DECLARATION
of 16 October 2006
amending Decree No. 26 / 2001 of the Ministry of Health Coll., on sanitary requirements for cosmetic products, on the particulars of the application for the non-inclusion of ingredients on the packaging of cosmetic products and on the requirements for the education and practice of a natural person responsible for the manufacture of cosmetic products (cosmetic products decree), as amended, and repealing Decree No. 75 / 2003 Coll., on determining the nomenclature of cosmetic products ingredients
According to Article 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the Amendment of Certain Related Acts, as amended by Act No. 274 / 2001 Coll., Act No. 320 / 2002 Coll., Act No. 274 / 2003 Coll., Act No. 392 / 2005 Coll. and Act No. 222 / 2006 Coll., for the implementation of § 26 (1) (b) and § 29 (1) thereof:
Amendment of the order on cosmetic products
Decree No. 26 / 2001 Coll., on sanitary requirements for cosmetic products, on the particulars of the application for the non-inclusion of ingredients on the packaging of cosmetic products and on the requirements for the education and practice of a natural person responsible for the manufacture of cosmetic products (cosmetic products decree), as amended by Decree No. 268 / 2001 Coll., Decree No. 444 / 2004 Coll., Decree No. 126 / 2005 Coll., Decree No. 104 / 2006 Coll. and Decree No. 260 / 2006 Coll., is amended as follows:
1. footnote 2 shall read:

2. in the 10th sentence of Article 2 (1) (g), the words "The name of the ingredient must be given in accordance with the specific legislation1b) under the common nomenclature INCI" shall be replaced by the words "The name of the ingredient must be given in accordance with the common nomenclature INCI adopted as a common nomenclature by the Commission of the European Community1b)."

4. In Annex 3, Part 2, the entries under reference numbers 17, 23, 40 and 42 are deleted.
5. in Annex 3, Part 2, in box g, for reference numbers 1, 2, 8, 13, 15, 30, 34, 41, 43, 45, 46, 51 to 54, 57, 59 and 60, the words "31 August 2006" shall be replaced by "31 December 2007."
6. In Annex 3, Part 2, in box g, for reference numbers 3 to 7, 9 to 12, 14, 16, 18 to 22, 24, 25 to 29, 31 to 33, 35 to 39, 44, 47 to 50, 55, 56 and 58, the words "31 December 2006 'are replaced by the words" 31 December 2007'.
Transitional provisions
1. Even points 3 and 4 shall, until 1 December 2006, be assessed in accordance with existing legislation when marketing, distribution, selling or offering to the consumer.
2. Cosmetic products placed on the market, distributed, sold or offered to the consumer before the date of entry into force of this decree, the name of the ingredient on which is given in accordance with Decree No. 75 / 2003 Coll., shall be considered as cosmetic products on which the name of the ingredient is given in accordance with this decree, pending the sale of its stocks.
Repeal of the order on the nomenclature of ingredients of cosmetic products
Decree No. 75 / 2003 Coll., establishing the nomenclature of ingredients of cosmetic products, is deleted.
EFFECTIVE
This decree shall take effect on the day of its publication.
