of 12 December 2017
amending Decree No. 428 / 2001 Coll., implementing Act No. 274 / 2001 Coll., on water and sewage for public use and amending certain laws (Water and Sewerage Act), as amended
The Ministry of Agriculture provides pursuant to § 40 of Act No. 274 / 2001 Coll., on water and sewage for public use and on the amendment of certain laws (Water and Sewerage Act), as amended by Act No. 76 / 2006 Coll. and Act No. 275 / 2013 Coll.:
Decree of the Ministry of Agriculture No. 428 / 2001 Coll., implementing Act No. 274 / 2001 Coll., on Water and Sewerage for Public Use and on the amendment of certain laws, as amended by Decree No. 146 / 2004 Coll., Decree No. 515 / 2006 Coll., Decree No. 120 / 2011 Coll. and Decree No. 48 / 2014 Coll., is amended as follows:
1. the heading of Part One shall read:
"INTRODUCTORY PROVISIONS."
2. In Part One, the following Section 1 is inserted:
Subject matter
This decree regulates
(a) the scope and manner of processing of the water supply and sewerage development plan and the electronic form, format and content to be provided by updating the development plan;
(b) the manner and content of the management of the ownership records of water ducts and sewerage, their operational records and the records of the selected data on water ducts and sewerage, including the way in which the data collected are transmitted from the ownership and operational records of water ducts and sewerage,
(c) the established format of the application for authorisation to operate a water duct or sewerage and related field in the water and sewage sector;
(d) the content of the plan for financing the recovery of water ducts and sewerage and the rules governing its processing;
(e) the method of calculating compensation for losses in the case of unauthorised water collection or discharges;
(f) technical requirements for the construction of water pipelines;
(g) requirements for waste water treatment, requirements for project documentation for waste water treatment, requirements for the construction and operation of waste water treatment plants and requirements for their project documentation and requirements for the construction and operation of the sewer network;
(h) quality indicators for raw water taken from surface water sources or groundwater for treatment to drinking water;
(i) the elements of the sewage system and the requirements for analysis of waste water samples;
(j) determining the quantity of water collected without measurement;
(k) general technical conditions for measuring the quantity of water delivered;
(l) the method of calculating the quantities of waste and withholding water discharged into the sewerage without measurement;
(m) the method of calculating the fixed component of the aqueous and ductile components at payment in two-component form, the breakdown of the cost items, their content, the volume and the quantity items and their proportion in the calculation of the price according to the price regulations for the aqueous and tapered products and the comparison of all the items for the calculation of the price for the aqueous and tapered products with the facts achieved;
(n) the content and use of technical audits and the detailed conditions for the inclusion of a competent natural person in the list of technical auditors. ';
Paragraph 1 is renumbered Article 1a.
3. In Article 4 (2) of the Introductory Part of the provision, the words "via the Water and Sewerage Information System 'shall be inserted after the word" Development'.
4. In Article 6, the following paragraph 4 is inserted after paragraph 3:
"(4) The Water Authority shall transmit the data of property records processed in accordance with Section 5 (4) of the Act to the Ministry through the Water Water Information System and Sewerage. '
Paragraph 4 shall become paragraph 5.
5. In Article 7, the following paragraph 7 is inserted after paragraph 6:
"(7) The Water Authority shall transmit the data processed under Section 5 (4) of the Act to the Ministry through the Water Water Information System and Sewerage. ';
Paragraph 7 shall become paragraph 8.
6. In Paragraph 10 (1), the word "recovery 'shall be inserted after the words" maintenance, repair'.
7. In the third sentence of Paragraph 10 (3), "reconstructed 'is replaced by" renewed'.
8. In Article 10 (4), the words "following the restoration of water ducts and sewerage and beyond 'shall be inserted after the words" to be adapted on an ongoing basis'.
9. In Paragraph 11, the sentence "The operating logbook and the operating records must be kept to serve as a basis for operational decision-making and for the owner as evidence of the way in which the water-based assets are operated 'is added to the beginning of paragraph 1.
10. In the second sentence of Article 11 (1), the words "and records of the measures taken concerning the operation of the water duct and resulting from the conclusions of the risk assessment32 'shall be added after the words" drinking water or sewerage', in accordance with the Ordinance on sanitary requirements for drinking and hot water and checks on drinking water33).

11. In Paragraph 11, at the end of paragraph 3, the words "or may be kept electronically. Operating records shall be kept for 5 years. ';
12. in Paragraph 12 (2):
"(2) The information provided by the Regional Authority under Section 6 (10) of the Act is transmitted to the Ministry through the Water and Sewerage Information System. The format and structure of the application for registration are set out in Annex 23 to this Decree. ';
13. in Article 12a (1) of the introductory part of the provision and in Article 12a (2), the number "4" is replaced by "6."
14.
(1) The content of the financing plan for the recovery of water ducts and sewerage is:
(a) the definition of infrastructure assets broken down by selected data by property records at the replacement cost calculated in accordance with Annexes 1 to 4 to this Decree;
(b) an assessment of the state of the property, expressed as a percentage of wear,
(c) indication of the theoretical time of accumulation of funds;
(d) the annual need for and coverage of funds; and
(e) documents showing the use of the funds generated, including invoices or copies thereof.
(2) The preparation of the plan referred to in paragraph 1 shall be carried out in accordance with Annex 18 to this Regulation.
(3) The update of the plan referred to in paragraph 1 shall be carried out in the calendar year following the calendar year in which the property of the owner has changed by more than 10% of the value of the property referred to in the recovery plan, but not more than 10 years after its processing or, where applicable, the last update. Each update made shall be part of the original plan for the financing of the recovery of water ducts and sewerage.
(4) The plan for the financing of the recovery of water ducts and sewerage must be drawn up in such a way as to provide a reserve of funds for the recovery of water ducts and sewerage. An overview of the creation and utilisation of recovery funds, prepared in accordance with Table 4 of Annex 20 to this Decree, in relation to the plan for financing the recovery of water pipelines and sewerage in each year shall be documented in the comparison provided for in Section 36 (5) of the Law. '
15. in Article 14 (3) and (4), the words "tap or" shall be deleted;
16. In Article 15 (5), "connection 'is replaced by" connection'.
17. in Article 15 (12), the words "special legislation13)" shall be replaced by the words "the health requirements for products coming into direct contact with water and for the treatment of water34."
Footnote 34 reads:
"34) Decree No. 409 / 2005 Coll., on sanitary requirements for products in direct contact with water and for water treatment, as amended."
footnote 13 is deleted.
18. in Paragraph 16 (h), the words "or tertiary" shall be inserted after the word "further."
19. in Paragraph 21 (3), "5 and 6" is replaced by "4 and 5."
20. Paragraph 21 (4) reads:
"(4) The operator shall transmit the results of the analyses once a year to the Regional Authority and the competent river basin administrator by 31 March each year for the previous year, within the scope of Tables 1 and 2 of Annex 9 to this Decree, through a database managed by the Czech Hydrometeorological Institute. The operator will use the electronic application published on the website of the Czech hydrometeorological institute to enter the results into the database."
21. In Paragraph 22 (5), first sentence, the word "surface" shall be deleted.
22. In the second sentence of Article 22 (5), the words "raw surface water 'shall be inserted after the words" samples'.
23. The following Section 35b is inserted after § 35a:
The calculation of prices for water and sewage shall include the funds for the renewal of water pipelines and sewerage lines 8 and 16 of the table of the financing plan for the recovery of water pipelines and sewerage pursuant to Annex 18 to this Regulation. ';
24. Annexes 1 and 2 shall read as follows:

TECHNICAL INDICATORS FOR THE WATER QUALITY CONTROL PLAN
MODELS OF SAMPLES IN CONTROL PROFILE
a) Influence of crude water used for drinking water treatment, for water without treatment - before disinfection. Raw water samples shall be taken before the first technological intervention.
Where raw water is supplied from several water sources, samples shall be taken from their mixture. The control of individual sources shall be carried out when there is an abnormal change in the quality of mixed raw water.
(b) Water during treatment by a technological line, if the treatment technology exists. Water checks during treatment by the technological line shall be carried out, where possible, between stages; the place of inspection shall be determined by the person responsible for the adaptation technology.
c) Output of the water produced from the water treatment plant, output of the water produced by the water protected.
(d) Strategic sites of the distribution network, including water sinks.
(e) Places where drinking water flows from taps intended for human consumption. These places are determined in accordance with Decree No. 252 / 2004 Coll.
MINIMUM SCOPE OF THE DIFFERENCE REQUIREMENTS
The following types of analysis are distinguished according to the scope of the indicators and depending on the necessary monitoring requirements:
1. COMPLETION
2. CHANGED DIFFERENCE
3. OPERATIONAL DISTRIBUTION
1. COMPLETE DIFFERENCE OF DEROGED RAW WATER
A complete analysis of the raw water shall be determined whenever the raw water is first included in the category referred to in Section 22 and subsequently for the confirmation of the raw water category.
Samples and analysis to the extent of complete raw water analysis shall be provided to the holder of the accreditation certificate, to the holder of the laboratory's good functioning certificate or to the authorisation holder.
The scope of the parameters of the complete raw water analysis shall be extended by indicators which result from the risk assessment carried out under Decree No. 252 / 2004 Coll. for the raw water source concerned.

Notes to Table 1:
Indicator No 37 is expressed as the sum of the concentrations: (benzo (b) fluorantene, benzo (k) fluorantene, benzo (ghi) perylene, indeno (1,2,3-cd) pyrene. If the substance is not quantitatively detected, zero is added to the sum.
Indicator No 38 is expressed as the sum of individual pesticides and their relevant metabolites. These are pesticides which are likely to be present in crude water, according to the pesticides used in the territory. If the substance is not quantitatively detected, zero is added to the sum.
Indicator No 39: All individual pesticides and their significant metabolites likely to occur in raw water are monitored, in particular those resulting from the conclusions of the risk assessment carried out under Decree No 252 / 2004 Coll. for the water source.
Indicators 40 and 41: Only one indicator can be selected for TOC and CHSKMn.
To indicator 48: It shall be established as an indication value for the decision to analyse other indicators, in particular organic micro-pollutants, since the A1254 = 0,08.
2. SHORT DISTRIBUTION OF RAW WATER
The reduced raw water analysis serves to specify the raw water category in accordance with § 22 and to monitor the quality constantly. The results of the operational analyses shall also be taken into account.
In the year when the raw water category is confirmed by full analysis, the complete analysis shall replace the reduced analysis.
Indicators according to Table 2 are included within the range of the cut-off analysis, the cut-off analysis is extended by:
(a) indicators from the complete raw water analysis which exceed 75% of the limit value for drinking water provided for in Decree No. 252 / 2004 Coll.; if subsequent analyses for 2 calendar years show a decrease in value below 75% of the limit value for drinking water provided for in Decree No. 252 / 2004 Coll., the monitoring indicator may be excluded from the analysis. The condition is that at least 2 analyses will be carried out in a given calendar year.
(b) indicators equal to or exceeding the value of Category A 2 determined in the previous categorisation of the raw water (according to Annex 13 to this Decree).
(c) indicators which result from a risk assessment carried out in accordance with Decree No 252 / 2004 Coll. for a given raw water source.
(d) indicators that vary significantly during the year (occurrence of the indicator in two categories such as seasonal changes).
Samples and analysis in the range of shortened raw water analysis shall be ensured for the holder of the accreditation certificate, for the holder of the laboratory's good functioning certificate or for the authorisation holder.

Comments on Table 2 indicators:
Indicators 17 and 18: Only one indicator can be selected for TOC and CHSKMn.
To indicator No 23: It shall be established as an indication value for the decision on the analysis of the other indicators, starting from the A1254 value = 0,08.
3. OPERATIONAL DISTRIBUTIONS OF RAW WATER AND WATER BETWEEN TECHNOLOGICAL STUDENTS
1. Operating water analyses mainly serve for technological management of the operation.
2. The scope of the operational analyses between the various technological stages is determined by the operator according to the complexity of the treatment, the composition of the water treatment line and the results of the risk assessment prepared in accordance with Decree No. 252 / 2004 Coll. These analyses must ensure proper operation of the water treatment plant and resources without modification.
3. Mobile analytical kits can be used for analyses to ensure the correct and accurate analysis.
4. Operational analyses may be partially or completely replaced by continuous operational measurements. Continuous analysers shall be suitable for the type of water concerned and the range of parameters monitored. The functionality of continuous analysers shall be regularly and demonstrably verified.
5. The results of the operational analyses, including continuous analysers, are metrologically linked to the laboratory that holds the accreditation certificate, the laboratory certificate or the authorisation holder in accordance with the monitoring programme in accordance with Decree No. 252 / 2004 Coll. and the manufacturer's recommendation.
6. The collection and analysis of the operational analyses need not be ensured for the holder of the accreditation certificate, for the holder of the laboratory's good functioning certificate or for the holder of the authorisation.
7. Technological tests (in particular determination of the dose of chemicals) for proper operation shall be determined by the operator as appropriate and according to the complexity of the technology.
The table shows typical indicators for raw water operations. The choice of typical indicators and the extension of other indicators needed to manage the operation is determined by the operator depending on the variability in the quality of the raw water, the manner and complexity of the water treatment technology and the outputs from the risk assessment carried out in accordance with Decree No. 252 / 2004 Coll.
