amending Act No. 168 / 1999 Coll., on insurance of liability for damage caused by the operation of a vehicle and amending certain related laws (Act on Insurance of Liability from the Operation of a Vehicle), as amended, Act No. 586 / 1992 Coll., on Income Tax, as amended, Act No. 200 / 1990 Coll., on Infringements, as amended, and Act No. 40 / 1964 Coll., Civil Code, as amended
Parliament has decided on this law of the Czech Republic:

Amendment of the Income Tax Act

1. Paragraph 15 (13) reads as follows:
"(13) The tax base for the tax period may be deducted by the taxpayer paid the normal insurance premiums in the tax period for his private life insurance under the insurance contract between the policyholder and the insured person in the same person and by the insurance undertaking which is entitled to pursue the insurance activity in the territory of the Czech Republic under the special legislature89), provided that the payment of the insurance premiums (pension or one-off benefits) is agreed in the contract only after 60 months from the conclusion of the contract and at the same time in the calendar year in which the policyholder reaches the age of 60 years and, in the case of an insurance contract with a fixed insurance sum of life, on condition that he fulfils the minimum premium requirement. The minimum insurance amount is fixed for these insurance contracts with insurance periods from 5 to 15 years including for 40 000 CZK and for insurance contracts with insurance periods over 15 years for 70 000 CZK. In the case of pension insurance, the minimum insurance amount shall be considered as the corresponding one-off life-long benefits. One-off premiums shall be calculated in proportion to the tax period according to the duration of the insurance with precision to the days. The maximum amount that can be deducted in the tax period under this paragraph is CZK 12,000, even if the taxpayer has several contracts with several insurance companies. In the absence of these conditions due to the loss of insurance or the additional change in the duration of insurance, the right to deduct the non-taxable amount of the tax base shall cease to exist and the income referred to in Paragraph 10 in the tax period in which this occurred shall be reduced by the amounts by which the taxpayer was reduced in the years concerned due to the insurance basis paid. In the case of insurance contracts for which insurance benefits are not paid or payable and at the same time the provision or capital value of the insurance will be transferred to a new private life insurance contract satisfying the conditions for tax eligibility, the taxpayer, as a policyholder and insured in one person, shall not be obliged to submit a tax return and to indicate in it, as income under Section 10, the amounts by which he was reduced in the years concerned due to the insurance basis paid. '
2. In Article 15, the following paragraph 15 is added:
"(15) Insurance contracts which do not meet the condition of the minimum premium amount (Paragraph 15 (13)) for which the taxpayer may have applied a tax deduction cannot be applied from the date of the amendment to this Act, and insurance undertakings will not send to policyholders a certificate of the premium paid by the taxpayer for private life insurance for the past tax period. '
3. in Article 19 (1), point (w), including footnote 86, shall be deleted;

4. In Paragraph 21 (2), "15 'is replaced by" 5'.
5. in Article 21 (2) (a), the words "and the pension fund," including the reference to footnote 9a, shall be deleted;
6. In Article 21, the following paragraph 3 is inserted after paragraph 2:
"(3) The tax rate is 15% for the pension fund. 9a) This tax rate shall apply to the tax base reduced by the items referred to in Paragraph 34, which shall be rounded down to the nearest thousand crowns. '
Paragraphs 3 to 5 shall be renumbered paragraphs 4 to 6.
Čl. VI
Transitional provision
Paragraph 15 (13) and (15), § 19 (1) and Article 21 (2) and (3) of Act No. 586 / 1992 Coll., on income taxes, as amended by this Act, shall apply for the first time for the tax period which began in 2004.

This Act shall take effect on 1 May 2004, with the exception of the provisions of § 6 paragraphs 4 to 6, § 9a, 15a, § 17 paragraph 2, § 18 paragraph 2 (b) and (d), § 18a, § 24 paragraph 2, § 24a and 24b of Act No. 168 / 1999 Coll., on insurance of liability for damage caused by the operation of a vehicle and amending certain related laws (Act on Insurance of Liability from the operation of a vehicle), as amended by this Act, which shall take effect on the date of the entry into force of the Treaty on the accession of the Czech Republic to the European Union.
