on the prices of privately owned buildings and the replacement of real estate
The Slovak Price Office and the Ministry of Finance of the Slovak Socialist Republic, in agreement with the participating central authorities and authorities of the Slovak Socialist Republic, provides for the Act No. 53 / 1968 Coll., on Changes in the Organisation and Scope of Certain Central Authorities, pursuant to Article 31 (2) (b) of Act No. 87 / 1958 Coll., on the Construction Regulations, and under Article 144 (2) of Constitutional Act No. 143 / 1968 Coll., on the Czechoslovak Federation:
§ 1
Subject matter
(1) This decree provides:
(a) the prices of buildings acquired from citizens by their personal ownership for any legal reason by socialist or other organisations and citizens, as well as the prices of such buildings acquired by citizens from those organisations (Sections 2 to 10), unless otherwise specified by specific regulations;
(b) prices of land use law (§ 11);
(c) the amount and method of compensation for privately owned and privately owned buildings (Sections 12 to 21).
(2) In addition, this decree (hereinafter referred to as the "Order") regulates the process of socialist organisations in concluding agreements on the transfer of immovable property to citizens or non-socialist organisations (§ 22).

PRICE PROVISIONS

Hlava první

Prices of personal property structures
Family homes and residential areas of agricultural settlements
(1) The price of the family home and the residential part of the farm estate *) shall be determined as follows:

The principles for the classification of family houses and housing areas of agricultural holdings in each class are set out in Annex 1.
(2) Price calculation area means floor area
(a) housing rooms according to housing regulations;
(b) rooms which may be used only for temporary accommodation by their construction and technical arrangements and which do not meet the conditions for permanent housing under housing regulations, reduced by 50%;
(c) rooms intended for non-residential purposes * *) located, where appropriate, in the family home.
(3) The price of the family home is reduced accordingly by its wear and tear; This reduction is generally 1% for each year of construction age in normal maintenance. For a family house where upgrading or overhauls have been carried out, the reduction is reasonably lower and for a family house where maintenance or repair has been neglected, or if and the home damaged, is reasonably higher.
(4) In case of doubt, the date on which the building is put into use is crucial to assess the age of the family house.
§ 3
Vacation cabins
(1) The price of the holiday cottage is found as follows:

The principles for the inclusion of holiday huts in each class are set out in Annex 2.
(2) The price referred to in paragraph 1 shall be increased by 20% if the holiday cabin has an attic and by 60% if the holiday cabin has a continuous floor.
(3) The built-in area for calculating the price of the holiday cottage is the total built-in area of the building, including the porch, but without accessories, if outside the building, and without secondary constructions (wood, tools, etc.).
(4) Paragraph 2 (3) and (4) applies mutatis mutandis, with the reduction for each year of age of the holiday cottage generally being 1,25% for the construction quality of Class I, 1,75% for Class II and 3,3% for Class III.
§ 4
Garage
(1) The price of a separate garage is determined as follows:

The principles for the classification of garages in each class are set out in Annex 3.
(2) Paragraph 2 (3) and (4) applies mutatis mutandis, with the reduction for each year of garage age generally being 1,25% for the construction of Class I, 1,75% for Class II and 3,3% for Class III.
§ 5
Fences
(1) The price of the fence is determined as follows:

The principles for the classification of fences in each class are set out in Annex 4.
(2) Paragraph 2 (3) and (4) are similar as the reduction for each year of age of the fence is generally 2% for Class I, 2.5% for Class II, 3.3% for Class II and 5% for Class IV.
§ 6

(2) The price of the well in paragraph 1 includes the price of a simple (hand) pump.
(3) Paragraph 2 (3) and (4) applies mutatis mutandis, with a reduction of 1% for each year of well age.
§ 7
Small buildings
(1) The price of small buildings is determined as follows:

The principles for the classification of small buildings in each class are set out in Annex 5.
(2) Small buildings are structures which, by their nature, serve personal needs (e.g. lumber, colna, laundry, etc.).
(3) Paragraph 2 (3) and (4) applies mutatis mutandis to the fact that the reduction for each year of age of the small construction is generally 1,25% for construction of Class I, 1,75% for Class II and 3,3% for Class III.
§ 8
Outdoor treatment
(1) The price of outdoor treatment (paving, gazebo, wall protection, railing wells, drains, etc.) on land intended for the construction of a family house, holiday cabins, garages or for the establishment of a garden is equal to the cost of purchasing at the time of valuation reduced by usually 2% for each year of age of outdoor treatment.
(2) Paragraph 2 (3) and (4) shall apply mutatis mutandis.
§ 9
Unfinished constructions
The price of the unfinished construction is that part of the price of the completed construction which corresponds to the ratio of the costs expected when the construction was completed to the costs already incurred. Unbuilt construction material shall not be included in the cost.
§ 10
Prices of buildings acquired by citizens
(1) The prices of privately owned buildings (Sections 2 to 9), as well as those sold by socialist organisations other than the usual management or by non-socialist organisations to citizens are the highest prices, unless otherwise provided in this Decree (Sections 10 (2) and 22).
(2) If the owner has acquired a personal property structure after 1 June 1953 at a price higher than that laid down in Sections 2 to 9 of the Decree, the highest price of the identifiable acquisition costs after deduction of the wear pursuant to Sections 2 to 7 of the Decree.

Hlava druhá

Price of the right of personal use of land
§ 11
(1) The price of the right of personal use of land *) for the construction of a family house, holiday homes, garages or the establishment of a garden or land already used for this purpose is determined at the rates set out in § 14 (1) and (2).
(2) The Regional National Committees or the National Committees set up by them in agreement with the Ministry of Finance of the Slovak Socialist Republic may, taking into account local conditions, increase the price of the right of personal use of land intended or used for the construction of a holiday cabin or garden.

REFUNDS ON IMMOVABILITY

Hlava první

Compensation for personal property construction
§ 12
(1) In the case of expropriation, the amount of the cost of the construction shall be paid for personal property (Sections 2 to 9 and 10 (2)), unless otherwise specified in paragraph 2.
(2) The reduction due to the age of the building is 70% or less for the family house and residential part of the farm estate (§ 2) and 80% for the buildings referred to in § 3 to § 8.

Compensation for privately owned immovable property
§ 13
Construction
(1) A refund calculated in accordance with the following table shall be granted for the construction:

The principles for the classification of residential buildings in each class are set out in Annex 1, for the classification of garages in Annex 3 and for the classification of economic buildings in Annex 5.
(2) For residential buildings which may fulfil the purpose of family houses, * *) and for buildings with an apartment and an establishment, the district national committee may, in particular, authorise the granting of compensation to the owner for the personal residence of the family house. when calculating the refund, account shall be taken of the living space (Paragraph 2 (2)) only up to an area of 120 m2.
(3) For buildings used by the owner for agricultural or trade activities, the compensation in question is equal to the price calculated in accordance with Section 7.
(4) The compensation for the fence and well is equal to 1% of the price calculated in accordance with Sections 5 and 6.
§ 14
Land in the built-up part of the village and land intended for the construction of holiday cottages and the establishment of gardens outside the built-up part of the village
(1) For the land or parts thereof in the built-up part of the municipality, taking into account the location and quality of the land under local conditions, compensation for 1 m2 shall be payable:
(a) up to 3000 m2:
not more than 15, - Ccs in cities over 100 000 inhabitants
in cities from 40 000 to 100 000 inhabitants
not more than 8, - in cities from 10 000 to 40 000 inhabitants
not more than 6, - Kčs in municipalities from 2000 to 10 000 inhabitants
not more than 4, - Guts in municipalities with less than 2000 inhabitants
(b) for an area exceeding 3000 m2, 0,40 CZK.
(2) For the land or parts thereof outside the built-up part of the municipality, it is evidently intended for the construction of a holiday cottage or for the establishment of a separate garden, taking into account the location and / or quality of the land under local conditions, the compensation per 1 m2 is:
(a) up to 1500 m2, at the rates referred to in paragraph 1 (a);
(b) at an area exceeding 1500 m2 at the rate referred to in paragraph 1 (b).
(3) If the owner has obtained the land demonstrably after 1 June 1953 at a higher price than the refund referred to in paragraphs 1 and 2, the expropriation authority may grant compensation up to the amount of the acquisition price established.
(4) According to the preceding paragraphs, compensation shall also be granted for the parcels already used for those purposes.
(5) A built-in part of a municipality under this Decree means a territory which is continuously built or otherwise technically adapted for the needs of the municipality. * * *)
§ 15
Other land
(1) For land other than those referred to in Paragraph 14, the cash compensation of Kčs is 0,40 out of 1 m2.
(2) At the request of the expropriated person, he may be granted compensation for the expropriated land on a replacement parcel of the same type, provided that the expropriating organisation has it available.
§ 16
Outdoor treatment
For outdoor treatment (paving, etc.) not covered by the provisions of Section 8, compensation shall be granted at the price of the material obtained by demolition after deduction of demolition costs.

Hlava třetí

COMMON PROVISIONS
Replacement for crops
§ 17
Permanent crops
(1) Compensation for fruit trees shall be granted at the rate calculated in accordance with Table I of Annex 6.
Compensation for utility trees shall be granted at the price of the harvested timber.
If the total compensation for fruit and utility trees exceeds 40 000, - CZK, the part of the refund in excess of 40 000, - CZK is reduced by 50%.
(2) Compensation for vineyard crops, including vineyard facilities, shall be granted in accordance with Table II of Annex 6.
If the total refund for vineyards and vines exceeds 40 000, - Kčs, the part of the refund exceeding 40 000, - Kčs shall be reduced by 50%.
(3) The compensation for hop crops and hop plant is granted at the level calculated in accordance with Table III of Annex 6.
(4) The compensation for forest crops is granted at the level calculated in accordance with Table IV of Annex 6.
Wood material from expropriated forest areas belongs to expropriators.
If the total compensation for forest crops exceeds 40 000, - Cds, the part of the refund exceeding 40 000, - Cds is reduced by 50%.
§ 18
Other crops
For crops other than those referred to in § 17, compensation shall be granted for the costs of sowing or planting, cultivation and fertilisation.
§ 19
Reimbursement of certain costs
(1) The removal or, where appropriate, the transfer of non-expropriated portable buildings from the expropriated land is subject to compensation of reasonable and demonstrably incurred costs; such refund shall not be granted where the owner has been obliged, by contract or by official decision, to remove it for his cargo.
(2) The transfer of uppers and other movable property of the user of the expropriated building to a new place of destination shall be subject to compensation of reasonable and demonstrably incurred costs.
§ 20
Preliminary use of the property
(1) For the provisional use of *) citizens' owned properties, if they were not in the use of socialist organisations, the compensation of 2,5% per year is due to the amount which would be due for the acquired property.
(2) The total refund on immovable property is not reduced by the refund for the provisional use of the property.
§ 21
Provision of higher compensation (purchase prices)
(1) In exceptional cases, the district national committee may authorise the granting of higher compensation up to the amount of a member's share in the building housing cooperative if the compensation for the personal property is not sufficient to obtain an adequate replacement apartment in cooperative housing.
(2) If the building is co-owned, a higher refund may be granted only to the co-owner who needs to buy a replacement apartment; in such a case, it may be authorised only up to an amount corresponding to the share of that joint owner.
(3) The higher compensation permitted under paragraph 1 may only be used to repay a member interest in a building housing cooperative. The expropriation authority shall quantify in the decision the difference by which the refund is higher and shall provide for the condition that the difference must be recovered if the refund is not used for that purpose within a period to be determined by that authority.
(4) The higher replacement of the organisation will point to the state savings bank in the district of the residence of the former owner of the construction, who will confirm the receipt of the remuneration and deposit it on a wine-based deposit book, with the possibility that the payment of the deposit can be used only with the agreement of the organisation. The organisation shall consent to the payment of this contribution only to the payment of a member's share in the building housing cooperative.
(5) The provisions of paragraphs 1 to 4 also apply to the contractual acquisition of buildings in private ownership.

The process of SOCIALISTIC ORGANISATIONS in the negotiation of CONTRACTS WITH CITIZENS AND OTHER THAN SOCIALISTIC ORGANISATIONS ON TRANSFER OF IMMOVATIVES
§ 22
(1) In the contractual acquisition of privately owned and privately owned buildings covered by this Decree, Socialist organisations may undertake higher remuneration than those provided for in expropriation only in exceptional, particularly social cases and only with the approval of the District National Committee.
(2) The provisions of paragraph 1 shall apply mutatis mutandis to sales of buildings by socialist organisations other than the usual management of citizens' personal property.
(3) The Socialist organisation may also agree to provide the owner with a different building (including its construction), which may be privately owned, or with a means of building, instead of a cash payment. The owner shall not be entitled to compensation in another construction or replacement in the means of construction. The replacement construction shall be valued in accordance with § 12 (1) and (2) and any differences shall be offset in cash. Also in money, the difference between the remuneration for the building purchased and the price of the building assets will be offset. The Socialist organisation will ensure the unpaid difference in the replacement construction by contract to limit the transfer of real estate pursuant to § 58 of Civil Code No. 40 / 1964 Coll.
(4) The Socialist organisation may also agree to provide the owner with a different parcel of the same type instead of a cash payment. Any differences in the valuation shall be settled in cash.
(5) Paragraphs 19 to 21 apply mutatis mutandis. The difference (Paragraph 21 (3)) must be calculated and the obligation to repay it laid down in the contract.
(6) The provisions on the management of national assets are without prejudice to this.

TRANSITIONAL AND FINAL PROVISIONS
§ 23
Organisations which acquired the buildings by expropriation or contract for a refund or at a price under Decree No. 73 / 1964 Coll. after 1 January 1969 shall pay the former owner the amount of the difference between this refund (purchase price) and the refund (purchase price) under this decree.
§ 24
Organisations which have acquired land for compensation in replacement land which has not yet been granted before the date of application of this Decree by a valid expropriation decision shall, at the request of the former owner, grant a monetary refund in accordance with Paragraph 15 (1), if the Financial Department of the relevant District National Committee confirms that it cannot provide replacement land in the same municipality. The organisation shall inform the expropriating authority and the financial department of the District National Committee of the granting of the cash compensation.
§ 25
This decree takes effect on 1 June 1969, and from that date the Decree No. 73 / 1964 Coll., on the prices of privately owned buildings and the compensation for the expropriation of real estate does not apply in the Slovak Socialist Republic.

It will decide whether at least two-thirds of the questions are answered positively.
If it is not possible to achieve two thirds of the positive responses for any class when the construction is included, the class concerned shall be determined as follows:
1. If the sum of Class I and Class II qualitative characters for construction is greater than or equal to two thirds of the total number of characters, the construction shall be assigned to Class II.
2. In other cases:
(a) each character obtained in Class I shall be multiplied by one point, two points in Class II, three points in Class III and four points in Class IV;
(b) the sum of all points shall be divided by the number of all characters answered. (The omitted characters are not taken into account. Only a character that is objectively not possible for a given construction may be considered a omitted character);
