amending and supplementing Decree No. 83 / 1976 Coll., on General Technical Requirements for Construction
The Federal Ministry of Technical and Investment Development provides, pursuant to § 143 (1) (k) of Act No. 50 / 1976 Coll., on Territorial Planning and Construction Regulations (Construction Act):
Decree of the Federal Ministry of Technical and Investment Development No. 83 / 1976 Coll., on General Technical Requirements for Construction, is amended as follows:
Article 1 (2) reads as follows:
"(2) The superstructures, modifications and maintenance work on the buildings shall be carried out in accordance with this decree. '
Article 2 (4) (6) reads as follows:
"(6) Building land may be fenced or fenced if it is desirable in particular for reasons of safety, protection of property, the specific nature of the construction or general arrangement when the construction is incorporated in the territory. '
3. Paragraph 44 reads as follows:
(1) If the family houses form a free space between them, the distance between them shall be 10 m, but shall not be less than 7 m.
(2) The distance between family houses forming free space shall not be less than 3 m from the common boundaries of the land. If the dimensions of the building plot would make it impossible for an efficient layout to build a family house, the construction office may, exceptionally, reduce its distance from the common boundary of the land to 2 m.
(3) In particularly cramped territorial conditions where the distances referred to in paragraph 1 cannot be respected, the construction office may reduce the distance between the family houses to up to 4 m if there are no windows in any of the opposite parts of the walls. In such cases, the provisions of paragraph 2 on the distances of family houses from the common boundaries of land need not apply.
(4) The distances shall be measured on the shortest link between the outer surfaces of the perimeter walls, or from the outer edges of the entrances, balconies, logbooks, terraces, from the boundaries of the land, etc. '.
4. In Paragraph 45 (1), the words "garages and 'and the words" small ones' are deleted.
5. In Paragraph 45 (2), the words "garages and change 'are deleted.
6. Article 45 (4) reads as follows:
"(4) The provisions of Paragraph 44 shall not apply to buildings placed on the building grounds of family houses referred to in paragraph 1. '
7. Article 53 (7) reads as follows:
"(7) Only small buildings that do not significantly affect the environment and fulfil the complementary function of holiday cottages in the landscape or appropriately complement their recreational purpose may be located on the building grounds of holiday cottages in the landscape only if the provision of such a function in the building is inappropriate. Garages for passenger motor vehicles may be established only as integrated into holiday cabins. ';
8. In Paragraph 56, the following paragraph 3 is inserted after paragraph 2:
"(3) Only such buildings which do not significantly affect the environment and fulfil the complementary function of holiday homes or appropriately complement their recreational purpose may be located on the building grounds of holiday homes only if, for reasons of construction engineering, such a function cannot be provided directly in holiday homes."
9. Paragraph 56 (3) becomes paragraph 4.
10.
(1) The provisions of § 56 (2) to (4) shall apply to the modification of the construction of holiday cottages and to the placement of buildings which perform an additional function to holiday cottages.
(2) The original character of the construction is to be preserved during the modifications. '
This Decree shall take effect on 1 May 1979.
