amending and supplementing the Law on Higher Education
The National Assembly of the Czechoslovak Republic decided on the following Act:
Act No. 58 / 1950 Coll., on Higher Education, is amended as follows:
1. Paragraph 4 to 17 of Part II reads:
Administration and organisation of universities.
College administration.
The Minister for Education and Culture essentially manages all higher education institutions and manages them uniformly in an ideological, scientific and pedagogical way. Measures of a general nature shall be taken in agreement with the participating members of the Government.
State Committee on Higher Education and Slovak Committee on Higher Education.
(1) The State Committee for Higher Education (hereinafter referred to as the State Committee) is hereby established as an initiative, coordination and advisory body of the Minister for Education and Culture and the Slovak Committee for Higher Education (hereinafter referred to as the Slovak Committee) as an initiative, coordination and advisory body of the School and Culture Officer. In their activities, both committees rely on the work of expert committees (Section 6).
(2) The State Committee shall express and submit proposals on matters relating to:
(a) fundamental questions of scientific, artistic and research work at universities;
(b) fundamental teaching issues at universities;
(c) the organisation of universities;
(d) the appointment of professors and teachers of higher education institutions, the appointment of their representatives and the filling of posts of professors and teachers by bankruptcy proceedings;
(e) the appointment of rectors, prorectors and deputies of universities and heads of scientific (artistic) institutes and scientific laboratories;
(f) in other organisational, educational, scientific (artistic) and personnel matters of universities in which the Minister of Education and Culture requests observations.
(3) The Slovak Committee shall exercise its powers mutatis mutandis under paragraph 2 in matters relating to universities in Slovakia.
(4) The State Committee shall consist of the President, the three Vice-Presidents, the main secretary and a further maximum of 30 members appointed by the Minister of Education and Culture to represent the main groups of scientific (artistic) disciplines.
(5) The Slovak Committee shall consist of the President, the Vice-President, the Secretary and a further maximum of 17 members appointed by the School and Culture Authorisers, mutatis mutandis, in accordance with the provisions of paragraph 4.
(6) The Bureau of the State Committee shall be composed of the President, Vice-Presidents, Chief Secretary and, in addition, a maximum of 10 members of the State Committee appointed by the Minister for Education and Culture.
(7) The Bureau of the Slovak Committee shall be composed of the President, Vice-President, Secretary and, in addition, a maximum of six other members of the Slovak Committee, designated by the School and Culture Officer.
(8) The Organisational and Rules of Procedure of the State Committee shall be issued by the Minister for Education and Culture, the Slovak Committee responsible for Education and Culture.
Commission of Experts.
The Committee of State and the Slovak Committee for individual fields of higher education are set up as necessary to discuss professional matters. Their tasks and composition will be determined in more detail by the Minister for Education and Culture (responsible for education and culture).
The organization of universities.
(1) The head of the university is the rector.
(2) The university is usually divided into faculties. The dean is in charge of the faculty.
Rector.
(1) The Rector of the Minister for Education and Culture is responsible for the activities of the College.
(2) As a general rule, the Rector has two prorectors. According to the scope of the tasks of the university, this number may be reduced or increased.
(3) The Rector is appointed and dismissed by the President of the Republic, acting on a proposal from the Government, by the Minister for Education and Culture.
Scientific (artistic) college board.
(1) A Scientific Council (the Arts Council) is hereby established in the universities, which is to be held in the main pedagogical, political, scientific (artistic) and research matters of the university.
(2) If the Rector does not agree with the resolution of the Scientific (Artistic) Council, it shall notify its opposition to the Scientific (Artistic) Council and submit the matter to the Minister of Education and Culture for decision.
(3) The president of the scientific (artistic) council of the university is the rector, its members are the prorectors and dean of the faculty. Other members are appointed and withdrawn by the Rector; appoint them from the academics of science or from national and well-deserved artists working at a university, from the heads of departments, scientific (artistic) institutes, clinics and scientific laboratories of the same school, from excellent scientific (artistic) university staff and from practitioners. The Rector may invite other practitioners at the meeting of the Scientific (Artistic) Council, as well as representatives of the organisation of students and staff of the College with a consultative voice.
Rectorate.
(1) The Rector's Office (Rector's Office) is hereby established for the performance of the administration of the College. The Rector's Office shall be the personal office of the staff of the College.
(2) The Rectory Office is managed by the Quaestor of the High School, who is the permanent representative of the Rector for Economic and Administrative Affairs; appointed by the Minister for Education and Culture.
Dean.
(1) The Dean is responsible for the activities of the faculty.
(2) As a rule, the Dean has two Dean's. According to the scope of the faculty tasks, this number may be reduced or increased.
(3) The Dean and the Dean are appointed and dismissed by the Minister for Education and Culture. The Minister of Education and Culture may empower the Rector to appoint and dismiss the Dean.
Scientific (artistic) board of the faculty.
(1) There is a Science Council (the Faculty of Arts Arts Council), which is held in the main pedagogical, political, scientific (artistic) and research matters of the Faculty.
(2) If the Dean does not agree with the resolution of the Scientific (Artistic) Board of the Faculty, he shall notify his opposition to the Scientific (Artistic) Board of the Faculty and submit the matter to the Rector for decision; the rector shall decide after hearing the scientific (artistic) council of the university.
(3) The Dean is chairman of the Scientific (Art) Board of the Faculty, its members are the Prodekans, the Head of the Department of the Faculty and the Head of the Scientific (Artistic) Institute and Scientific Laboratories, the Director of the Faculty Hospital at the Medical Faculty and the Director of the Faculty Veterinary Hospital at the Veterinary Faculty. Other members are appointed and withdrawn by the Rector; appoint them from distinguished scientific (artistic) staff of the faculty and from practitioners. The Dean may invite other practitioners, as well as representatives of the organization of students and staff of the faculty with an advisory vote, to attend the meeting of the Faculty's Scientific (artistic) Board.
The dean.
(1) The Dean's Office (Dean's Office) is hereby established for the administration of the faculty. The Dean's Office is the staff of the faculty.
(2) The Dean's Office shall be chaired by the Registrar of the Faculty; It's called the Rector. The faculty secretary is the Dean's permanent representative for economic and administrative matters.
General Assembly
(1) The Dean of the Faculty shall convene at least once a year a general assembly of teachers, other staff and students of the Faculty, at which he shall report on the activities and tasks of the Faculty and shall discuss the proposals and requirements presented.
(2) The Rector may convene a general assembly of teachers, other staff and university students.
The departments.
(1) The basic organisational unit for teaching and scientific (artistic) work and for the education of scientific (artistic) youth at a university is the department.
(2) The departments are set up at the Faculty for one or several related fields or for a branch common to several universities or universities. The Department can also provide tasks for other higher education institutions.
(3) The departments shall be set up and their heads appointed by the Rector.
Scientific (artistic) institutes, scientific laboratories, cabinet, libraries, clinics and other facilities.
(1) For scientific (artistic) and research activities and for the education of scientific (artistic) births, scientific and artistic institutes and laboratories shall be established in universities according to the needs of the state's economic and cultural construction, for one or several related fields; can also serve several departments, faculties or universities. Scientific institutes and scientific laboratories are research institutes of universities; their establishment shall be governed by specific rules. The Minister of Education and Culture sets up and issues their statutes in agreement with the Minister of Finance.
(2) In order to deepen the pedagogical and scientific activities of the departments, in particular as regards preparatory work and indicative teaching, HEIs, particularly in the field of social sciences, are set up by the Cabinet. They're set up by the Rector.
(3) Scientific (artistic), research, pedagogical and university work serve libraries established at universities. They are set up by the Minister for Education and Culture.
(4) In agreement with the Minister of Finance, the Minister of Education and Culture may, if necessary, set up other elements and departments serving scientific (artistic) and educational purposes in universities.
(5) The practical training of students of higher education institutions as well as other higher education institutions or their faculties, which prepare for the teaching profession, shall be carried out at the associated secondary schools. The organisational status of the higher education institution is set out in detail.
(6) Practical training of medical students is carried out mainly in departments of faculty hospitals (clinics and clinics). The statutes of the faculty hospitals, issued jointly by the health and education and culture ministers, lay down details.
(7) Practical training of veterinary students is carried out mainly in departments of faculty veterinary hospitals (clinics). The rules of the faculty veterinary hospitals issued jointly by the Ministers for Agriculture, Forestry and Education and Culture lay down details.
(8) Where practical training of students is carried out at facilities other than the Ministry of Education and Culture, the competent Minister and Minister of Education and Culture shall jointly determine the conditions for carrying out such training.
More detailed arrangements and derogations and organisational rules.
(1) The details of the organisation of universities and their constituents, their competence and their relationship are laid down by the Minister for Education and Culture by regulation in agreement with the participating members of the Government; where justified by the specific nature of universities or faculties, it may provide for derogations from the principles laid down in Sections 7 to 16, in particular for universities with a significant number of faculties and for universities which are not divided into faculties.
(2) The tasks, organisation and management of individual higher education institutions are laid down in their organisational statute, to be issued by the Minister for Education and Culture in agreement with the participating members of the government. "
2. Paragraph 19-28 reads:
Study and scientific degrees.
Study and students.
(1) The Ministry of Education and Culture provides for a length of study at the university (faculty) in agreement with the participating members of the government.
(2) Students are admitted to higher education according to the capacity of candidates and taking into account the planned economic, social and cultural needs of the State.
(3) Students are obliged to work in such a way as to become both professionally and politically advanced builders of socialism.
(4) The State takes care of students in social, health, cultural and moral terms.
(5) Details of the admission of students to higher education are laid down and the provisions on the general rights and obligations of students are laid down by the Minister for Education and Culture in agreement with the participating members of the Government.
Extraordinary ways to study.
(1) Workers are allowed to obtain higher education without interruption of employment by exceptional means of study (long distance studies, evening studies, external studies, etc.).
(2) The Minister for Education and Culture, in agreement with the participating members of the Government, sets out details of the exceptional forms of study, in particular when specific facilities for extraordinary forms of study may be set up in universities.
College graduates.
(1) College studies are completed successfully by carrying out prescribed state final examinations.
(2) A university student who has completed the prescribed state final examinations (graduate of a university) will receive a diploma in a ceremonial manner, which will in particular be characterised by the specialisation of the study and shall indicate the title of the graduate according to the field for which he qualified.
(3) A graduate of a university who has studied and performed the prescribed state finals with excellent benefits will receive a diploma with distinction.
(4) The names of the fields of study and their corresponding designation of university graduates are laid down in a regulation by the Minister for Education and Culture in agreement with the participating members of the Government.
Scientific (artistic) aspiration.
(1) A scientific (artistic) aspiration is established in universities as one of the means for the education of scientific (artistic) workers.
(2) The Minister for Education and Culture sets out the details in an agreement with the President of the Czechoslovak Academy of Sciences and the members of the Government.
Scientific rank.
(1) Graduates of higher education who demonstrate special competence in their field of science and publicly certify that they are able to study independently scientifically, grant higher education degrees in two stages, namely the scientific rank of the candidate of science and the scientific rank of the doctor of science.
(2) Under the same conditions, scientific degrees may be awarded exceptionally to non-university graduates.
(3) In order to express a high honor for the special merit of progress in the field of science, culture and social relations, the Scientific (artistic) Board of Higher Education, with the approval of the Minister of Education and Culture, may grant the honorary scientific rank of Doctor of Sciences.
(4) The award of scientific evaluations is governed by specific provisions.
Nostrification.
(1) The Minister for Education and Culture, in agreement with the participating members of the Government, provides for the conditions under which studies and scientific degrees (certificates and diplomas) obtained at foreign universities and scientific (artistic) institutes may be recognised.
(2) Studies (certificates and diplomas) obtained in foreign universities may be recognised by the Ministry of Education and Culture; The Ministry of Education and Culture may delegate decisions to a university or faculty.
Teachers, other university staff and scientific and educational degrees.
(1) The following university staff are active at universities:
1. teachers:
(a) professors,
(b) docents,
(c) professional assistants,
(d) tutors;
(e) assistants,
(f) professional instructors;
2. scientific research, after the case of artists;
3. management and support librarians;
4. technical and other experts (in particular engineers, mechanics, technicians, etc.);
5. Administrative staff;
6th relief workers.
(2) External teachers may also operate in universities as required.
(3) The Government may amend or supplement the groups of staff referred to in paragraph 1.
(1) The designation "Professor" and "Docent" is a scientific and educational title, in the fields of art and teaching. It is for all workers who have been appointed professors or professors at universities.
(2) Professors of higher education for certain scientific or artistic fields shall be appointed by the President of the Republic from among those who have demonstrated outstanding competence in scientific (artistic) and teaching, as a general rule from the doctors of science or from university teachers. The proposal is submitted to the Government by the Minister for Education and Culture, in Slovakia by the College of Authors.
(3) Teachers of higher education for certain scientific or artistic fields are appointed by the Minister of Education and Culture from persons who have demonstrated the necessary competence of scientific (artistic) and teaching in habilitation management, as a general rule from candidates for science.
(4) The places of professors and teachers in universities are essentially covered by bankruptcy. The Minister for Education and Culture shall determine the details of the habilitation management and occupation of professors and teachers at universities. The Minister for Education and Culture may provide for a transitional period to be waived for certain fields from the condition of habilitation proceedings.
(5) The position of professors and teachers in universities is determined and amended by the Minister for Education and Culture.
(6) Professors and professors in higher education shall cease this title by distying or discontinuing their employment under § 19 (2) (b) to (d) or (f) or § 20 of Act No. 66 / 1950 Coll., on the employment and pay ratios of civil servants. The sentence to the loss of civil rights is also imminent in the end of that title.
(7) The Minister of Education and Culture may appoint a temporary representative if no professor or professor is appointed for a particular field of science or art. This applies mutatis mutandis if the professor or the professor cannot perform his duties for a longer period.
(8) As a general rule, the employment of a university professor lasts until the end of the semester in which he reaches the 70th year of age. Exemptions are permitted by the Minister for Education and Culture after the State Committee has expressed its views.
(9) The Minister for Education and Culture sets out the period for which and under which conditions vocational assistants and assistants are admitted to university.
(1) The Minister for Education and Culture usually decides on the basis of the result of the bankruptcy proceedings whether the conditions for the professor or the professor to continue to be a professor or professor are met.
(2) Professors and professors who have not met the requirements of the bankruptcy procedure will be placed at another place of competence according to the relevant regulations.
(3) The Minister for Education and Culture sets out the details, in particular how the bankruptcy procedure will be implemented.
Where this law does not itself regulate the rights and obligations of university staff, specific provisions shall apply to such rights and obligations. Specific provisions shall also provide for their pay ratios. ';
3. Paragraph 35 reads: "The Government provides which provisions of this Act also apply to military universities."
(1) The provisions of the Act on Higher Education, as amended by that Act, are hereby repealed; in particular, the following shall be deleted:
1. the Decree of the Minister for Education, Science and Arts No. 130 / 1950 Coll., establishing the Rules of Organisation and Procedure of the State Committee for Higher Education and its Scope,
2. the Decree of the Minister for Education, Science and Arts No. 92 / 1952 Coll., which regulates the management and management of universities,
3. § 17 of Government Decree No. 60 / 1953 Coll., on Scientific Aspects and on the Designation of Graduates of Higher Education,
4. regulations on nostalification and recognition of foreign studies, certificates and diplomas.
(2) Without prejudice to the following provisions:
1st Government Order No. 97 / 1953 Coll., on the High Party School at the Central Committee of the Communist Party of Czechoslovakia,
2. Government Decree No. 60 / 1953 Coll., with the exception of the provisions of § 17, and the provisions issued for its implementation.
This Law shall take effect from the date of its publication; It shall be carried out by Ministers for Education and Culture, Health, Agriculture and Forestry and National Defence in agreement with participating members of the Government.
