DECLARATION
of 20 March 2014
amending Decree No. 428 / 2001 Coll., implementing Act No. 274 / 2001 Coll., on water and sewage for public use and amending certain laws (Water and Sewerage Act), as amended
The Ministry of Agriculture provides pursuant to § 40 of Act No. 274 / 2001 Coll., on water and sewage for public use and on the amendment of certain laws (Water and Sewerage Act), as amended by Act No. 76 / 2006 Coll. and Act No. 275 / 2013 Coll.:
Decree No. 428 / 2001 Coll., implementing Act No. 274 / 2001 Coll., on Water and Sewerage for Public Use and amending certain laws (Water and Sewerage Act), as amended by Decree No. 146 / 2004 Coll., Decree No. 515 / 2006 Coll. and Decree No. 120 / 2011 Coll., is amended as follows:
1. the words "and technological" shall be inserted after the word "building."
2. In Article 1 (f), the word "sewerage 'is inserted after the word" supply'.
3. in Article 1, the following points (i) to (l) are inserted after point (h):
"(i) water taken from the water supply lines drinking water taken by one water supply line operator from another water supply line operator;
(j) the water taken over by sewage treatment plants from one sewage operator to another;
(k) drinking water delivered by one water duct operator to another water duct operator with the exception of water before treatment or hygiene;
(l) water supplied by a sewage operator to another sewage operator by sewage sewers, ';
Points (i) and (j) shall be renumbered as points (m) and (n).
4. In the heading of Part Two, the words "AND TRANSLATION 'shall be inserted after the word" PROCESSING' and the words "paragraph 8 'shall be replaced by" paragraph 9'.
5. Article 2 shall be deleted;
(6) Sections 3 and 4, including footnote 1, read:
(1) The development plan for water ducts and sewerage of the region (hereinafter referred to as the "development plan") is to the following extent:
(a) an assessment of the current state of supply system for drinking water, sewerage and treatment of municipal waste water or parts of the municipality (1) on the territory of the region or part thereof, which is determined in relation to water supply systems, sewerage and sewage treatment systems;
(b) a balance of the need for drinking water, sewerage and sewage treatment, broken down into all municipalities or parts thereof in the territory of the region;
(c) the definition of the surface water and groundwater resources planned for the treatment of drinking water;
(d) a plan for the technically and economically optimal expansion and restoration of drinking water supply systems, sewerage and treatment of municipal waste water or parts thereof in the area concerned;
(e) the supply plan for drinking water when the emergency situation is declared under Article 21 of the Act;
(f) the economic part with a calculation of the costs of implementing the plans referred to in (d) and (e);
(g) a timetable for the implementation of the plans referred to in (d) and (e) expressing the urgency of the solution.
(2) The plan for the development of water ducts and the sewerage of the region is updated in the current state section and in the proposal for a change to the development solution to the following extent:
(a) the part of the development plan which affects it and its administrative parts shall be updated for the design of the municipality to the extent specified in paragraph 1;
(b) for proposals involving water supply systems and sewerage systems common to several municipalities in the territory of the region, the part of the development plan affecting them shall be updated to the extent specified in paragraph 1.
(1) The development plan and its ongoing update shall be processed in electronic form following the geographical information system.
(2) The Regional Authority shall forward to the Ministry of Agriculture (hereinafter referred to as the Ministry), pursuant to Article 4 (8) of the Act, updates of the development plan to the following extent:
(a) a list of regional councils approved by updating the development plan, including the number and date of the relevant county councils' resolutions;
(b) updated descriptions of water supply systems and sewerage of individual municipalities or parts thereof included in approved updates to the full extent of the original and, where appropriate, previous descriptions; the adjustments and formats for updated descriptions are set out in Annex 21,
(c) individual updated descriptions of water supply systems and sewerage of municipalities or parts thereof, in which the current state of supply of drinking water, waste water collection and treatment has been supplemented without the need to discuss them in accordance with Article 4 (5) of the Act, to the full extent of the original or, where appropriate, previous descriptions; the adjustments and formats for updated descriptions are set out in Annex 21,
(d) the table for updated descriptions referred to in points (b) and (c) containing demographic, balance sheet, technical and economic data; a file in MDB format can be created in an electronic application provided by the Ministry for Development Planning Processing; the file structure is set out in Annex No 21,
(e) the map part of the development plan containing updated drawings of the water supply systems and sewerage following the geographical information system, including all the underlying maps in the formats in which that part of the development plan has already been processed when it is acquired; the updated map part of the regional development plan will be transmitted to the Ministry in accordance with Article 4 (8) of the Act or sent to the Ministry of Communication, where the Regional Office is published and made available.
(3) The municipalities submit to the Regional Office, in electronic form, a proposal for updating the development plan in the same formats and content as set out in paragraphs 2 (b), (c), (d) and (e) of Article 4 (4) of the Act.

7. In Article 5, "paragraph 3 'is replaced by" paragraph 4';
8. Paragraph 6 (1) reads as follows:
"(1) The content of the collected data transmitted is listed in Annexes 1 to 4 and the structure of the database file is listed in Annex 22. ';
9. in Article 6 (2) (c):
"(c) the supply channel and the sewer network used at least in part 1 of the municipalities,"
10. Paragraph 6 (4) is deleted.
Paragraph 5 shall become paragraph 4.
11. in Article 6 (4), the words "Ministry in electronic form" shall be inserted after the words "Ministry of Agriculture" and the words "Ministry of Agriculture" shall be deleted;
12. in Article 7 (1):
"(1) The content of the selected traffic record data transmitted is set out in Annexes 5 to 8 and the structure of the database file is set out in Annex 22. '
13. in Article 7 (4), the second sentence is replaced by the following: "The information collected from the register shall be transmitted by the owner of the functional unit or part of it with the highest annual drinking water consumption or the highest amount of waste water treated."
14. in Article 7, paragraph 7 is deleted;
Paragraph 8 shall become paragraph 7.
15. in Article 7 (7), the word "electronic" shall be inserted after the word "transmission" and the word "June" shall be replaced by "July."
16. In the heading of Part Four, the word "IMPLEMENTATION 'is replaced by the words" FORMATE' and the words in brackets "paragraph 11 'are replaced by" paragraphs 12 and 13'.

(1) The content of the application form is set out in Annex No 11.
(2) The information provided by the Regional Authority pursuant to Paragraph 6 (10) shall be transmitted to the Ministry in one of the following electronic forms:
(a) a form of output from an application for registration, the format and structure of which are listed in Annex 23, or an output from an application published on the Ministry's website; or
(b) by transmission of the application form, accompanied by the particulars of the decision of the Regional Office in the format referred to in paragraph 1. ';
18. The heading of Section 12a is deleted.
19. in Article 12a (1), the words "or the field of higher education" shall be inserted after the word "test."
20. in § 12a (d) and (h), the words "watery and tawdry" shall be replaced by the words "for water and prices for tawdry."
21. The heading of Part Five reads:
"CONTENTS OF THE PLAN FOR THE FINANCING OF WATER AND CANALIZATION, RULES FOR ITS PROCESSING
(Paragraph 8 (1) and (11) of the Law) '.

The content of the Plan for the Financing of the Recovery of Water and Sewerage is the definition of infrastructure assets broken down according to the selected data by the property records with a replacement purchase price, the assessment of the state of the property, expressed in% wear, the calculation of the theoretical time of accumulation of funds, the annual need for funds and its cover and the evidence of drawdown of the funds generated, including invoices or copies thereof. The processing shall be carried out in accordance with Annex 18. Each update carried out shall be part of the initial plan for the financing of the renewal of water pipelines or sewerage. ';
23. Article 13a is deleted.
24. in Article 16 (d), the word "sewerage" shall be deleted;
25. in Article 21 (4), the words "and the competent river basin administrator" shall be inserted after the words "the Authority."
26. in Paragraph 22 (4), "No 13; Directional and marginal" is replaced by "No 13 in Tables 1a and 1b. Limit."
27. In Article 22, the following paragraph 8 is added:
"(8) The method of evaluation of the limit values and the inclusion of raw water in the basic categories are set out in Annex 13, Part 3."
28. In the title of part 10, the words "paragraph 5 'shall be replaced by" paragraph 6'.
29. in Paragraph 24 (a):
"(a) basic data,
1. the name or name and surname, the identity number of the owner or owners of the sewerage, if assigned to which the sewerage rules apply, the name and identification number of the operator or operators operating the sewerage, if any, the name and surname of the operator, the property registration numbers of the sewerage and of the waste water treatment plant in accordance with Annexes 3 and 4;
2. the characteristics and description of the territory of the municipality or part thereof with sewerage, to which the sewerage system applies, from the point of view of the geographical and urban sector, the supply of drinking water, the de-sewerage method, the basic balance parameters of the delivered drinking and discharging waste water, the effluent conditions in the municipality, the brief description of the water receptance, the approximate number of persons cleaning waste water in septic and domestic waste water treatment plants, the approximate number of persons collecting waste water in the cesspool and the objectives of the sewerage system for the site, the inventory of the main waste water producers, the type and volume of waste water discharges to the sewerings in each day and day of the year including the pollution, '.
30. in § 24 (b) (8):
'8. data on the number of sewerage connections; ';
31. in Article 24 (b), point 9 shall be deleted;
32. in Article 24 (c), the words "sewer nets and positions" shall be inserted after the words "marking."
33.In Paragraph 24 (d):
"(d) data on the relevant waste water treatment plant to which waste water is to be taken,
1. the design capacity of the sewage treatment plant;
2nd year of putting into service of waste water treatment plant, year of reconstruction and treatment, description of current technical condition, total amount of waste water, sewage waste water, other waste water, precipitation or ballast, concentration of pollutants in inflow and outflow including projected values,
3. the number of persons connected and the number of equivalent persons connected;
4. the way or ways of dealing with the separation of rainwater from single sewers; ';
34. in Article 24 (h), the words "selected" shall be inserted after the words "water u" and the words "and their list" shall be added at the end of the text (h).
35. in Article 24 (j), the word 'control' is replaced by 'control method' and the words' sampling type 'are inserted after the words' sampling point ';
36. Article 25 shall be deleted;
37. In the heading of the 11th part, in brackets, "paragraph 5 'is replaced by" paragraph 6'.
38. Paragraph 28 (3) is deleted.
39. in Paragraph 31 (1), the words "total precipitation" are replaced by the words "withholding normal."
40. The heading of Part 14 reads:
"METHOD OF CALCULATION OF THE PERFORMANCE OF THE AQUATIC AND STOCKS COMPONENTS FOR PAYMENT IN THE TWO-SHIP FORM, CALCULATION OF THE PRICE FOR THE AQUATIC AND STOCKS ON THE CALENDAR YEAR UNDER THE PRICE RULES AND THE STANDARDS OF ALL THE PRICE CALCULATION ITEMS FOR THE AQUATIC AND STOCKS ACHIEVED
(Articles 20 (3) and (9) and 36 (7) of the Law) '.
41.In Article 32 (2) (a), "§ 8 (5)" is replaced by "§ 8 (6)."

43. In Paragraph 35 (1), the words "For the smallest water-meters qp = 1,5 m3.h-1" are replaced by the words "For water-meters with an overflow rate 31) of less than 3,125 m3.h-1."
44. § 35a reads:
(1) The calculation of the price for water and the prices for the calendar year in accordance with the price regulations is carried out in accordance with Annexes 19 and 19a.
(2) The calculation of the water price and the tidal prices referred to in paragraph 1 shall be carried out for the customers, for the water pipeline owners and for the water sewerage owners, for the drinking water and the waste water taken over.
(3) Where the price for drinking water transmitted is calculated, the unit costs of the drinking water source and, where appropriate, its transport shall be calculated.
(4) In cases of calculation of the price for waste water taken over, the unit costs of waste water treatment and, where appropriate, its transport shall also be calculated.
(5) The comparison of all items of the calculation of the price for the water and for the calendar year in accordance with the price regulation with the facts achieved in a given calendar year shall be made by dividing the cost items with their content and, to the extent of the data set out in Annex 20 and the database structure as set out in Annex 24.
(6) The comparison of all the price calculation items for aqueous and wrenches with the achieved fact shall be made for customers, for the water pipeline owners, for the operationally related and for the sewerage owners, for the drinking water and for the waste water taken over.
(7) In the context of the cost of calculating the price for water and bulkheads, the processor shall indicate on each cost item all the actual costs associated with the operation of pipelines or sewerage for public use and shall not transfer such costs to other activities carried out by the owner or the operator of the pipelines or sewerage for public use. ';
45. in Paragraph 36, paragraph 3 is deleted;
Paragraphs 4 and 5 shall be renumbered paragraphs 3 and 4.

1) It shall be determined only in relation to a possible or proven occurrence in the source and at first classification of raw water as defined in Section 22. The demonstrated occurrence is a concentration value exceeding the limit value given in Annex 13 in Table 1 for category A1.
Indicator serial number:
Indicator No 33 is expressed as the sum of the concentrations: (benzo (b) fluorantene, benzo (k) fluorantene, benzo (ghi) perylene, indeno (1,2,3-cd) pyrene, benzo (a) pyrene. Indicator No 34 is expressed as the sum of individual pesticides. These are pesticides which are likely to be present in crude water, according to the pesticides used in the territory. Indicator 50: All individual pesticides likely to be present in raw water are monitored.
