THE LAW
of 27 November 2001
amending Act No. 128 / 2000 Coll., on Municipality (municipal establishment), as amended, Act No. 129 / 2000 Coll., on Counties (regional establishment), as amended, Act No. 131 / 2000 Coll., on the City of Prague, as amended, Act No. 250 / 2000 Coll., on the Budgetary Rules of the Territorial Budget, as amended by Act No. 320 / 2001 Coll., Act No. 218 / 2000 Coll., on the Budgetary Rules and on the Amendments to Certain Related Laws (Budgetary Rules), as amended, and Act No. 101 / 2000 Coll.
Parliament has decided on this law of the Czech Republic:
Amendment of the Municipality Act (municipal establishment)
Act No. 128 / 2000 Coll., on municipalities (municipal establishment), as amended by Act No. 273 / 2001 Coll. and Act No. 320 / 2001 Coll., is amended as follows:
1. In Paragraph 38, the following paragraphs 3, 4 and 5 are inserted after paragraph 2:
"(3) The municipality shall not be liable for its assets for the obligations of natural persons and legal persons to whom it is not the founder.
(4) Legal acts taken in breach of paragraph 3 shall be void from the outset.
(5) The State is not liable for the management and liabilities of the municipality if the State does not take over this obligation contractually. "
Paragraphs 3 and 4 shall be renumbered paragraphs 6 and 7.
2. In Paragraph 85, the present text becomes paragraph 1 and the following paragraphs 2, 3, 4 and 5 are added:
"(2) The Government shall approve the conclusion of a contract to accept a loan or loan from abroad.
(3) The Government approves the issue of municipal bonds.
(4) The municipality must not accept a loan if its debt service exceeds 15% of its own budget last year.
(5) Legal acts taken in breach of the provisions of paragraphs 2 and 3 shall be void from the outset. "
Amendment of the Regional Act (Regional Establishment)
Act No. 129 / 2000 Coll., on Counties (Regional Establishment), as amended by Act No. 273 / 2001 Coll. and Act No. 320 / 2001 Coll., is amended as follows:
1. In Article 17, the following paragraphs 3, 4 and 5 are inserted after paragraph 2:
"(3) The county shall not be liable for the liability of natural persons and legal persons to whom it is not an authority.
(4) Legal acts taken in breach of paragraph 3 shall be void from the outset.
(5) The State is not liable for the economy and the commitments of the Region if the State does not take over this obligation contractually. "
Paragraphs 3 and 4 shall be renumbered paragraphs 6 and 7.
2. In Paragraph 36, the present text becomes paragraph 1 and the following paragraphs 2, 3 and 4 are added:
"(2) The government shall approve the issuance of bonds issued by the regions.
(3) Legal acts taken in breach of paragraph 2 shall be void from the outset.
(4) The Region must not accept a loan if its debt service exceeds 15% of its own budget last year. "
3. In Title Seven, the words "AND GOVERNMENTS 'shall be inserted in the title after the words" RELATING TO MINISTERSTEV'.
Amendment to the Prague Capital Act
Act No. 131 / 2000 Coll., on the City of Prague, as amended by Act No. 145 / 2001 Coll., Act No. 273 / 2001 Coll. and Act No. 320 / 2001 Coll., is amended as follows:
1. In Article 35, paragraphs 6, 7 and 8 are added:
"(6) The City of Prague and the City of Prague must not be liable for the obligations of natural persons and legal persons to whom they are not the founder.
(7) Legal acts taken in breach of paragraph 6 shall be void from the outset.
(8) The State is not liable for the management and liabilities of the capital city of Prague if the State does not take over this obligation contractually. "
2. In Paragraph 59, paragraphs 6, 7 and 8 are added:
"(6) The Government shall approve the conclusion of a contract to accept a loan or loan from abroad.
(7) Legal acts taken in breach of paragraph 6 shall be void from the outset.
(8) The City of Prague or the City may not accept a loan if its debt service exceeds 15% of its own budget last year. "
Amendment of the Act on the budgetary rules of the territorial budgets
In Act No. 250 / 2000 Coll., on the budgetary rules of the territorial budgets, in § 8 (1) (i) the word "municipality" is replaced by the word "county."
Amendment of the budgetary rules law
Act No. 218 / 2000 Coll., on budgetary rules and amending certain related laws (budgetary rules), as amended by Act No. 493 / 2000 Coll., Act No. 141 / 2001 Coll., Act No. 187 / 2001 Coll. and Act No. 320 / 2001 Coll., is amended as follows:
1. In Article 7 (1), the dot at the end of point (r) is replaced by a comma and the following point (s) is added:
"(s) expenditure in the public interest by decision of the Presidents of both chambers of Parliament or of the Prime Minister, the amount of which shall be determined by the Government by regulation.";
2. In Article 7, the following sentence is added at the end of paragraph 2: "The expenditure referred to in paragraph 1 (s) shall not be covered by this law. '.
EFFECTIVE
This Act shall take effect on the day of its publication.
