THE LAW
of 13 January 2016
amending Act No. 219 / 1999 Coll., on the Armed Forces of the Czech Republic, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 219 / 1999 Coll., on the Armed Forces of the Czech Republic, as amended by Act No. 352 / 2001 Coll., Act No. 320 / 2002 Coll., Act No. 253 / 2005 Coll., Act No. 413 / 2005 Coll., Act No. 546 / 2005 Coll., Act No. 274 / 2008 Coll., Act No. 41 / 2009 Coll., Act No. 147 / 2010 Coll., Act No. 375 / 2011 Coll., Act No. 253 / 2012 Coll., and Act No. 250 / 2014 Coll., is amended as follows:
1. In Article 2 (3), the words "and ministries' shall be inserted after the words" the needs of the armed forces'.
2. Paragraph 2 (4) is deleted.
Paragraphs 5 to 13 shall be renumbered paragraphs 4 to 12.
3. In Paragraph 2 (10), the words "military rescue service 'are deleted.
4. In Article 2, paragraphs 13 and 14 are added:
"(13) Operational deployment means:
(a) the use of armed forces in the defence of the Czech Republic against external assault or in other serious situations threatening the lives, health, significant assets or the environment; or
(b) the performance of the tasks of the armed forces in an environment of armed conflict or in an environment threatened by combat activity.
(14) A task group shall mean a temporary grouping of military units, military facilities, units, parts or individual soldiers in active duty under the command of a designated commander, which is designed for operational deployment, to perform a specific operation or to perform a specific task, and which does not have a permanent organisational structure. The commander shall have the status of a service authority with regard to the soldiers of the task force. ';
5. The following Section 3a is inserted after Section 3, including the title and footnote 24:
Military oath
Soldier 24) takes a military oath, which reads:
"I, a soldier, aware of my civic and patriotic duties, solemnly declare that I will be faithful to the Czech Republic.
I will be a soldier brave and disciplined, I will carry out the task of the armed forces and I will follow the law and military regulations. I will learn to control military technology and weapons, prepare to defend the Czech Republic and defend it against external assault.
To defend my country, I'm ready to put my life on the line.
I swear. "
24) Paragraph 1 (4) of Act No. 585 / 2004 Coll., on the defence obligation and its provision (the Defence Act), as amended. '
6. In Article 4, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The organisation of political meetings and election campaigns shall be prohibited in military buildings and in the performance of the tasks of armed forces outside military buildings. '
7. in Article 5 (c) and (d), the comma after the words "military services" shall be replaced by "and" and military rescue services "shall be deleted;
8. The following Section 6a is inserted after Section 6:
Member of the armed forces designated to carry out civil defence tasks
The Government shall establish, by means of a regulation, by means of Article 67 of the Additional Protocol to the Geneva Conventions of 12 August 1949 on the protection of victims of international armed conflicts, military services, military facilities or parts thereof, or of a category of members of the armed forces, to carry out the civil defence tasks referred to in Article 61 of this Protocol. ';
9. in Article 7 (1) (b), the comma after the words "military services" shall be replaced by "and" and military rescue services "shall be deleted;
10. In Article 7, at the end of paragraph 1, the dot is replaced by a comma and the following point (f) is added:
"(f) creates conditions for members of the armed forces to exercise a national sports representation."
11. in Paragraph 7 (3):
"(3) Part of the Ministry is the General Staff of the Army of the Czech Republic, which ensures the command of the army and which, to the extent of its competence, is involved in the performance of tasks set out by the Ministry by special legislation. The Head of the General Staff of the Army of the Czech Republic is the Chief of the General Staff of the Army of the Czech Republic (" Chief of the General Staff "). '
12. In Article 7, the following paragraphs 5 to 7 are added:
"(5) On a proposal from the Minister, the Government provides for the systemisation of the General Staff of the Army of the Czech Republic for the relevant calendar year to the following extent:
(a) the number of systemised locations of soldiers classified by rank;
(b) the number of systematic posts of non-senior staff classified by grades;
(c) the number of systematic posts of senior staff in employment classified by grades;
(d) the amount of funds for the salaries of soldiers; and
(e) the amount of appropriations for staff salaries in employment.
(6) If the systemisation of the General Staff of the Army of the Czech Republic is not approved by 31 December, the current systemisation shall apply for the following calendar year.
(7) The organizational structure of the General Staff of the Army of the Czech Republic is approved by the Minister on the basis of a proposal prepared by the Chief of General Staff in accordance with the systemisation of the General Staff of the Army of the Czech Republic approved by the Government. "
13. in Paragraph 10 (2), the words "professional" are replaced by the words "active duty."
14. In Paragraph 13, the comma after the words "military services' is replaced by" a 'and the words "and military rescue services' are deleted.
15. in Paragraph 14 (1) (k), "protection" is replaced by "defence."
16. In Article 15, the comma after the words "Territorial Authority 'is replaced by" or' and the words' or military rescue services' are deleted.
17. in Article 16 (1), the word "require" is replaced by "require" 25);
footnote 25:
"25) § 20 et seq. of Act No. 239 / 2000 Coll., on the Integrated Rescue System and on the amendment of certain laws, as amended."
18. In Paragraph 18, the words "persons, fire 'are replaced by the words" persons or fire', the words "or military rescue services' are deleted and the words" immediately 'are inserted after the words "the use of military equipment'.
19. Paragraph 19 shall be deleted, including the title and footnote 11a.
20. In Section 21, the words "If there is a danger of delay and if the forces and means of securing aircraft for the medical rescue service are not sufficient, the military shall participate 'shall be replaced by the words" The army shall participate'.
21. The following Section 22a is inserted after Section 22, which includes the title:
Free use of the armed forces vehicle
(1) The Chief of Staff and his representative are entitled to use the vehicle of the armed forces free of charge for the performance of their duties or in connection with it or for personal use.
(2) The service authority may, where justified, authorise a soldier in active duty to use a vehicle of the armed forces to travel to and from the place of service in connection with the performance of the tasks of the armed forces. "
22. in § 24a (1) (g):
"(g) members of the security corps of the Czech Republic and material equipment to ensure the operation of the security corps of the Czech Republic in order to deal with emergency or crisis situations in order to protect the life, health and property of citizens of the Czech Republic or in the performance of tasks of members of the security corps of the Czech Republic and in the protection of the interests of the Czech Republic abroad."
23. In Paragraph 29 (2), the words "military rescue services" shall be deleted.
24. in Article 31 (3), the word "protection1)" shall be replaced by the word "defences 1)."
25. In Paragraph 31 (4), the words "even soldiers outside active duty and other persons" are replaced by the words "soldiers in reserve and also persons."
26. in Paragraph 32 (2):
"(2) The Ministry shall determine by decree:
(a) the types and categories of military vehicles and military working machinery and the method of approving their technical competence;
(b) conditions for the recognition of type-approval certificates for military vehicles issued by another State;
(c) technical conditions, design and design of military vehicles and possible exemptions;
(d) the conditions of technical incompetence and prohibition on the operation of military vehicles; and
(e) additional equipment and equipment for military vehicles. ';
27. in Paragraph 32a (2), "missions" is replaced by "operations";
28. In Article 32a, the following paragraph 3 is inserted after paragraph 2:
"(3) In the event that the periodic technical inspection and measurement of emissions of a vehicle of the armed forces deployed in a foreign operation expires during or during a foreign operation, it shall be deemed to expire on the last day of the sixth month following the date of the return of the vehicle from the foreign operation. ';
Paragraph 3 shall become paragraph 4.
29. in Paragraph 34 (6), the words "in agreement with the Ministry of Transport and Communications" are deleted.
30. In Paragraph 40 (4), the words "in agreement with the Ministry of Transport and Communications" are deleted.
31. The heading of § 42 reads: "Use of military weapons in the exercise of order, guard, escort and supervision services outside combat situations."
32. In Section 42 (1) of the Introductory Part of the Provisions, the words "in active service 'shall be inserted after the word" Soldier' and the words "or special means referred to in Section 42a (2) 'shall be added at the end of the text of the Introductory Part of the Provisions.
33. In Article 42 (3) and (7), the words "in active service" shall be inserted after the words "soldier."
34. in Article 42 (4) and (5), the words "in active service" shall be inserted after the words "Soldier."
35. in Article 42a (1) and (3), the words "professional" shall be replaced by the words "active duty."
36. In Article 44 (3), the words "train drivers, train trainers, test Commissioners of the bridegroom," shall be inserted after the words "data."
37. The words "A SERVICES 'shall be added at the end of the text of the title of Part Ten.
38. The following Part 11 is inserted after Part 10:
RISK CONTRIBUTION
A civil servant who is involved in the security of the tasks of the armed forces abroad pursuant to § 10 and who is posted on a business trip to a place where foreign operations are carried out is entitled to a risk allowance of 700 to 3,500 CZK per day. The amount of the contribution shall be determined by the Minister for a specific foreign operation depending on the level of risk, intensity and duration of the operation. ';
Part 11 shall be renumbered as part 12.
Transitional provision
A military oath made before the date of entry into force of this Act shall be deemed to be a military oath made under Act No. 219 / 1999 Coll., as effective from the date of entry into force of this Act.
Efficacy
This Law shall enter into force on 1 July 2016.
