that examination and the manner in which it is assessed;
(n) the extent of the financial capacity necessary for carrying out training for a crew member of a vessel or for carrying out the activities of a passenger transport expert;
(o) the conditions of technical competence of the simulator, the procedure for carrying out the technical examination of the simulator and its scope and details of the protocol on the result of the technical examination of the simulator;
(p) the composition of the expert committee set up to carry out the technical examination of the simulator and the manner in which it is carried out;
(q) the conditions for appointment by the test Commissioner for conducting the tests and examinations referred to in points (b) to (j) and (m);
(r) technical parameters and equipment of the vessel which enable:
1. verification and checking of the practical skills of the master of the vessel;
2. verification of the practical skills required to conduct a radar-powered vessel;
3. the conduct of training intended for a crew member of a vessel or for the performance of a passenger transport expert;
4. verification of competence to conduct training for a crew member of a vessel or to perform the activities of a passenger transport expert and final examinations;
5. verification of the practical skills needed to conduct a small or recreational vessel;
6. verification of competence to perform the examination of the practical skills required to conduct a small or recreational vessel;
(s) the organisation and fitting of premises enabling the verification and checking of the practical skills necessary for the performance of the passenger transport expert and of the liquefied natural gas expert; and
(t) the model of the licence of the crew member, the service books, the driver's licence, the small-vessel leader licence and the international recreational vessel leader licence.
§ 2
Activities carried out by vessel crew members
(Paragraph 24 (4) of the Law)
(1) The master of the vessel shall carry out on board activities consisting of the management of the vessel in the course of its waterway movement, in particular:
(a) issuing orders to crew members of the vessel in their activities;
(b) the planning, management and safe manoeuvring of the vessel, including addressing emergency situations in accordance with the rules on navigation and the rules on the transport of dangerous goods;
(c) ensuring the safe transport of passengers, including assistance to disabled persons and the loading of material with regard to the stability of the vessel;
(d) inspection of safe operation and maintenance of machinery, electrical and electronic equipment on board;
(e) ensuring the organisation of training on board, communication with crew and passengers; and
(f) ensuring safety and health, passenger rights and environmental protection.
(2) The helmsman carries out on board activities consisting of the operation of steering and radio equipment.
(3) A qualified seaman shall carry out on board activities consisting of:
(a) operating machinery, except work equipment on a floating machine;
(b) operating the helm under the supervision of the master of the vessel;
(c) ensuring the operation of electrical and electronic equipment, including repair;
(d) the provision of operational maintenance of the drive set; and
(e) the control of the steering gear and signalling system.
(4) The shipowner shall carry on board on board operations relating in particular to the operation of on-board equipment and of the vessel's anchorage mechanisms, including the operation of the rudder under the supervision of the skipper.
(5) The seafarer and auxiliary seafarer carry on board activities consisting mainly of the carriage of persons and goods, the loading and unloading of goods, the cleaning and washing of vessels and the maintenance of on-board machinery and equipment on board.
(6) The engineer carries out on board activities consisting of the operation of work equipment on a floating machine, checking the operation of the floating machine and of the work equipment on it and keeping records of the operation, operation and performance of the activity and the repair of the floating machine and of the work equipment on it; the operation of a floating machine is not the guidance of a floating machine when moving on a waterway that is not related to the performance of its work.
§ 3
Theoretical knowledge test and practical skills test, the successful composition of which is a condition for granting full authorisation to perform the duties of a crew member of a vessel
(Paragraph 24e (6) of the Law)
(1) Knowledge and skills which are the subject of a theoretical knowledge test and a practical skill test for the individual functions of a crew member of a vessel whose successful composition is a condition for granting full authorisation to perform the duties of a crew member of a vessel are set out in Annex 1 to this Regulation.
(2) The examination of theoretical knowledge, the successful composition of which is a condition for granting full authorisation to act as leader of the vessel, shall consist of an examination and an oral examination. For the processing of the test, applicants for the examination (hereinafter referred to as "candidates') shall have 55 minutes. The test contains 50 test questions compiled by random selection from a set of total 889 test questions containing 3 responses, one of which is correct. Questions shall include all thematic fields of knowledge listed in Part I of Annex 1 to this Decree; it is necessary for the successful passing of the test that the candidate correctly answers at least 40 questions. The oral examination shall consist of 4 questions on 20 test sheets selected from the thematic areas of knowledge listed in Part I of Annex 1 to this Decree. The choice of a specific test sheet will be made by random selection. In order to pass the test successfully, it is essential that the candidate correctly answers all 4 questions on the test list.
(3) The theoretical knowledge test, the successful composition of which is a condition for granting full authorisation to perform the duties of helmsman and seafarer, shall be composed of a test for which the candidate has 45 minutes to process. The test contains 40 test questions compiled by random selection from a set of a total of 190 test questions containing 3 response options, one of which is correct. The questions shall include all thematic fields of knowledge listed in Part II of Annex 1 to this Decree. In order to pass the test successfully, it is necessary that the candidate correctly answers at least 32 questions.
(4) The examination of practical skills, the successful composition of which is a condition for granting full authorisation for the performance of the skipper's duties, consists of verification of the ability to plan and carry out a voyage. If the interested party has failed to pass a theoretical knowledge test, the successful composition of which is a condition for granting full authorisation to perform the duties of helmsman and seafarer, or has failed to receive training for a crew member at operational level, the examination of the practical skills shall also include the verification of the ability to supervise the navigation, operation of the vessel, handling of the cargo and its provision and transport of persons, machinery and electronics, maintenance and repair of the vessel and its equipment, communication with persons on board and safety and health and the environment.
(5) The part of the practical skill test, the successful composition of which is a condition for granting full authorisation for the performance of the skipper's function, relating to the planning of a voyage, consists of a verification of skills within the scope of the themes listed in categories I and II set out in Part I of Annex 2 to this Decree. The test shall verify the skills in 10 topics from each category, compiled by random selection. The candidate can reach a maximum of 10 points in each topic. In order to pass the test successfully, it is necessary for the candidate to reach at least 7 points for category I on each topic tested and for category II at least a total of 60 points.
(6) The part of the practical skill test, the successful composition of which is a condition for the granting of full authorisation for the performance of the skipper's duties, relating to the conduct of a voyage, consists of a verification of skills within the scope of the subjects set out in Part II of Annex 2 to this Decree. The test shall verify the skills in all subjects. The candidate can reach a maximum of 10 points in each topic. In order to pass the test successfully, it is necessary that the candidate reaches at least 7 points on each topic tested.
(7) The part of the practical skill test, the successful composition of which is a condition for granting full authorisation to act as a leader of a vessel, relating to the capability referred to in the second sentence of paragraph 4, shall consist of a verification of skills within the scope of the subjects listed in categories I and II set out in Part III of Annex 2 to this Regulation. The test shall verify the skills in 20 Category I themes and 8 Category II themes compiled by random selection. The candidate can reach a maximum of 10 points in each topic. In order to pass the test successfully, it is necessary for the candidate to reach at least 7 points for category I on each topic tested and for category II at least a total of 40 points.
§ 4
Theoretical knowledge test and practical skills test, the successful composition of which is a condition for granting a restricted authorisation to perform the duties of a crew member
(Paragraph 24e (6) of the Law)
(1) Knowledge and skills which are the subject of a theoretical knowledge test and a practical skill test for the individual functions of a crew member of a vessel whose successful composition is a condition for granting a restricted authorisation to perform the duties of a crew member of a vessel are set out in Annex 3 to this Regulation.
(2) The test of theoretical knowledge, the successful composition of which is a condition for granting a restricted authorisation for the performance of the skipper of a vessel, shall be composed of a test and an oral test. The participants have 45 minutes to process the test. The test contains 40 test questions compiled by random selection from a set of total 735 test questions containing 3 response options, one of which is correct. Questions shall include all thematic fields of knowledge listed in Part I of Annex 3 to this Decree. In order to pass the test successfully, it is necessary that the candidate correctly answers at least 32 questions. The oral examination shall consist of three questions selected from the thematic areas of knowledge listed in Part I of Annex 3 to this Decree; it is necessary for the successful passing of the test that the candidates respond correctly to all 3 questions.
(3) The examination of theoretical knowledge, the successful composition of which is a condition for granting a restricted authorisation to perform the duties of a seafarer, shall consist of a test for which the interested party has 35 minutes. The test contains 30 test questions compiled by random selection from a set of total 148 test questions containing 3 responses, one of which is correct. Questions shall include all thematic fields of knowledge listed in Part II of Annex 3 to this Decree. It is necessary for the successful passing of the test that the candidates correctly answer at least 24 questions.
(4) The test of practical skills, the successful composition of which is a condition for the granting of a restricted authorisation for the performance of a master of a vessel other than a vessel without its own machinery or with its own engine power up to 4 kW, shall consist of a verification of skills in the range of 10 topics included in the thematic headings of navigation and regulations, navigation instruction and crew work listed in Part I of Annex 3 to this Regulation. The test shall verify the skills in all the thematic circuits mentioned. Compliance with each topic is evaluated by 1 point. It is necessary for a successful test to reach at least 8 out of 10 points.
(5) The test of practical skills, the successful composition of which is a condition for the granting of a restricted authorisation for the performance of a leader of a vessel without own machinery or with a power of up to 4 kW, shall consist of a verification of skills in the range of 13 topics included in the thematic headings of navigation and regulations, the navigational instruction and the design of vessels listed in Part I of Annex 3 to this Regulation. The test shall verify the skills in all the thematic circuits mentioned. Compliance with each topic is evaluated by 1 point. It is necessary for a successful test to reach at least 10 out of 13 points.
§ 5
Test of practical skills, the successful composition of which is a condition for the specific authorisation to conduct a vessel operating by radar
(K § 24h (9) of the Law)
(1) The skills which are the subject of a practical skill test, the successful composition of which is a condition for the granting of a special authorisation for the performance of the leader of a radar-powered vessel, are set out in Annex 4 to this Regulation.
(2) The test of practical skills, the successful composition of which is a condition for granting a special authorisation for the performance of the leader of a radar-based vessel, shall consist of a verification of skills within the scope of the themes listed in categories I and II set out in Annex 5 to this Regulation. The test shall verify the skills in each of the 16 category I themes and at least one of the random category II themes. The candidate can reach a maximum of 10 points in each topic. In order to pass the test successfully, it is necessary that the candidate reaches at least 7 points on each topic tested.
§ 6
Review of the theoretical knowledge and practical skills of the holder of a European Union certificate of qualification of a crew member of a vessel or a ship crew licence
(Paragraph 24l (6) of the Law)
(1) Article 4
(2) For the knowledge and skills which are subject to examination of the theoretical knowledge and practical skills of the certificate holder of the crew member of the vessel, for the conduct of that examination and its assessment, Section 4 shall apply mutatis mutandis.
(3) For the skills which are subject to examination of the practical skills of the holder of the European Union certificate of qualification as a leader of a radar-based vessel or a master licence of a radar-powered vessel, for the conduct of that examination and its assessment, Article 5 shall apply mutatis mutandis.
(4) For knowledge subject to examination of the theoretical knowledge of the holder
(a) the European Union certificate of qualification as a master of a vessel which ensures the movement of a pressurised assembly of vessels with a surface area of at least 7 000 m2, for the conduct of this examination and its assessment shall apply mutatis mutandis,
(b) a master's licence which ensures the movement of a pressurised assembly of vessels with a surface area of at least 7 000 m2, for the conduct of this examination and its assessment shall apply mutatis mutandis to the provisions of Article 4 (1) to (3).
§ 7
Test of the practical skills needed to perform the passenger transport expert's activities and check them
(K § 24o (5) and § 24s (6) of the Act)
(1) The skills which are the subject of the examination of the practical skills required for the performance of the passenger transport expert are set out in Annex 6 to this Decree.
(2) The examination of the practical skills needed to carry out the activities of the passenger transport expert shall consist of verification of the skills within the scope of the subjects listed in categories I, II and III set out in Annex 7 to this Decree. The test shall verify the skills in 9 out of 12 topics compiled by random selection from Category I, 7 out of 8 topics compiled by random selection from Category II and from both Category III themes. The candidate can reach a maximum of 10 points in each topic. In order to pass the test successfully, it is necessary for the candidate to reach at least 7 points in each of the subjects tested in categories I and III, together with a minimum total of 45 points in category II.
(3) Paragraphs 1 and 2 shall apply mutatis mutandis to the skills which are subject to the examination of the practical skills needed to carry out the work of the passenger transport expert and to the conduct of that examination and its evaluation.
§ 8
Testing and checking of the practical skills needed to perform the activities of the liquefied natural gas expert
(K § 24q (5) and § 24s (6) of the Act)
(1) The skills which are the subject of an examination of the practical skills needed to perform the activities of the liquefied natural gas expert are set out in Annex 8 to this Decree.
(2) The examination of the practical skills needed to perform the activities of the liquefied natural gas expert shall consist of verification of skills within the scope of the themes listed in categories I and II set out in Annex 9 to this Decree. The test shall verify the skills in 9 out of 11 topics compiled by random selection from Category I and 5 out of 7 topics compiled by random selection from Category II. The candidate can reach a maximum of 10 points in each topic. In order to pass the test successfully, it is necessary for the candidate to reach at least 7 points in each topic tested in Category I and at the same time a minimum total of 30 points in Category II.
(3) Paragraphs 1 and 2 shall apply mutatis mutandis for the skills which are subject to the examination of the practical skills needed to perform the activities of the liquefied natural gas expert and for the conduct of that examination and its evaluation.
§ 9
Test of theoretical knowledge needed to operate the floating machine and their testing
(§ 24u (6) and § 24x (6) of the Act)
(1) The knowledge which is the subject of an examination of the theoretical knowledge needed to operate a floating machine is set out in Annex 10 to this Decree.
(2) The test of theoretical knowledge needed to operate a floating machine is made up of computing by means of a test. The participants have 50 minutes to process the test. The test contains 40 test questions compiled by random selection from a set of a total of 177 test questions containing 3 response options, one of which is correct. The questions shall include all thematic areas of knowledge listed in Annex 10 to this Decree; it is necessary for the successful passing of the test that the candidates correctly answer at least 32 questions.
(3) Paragraphs 1 and 2 shall apply mutatis mutandis to the knowledge which is subject to the examination of the theoretical knowledge needed to operate the floating machine and to the conduct of that examination and its evaluation.
§ 10
Test of theoretical knowledge required to conduct a small vessel or a vessel in coastal sea waters, test of practical skills required to conduct a small or recreational vessel and examination of theoretical knowledge required to conduct a small or recreational vessel
(Articles 26d (4), 26e (4) and 26i (6) of the law)
(1) Knowledge which is the subject of an examination of the theoretical knowledge required to lead a small vessel or a vessel in coastal sea waters and the skills which are the subject of an examination of the practical skills required to conduct a small or recreational vessel are set out in Annex 11 to this Regulation.
(2) Knowledge which is the subject of examination of the theoretical knowledge needed to conduct a small or recreational vessel is set out in Annex 11 to this Decree.
(3) The test of theoretical knowledge needed to lead a small vessel which is not a sail vessel is composed of computer techniques in the form of a test. The participants have 30 minutes to process the test. The test contains 35 test questions compiled by random selection from a set of a total of 411 test questions containing 3 response options, one of which is correct. The questions shall include all thematic fields of knowledge listed in Annex 11 to this Decree. It is essential for the successful passing of the test that the candidate correctly answers at least 30 questions.
(4) The test of theoretical knowledge needed to lead a small sail vessel shall be composed of computer techniques by means of a test. He has 10 minutes to process the test. The test contains 14 test questions compiled by random selection from a set of a total of 170 test questions containing 3 response options, one of which is correct. The questions shall include all thematic fields of knowledge listed in Annex 11 to this Decree. It is essential for the successful passing of the test that the candidate correctly answers at least 11 questions.
(5) The test shall consist of the theoretical knowledge needed to guide the vessel in coastal marine waters by means of a computer test. The participants have 25 minutes to process the test. The test contains 28 test questions compiled by random selection from a set of a total of 215 test questions containing 3 responses, one of which is correct. The questions shall include all thematic fields of knowledge listed in Annex 11 to this Decree. It is necessary for the successful passing of the test that the candidates correctly answer at least 24 questions.
(6) The test shall consist of the practical skills required to conduct a small vessel or recreational craft by means of a skill verification to the extent of all thematic headings and topics set out in Annex 11 to this Regulation. For demonstrating skills in each topic, the candidate shall receive 1 point. The applicant may reach a maximum of 14 points if it is about proving the skills needed to lead a small vessel without its own machinery or with its own machinery without its own power limitation, 16 points if it is about proving the skills needed to lead a small vessel with a sail without any limit on the total sail area, or 17 points if it is about proving the skills needed to lead a recreational vessel other than a small one. In order to pass the test successfully, it is necessary that the candidate obtain at least:
(a) 13 points if it is to verify the practical skills needed to lead a small vessel without its own machinery or with its own engine power without a power limitation;
(b) 15 points if it is to verify the practical skills needed to lead a small sail vessel without limiting the overall sail area; or
(c) 16 points when it comes to verifying the practical skills needed to conduct a non-small recreational vessel.
§ 11
Content of the record of the course and result of the examination of the practical skills needed to conduct a small vessel or recreational craft and a model certificate of its successful composition
(Paragraph 26e (4) of the Law)
(1) The record of the course and result of the examination of the practical skills needed for the management of a small vessel or recreational craft shall include:
(a) details of the person responsible for carrying out the test:
1. the name and, where applicable, the names and surnames, the address of the place of residence and the date of birth, in the case of a natural person; or
2. the trading firm, the name or the name or, where applicable, the names and surnames, the address of the registered office and the identification number of the person, if assigned to the owner, in the case of a legal or commercial natural person,
(b) the name and, where applicable, the names and surname and date of birth of the candidate;
(c) the scope of the authorisation to conduct the small or recreational vessel which he has requested to be awarded;
(d) a list of the skills that have been verified during the test and an indication of whether the candidate controls them;
(e) an indication of whether the candidate has succeeded or failed in the examination;
(f) the place and date of the examination; and
(g) the signature of the natural person responsible for carrying out the examination or, if applicable, the legal person's representative.
(2) The model certificate of successful completion of the examination of the practical skills required to conduct a small vessel or recreational craft is set out in Annex 12 to this Decree.
§ 12
Test to demonstrate competence to perform the test of practical skills required to conduct a small or recreational vessel
(K § 26f (5) of the Act)
(1) The skills which are the subject of an examination demonstrating competence to carry out the examination of the practical skills needed to conduct a small or recreational vessel are set out in Annex 13 to this decree.
(2) The examination demonstrating competence to carry out the examination of the practical skills required for the conduct of a small or recreational vessel shall consist of a verification of skills to the extent of all thematic headings and topics set out in Annex 13 to this Regulation. For demonstrating skills in each topic, the candidate shall receive 1 point. The applicant may reach a maximum of 14 points if it is a demonstration of competence to perform the examination of the practical skills needed to conduct a small vessel without self-propelled or self-propelled, 16 points if it is a demonstration of competence to perform the examination of the practical skills needed to conduct a small craft with a sail without the limitation of the overall area of the sail, or 17 points if it is a demonstration of competence to perform the examination of the practical skills needed to conduct a recreational vessel other than a small one. It is necessary for a successful examination to give the candidate a maximum number of points.
§ 13
Knowledge and skills the acquisition of which must be ensured by training intended for a crew member of a vessel or for the pursuit of the activities of a passenger transport expert and the manner and course of such training
(Paragraph 25 (9) of the Law)
(1) Knowledge and skills the acquisition of which must be ensured by training for the skipper are set out in Part I of Annex No 1 to this Order.
(2) Knowledge and skills the acquisition of which must be ensured by training for the helmsman, the qualified seaman and the seafarer are set out in Part II of Annex 1 thereto.
(3) The skills the acquisition of which must be ensured by training to carry out the activities of a passenger transport expert are set out in Annex 6 to this Decree.
(4) Training may be carried out either in a preset or distance manner.
(5) The training course shall be in accordance with the training plan.
§ 14
Detailed breakdown of the data to be included in the plan to provide training for a crew member of a vessel or to carry out the activities of a passenger transport expert
(Paragraph 25 (9) of the Law)
(1) The plan to provide training for a crew member or for the performance of a passenger transport expert shall be established with a view to achieving the required knowledge and skills for the individual functions of a crew member or for the performance of the passenger transport expert.
(2) The plan shall include:
(a) the business name, name or name, names and surnames, address of the registered office and, if assigned, the identification number of the person responsible for conducting the training;
(b) the definition of the expertise and skills to be acquired by the trainee, including the number of hours devoted to obtaining them;
(c) duration of training;
(d) identification of the minimum and maximum number of persons involved in the training;
(e) criteria for assessing successful completion of teaching and training;
(f) the course of training and the manner in which the record is kept, showing the course of training;
(g) a model for the final assessment of the persons involved in the training;
(h) definition of teaching materials, aids and other equipment used to carry out training;
(i) the type of training to be carried out; and
(j) a forecast estimate of the costs of carrying out the training.
§ 15
Test demonstrating competence to conduct training for a crew member of a vessel or to carry out the activities of a passenger transport expert and to carry out the final test, the conduct of that test and its assessment method
(K § 25a (5) of the Act)
(1) The knowledge and skills which are the subject of an examination demonstrating the competence to carry out training for a crew member or to carry out the activities of a passenger transport expert and to carry out the final examination are set out in Annexes 1 and 6 to this Regulation.
(2) The theoretical knowledge test, which is demonstrated by the competence to conduct training for a crew member and to carry out the final test, shall be carried out in the form of an oral examination consisting of 10 questions selected from the thematic areas of knowledge listed in Annex 1 to this Regulation. For a successful examination, it is essential that the candidates respond correctly to all 10 questions.
(3) A practical skill test demonstrating competence to conduct training for a crew member of a vessel and to carry out a final test shall be carried out in the form of a skill verification within the scope of the subjects set out in Annex 2 to this Regulation. The test shall verify the skills in 10 topics. The candidate can reach a maximum of 10 points in each topic. In order to pass the test successfully, it is necessary that the candidate reaches at least 7 points on each topic tested.
(4) Paragraph 7 (1) and (2) shall apply mutatis mutandis for a practical skill test demonstrating the competence to conduct training for the performance of the passenger transport professional and for the conduct of the final examination.
§ 16
Financial capacity necessary for carrying out training for a crew member of a vessel or for carrying out the activities of a passenger transport expert
(Paragraph 25 (9) of the Law)
The person requesting a mandate to conduct training for a crew member or for the performance of a passenger transport expert must have a financial amount corresponding to a forecast estimate of the training costs specified in the training plan, but not less than CZK 100,000.
§ 17
Conditions of technical competence of the simulator, procedure for carrying out the technical examination of the simulator and its scope and details of the protocol on the result of the technical examination of the simulator
(K § 25b (7) of the Act)
(1) The conditions of technical competence of the simulator and the procedure for carrying out the technical inspection of the simulator and its scope are set out in Annex 14 to this Decree.
(2) The protocol on the result of the technical examination of the simulator contains:
(a) details of the applicant for the approval of the technical competence of the simulator,
1. the name and, where applicable, the names and surnames, the address of the place of residence and the date of birth, in the case of a natural person; or
2. the trading firm, the name or the name or, where applicable, the names and surnames, the address of the registered office and the identification number of the person, if assigned to the owner, in the case of a legal or commercial natural person,
(b) the date of application for approval of the technical competence of the simulator;
(c) the date and time of the technical inspection of the simulator;
(d) the composition of the expert panel conducting the technical examination of the simulator;
(e) an indication of whether the technical competence of the simulator has been requested to verify the practical skills of the master of the vessel or the practical skills required to conduct a vessel flying by radar;
(f) a record of the outcome of the check on compliance with the requirements laid down for each item listed in Annex 14 to this Regulation; and
(g) a conclusion on whether or not the simulator is technically competent.
§ 18
Composition of the expert committee set up to carry out the technical examination of the simulator and the manner of its action
(K § 25b (7) of the Act)
(1) The expert committee set up to carry out the technical examination of the simulator is three members. Its members shall be appointed from among experts in the field of vessel technology and navigation, of which at least 1 shall be a staff member.
(2) The expert committee set up to carry out the technical examination of the simulator is quorum in the presence of all its members and adopts its resolutions by a majority of votes, with the exception of a resolution on whether or not the simulator is technically competent, which must be adopted unanimously. No member of the expert committee set up to carry out the technical examination of the simulator shall be entitled to abstain.
§ 19
Conditions for appointment by the test Commissioner for conducting tests and checking
(Articles 24e (6), 24h (9), 24l (6), 24o (5), 24q (5), 24s (6), 24u (6), 24x (6), 26d (4) and 26f (5) of the Law)
(1) The examination Commissioner for the theoretical knowledge test and the examination of the practical skills of a crew member of a vessel whose successful composition is a condition for granting full authorisation to perform the duties of a crew member of a vessel and for checking the theoretical knowledge and practical skills of the holder of the European Union certificate of qualification of a crew member of a vessel may be appointed only by a natural person who:
(a) has reached the age of 30;
(b) have completed at least a secondary education with a graduate examination; and
(c) hold a valid European Union certificate of qualification as the master of the vessel.
(2) A pilot-in-command for a theoretical knowledge test and a pilot-in-command of the practical skills of a crew member of a vessel whose successful composition is a condition for granting a restricted authorisation to perform the duties of a crew member of a vessel and for checking the theoretical knowledge and practical skills of the certificate holder of a crew member may be appointed only by a natural person who:
(a) has reached the age of 30;
